FATHER GOD, WE THANK YOU FOR THIS DAY AS WE PREPARE FOR TODAY'S MEETING.

WE PRAY FOR YOUR PROTECTION, STRENGTH AND YOUR GUIDANCE.

WE PRAY FOR OUR CITY LEADERS AND OUR CITIZENS.

AND I ASK THAT YOU GIVE US WISDOM IN THE DECISIONS THAT LIE AHEAD AND YOUR CONTINUED STRENGTH AS WE CONTINUE TO SERVE IN A WAY THAT HONORS AND GLORIFY YOUR NAME.

AND AS WE CELEBRATE WOMEN'S HISTORY AND HEALTH AWARENESS DURING THIS MONTH, I PRAY THAT WE REMEMBER THE CONTRIBUTIONS AND THAT WE PAUSE FOR THOSE WITH DISABILITIES. MAY WE NEVER FORGET THAT WE ARE HERE TO SERVE OTHERS.

I WANT TO FIRST SAY HAPPY INTERNATIONAL WOMEN'S DAY TO ALL THE WOMEN OUT THERE, AND WE'D LIKE TO SHARE THE PROCLAMATION YOU HAVE GIVEN FOR THIS EVENT.

BUT FIRST, I WANT TO SAY THANK YOU FOR YOUR ENDLESS SUPPORT OF PUBLIC SAFETY AND SPECIFICALLY TODAY FOR WOMEN.

SO THE PROCLAMATION READS WHEREAS WE BELIEVE WOMEN SHOULD HAVE THE RIGHT TO FEEL SAFE AND COMFORTABLE IN DALLAS AT ALL TIMES, BUT ESPECIALLY AT NIGHT.

AND. WHEREAS, IN SUPPORT OF WOMEN AND OUR CITY'S 24 HOUR ECONOMY, THE PUBLIC IS INVITED TO ATTEND WOMEN UNITE ON MARCH 8TH, WHICH IS TONIGHT AT KESSLER THEATER. AND.

WHEREAS, WOMEN UNITE, COINCIDING WITH INTERNATIONAL WOMEN'S DAY, WILL BRING ATTENTION TO THE ISSUE OF NIGHT TIME SAFETY.

THE EVENT WILL ALSO SERVE AS A SOCIAL GATHERING FOR NORTH TEXAS WOMEN TO CELEBRATE COMMUNITY COLLABORATION AND NETWORKING AT NIGHT.

NOW, THEREFORE, I, ERIC JOHNSON, MAYOR OF THE CITY OF DALLAS, DO HEREBY PROCLAIM MARCH 8TH, 2023, AS WOMEN UNITE IN DALLAS, TEXAS, AND ENCOURAGE ALL BUSINESSES AND COMMUNITY MEMBERS TO VISIT 24HOURDALLAS.ORG TO TAKE ADVANTAGE OF SAFETY RESOURCES AND TO SIGN THE CHARTER ADVOCATING FOR WOMEN'S NIGHTTIME SAFETY.

I'LL POINT OUT JUST ONE FACT, WHICH IS 1 IN 5 WOMEN IN THE US HAS BEEN RAPED IN THEIR LIFETIME.

I THINK WE NEED TO CONSIDER THAT AND DO ALL THE THINGS THAT WE CAN TO HELP MAKE SURE THAT CUSTOMERS, EMPLOYEES, EVERYONE CAN FULLY PARTICIPATE IN OUR NIGHTTIME ECONOMY.

AND. WHEREAS, INTERNATIONAL WOMEN'S DAY HAS OCCURRED FOR WELL OVER A CENTURY, WITH THE FIRST COMMEMORATION OCCURRING IN 1911.

WE WERE TOLD THAT THIS IS GOING TO BE SOMETHING TINY AND, YOU KNOW, WE DON'T EVEN NOTICE IT.

IT'S GOING TO GO UP ON AN EXISTING POLE.

WELL, AS I FORWARDED IT TO YOU, THEY INSTALLED A NEW POLE AND SOMETHING GIGANTIC.

AND WE LIVE IN A NEIGHBORHOOD THAT THERE ARE CHILDREN IN OUR HOUSES.

THERE ARE PEOPLE OF DISABILITY WHO LIVE JUST ADJACENT TO ME.

THE FIRST WE HEARD OF THIS OR GIVEN NOTICE OF WAS OCTOBER OF 2022, AND THEY LED US TO BELIEVE THIS IS SOMETHING MINIMAL. NO HEALTH ISSUES, BUT I DOUBT IT.

AND WHOEVER I'VE SPOKEN TO IN THE CITY OF DALLAS AND OTHER AUTHORITIES, THEY DON'T SEEM TO CARE UNTIL WE HAVE A PROOF THAT SOMEBODY IS GETTING HURT OR THERE'S A CANCER ISSUE INVOLVED WITH THIS RADIATION THAT THESE THINGS EMIT.

AND I'M ASKING YOU TO PERHAPS IF YOU CAN LOOK INTO THIS.

I DON'T KNOW WHERE ELSE TO TURN.

I'VE TALKED TO ATTORNEYS.

UNFORTUNATELY, I CANNOT AFFORD TO HIRE AN ATTORNEY.

BUT STR OWNERS, THEY REALLY DON'T SEEM TO THINK ZONING REGULATIONS APPLY TO THEM.

IF YOU ALLOW THESE COMMERCIAL LODGING BUSINESSES TO OPERATE IN OUR NEIGHBORHOODS, YOU WILL BE DESTROYING RESIDENTIAL ZONING.

THEY ARE LIKE AN INVASIVE SPECIES IN THE PLANT WORLD THAT DESTROY ALL THE GOOD PLANTS.

STRS NEED TO BE CONTAINED WITHIN AREAS ZONED FOR SIMILAR BUSINESSES, COMMERCIAL AND MIXED USE AREAS.

LAST YEAR WE DECIDED TO SELL ONE OF OUR TWO DUPLEXES NEXT DOOR BECAUSE THE GARAGE NEEDED FOUNDATION WORK.

AND WE'RE AT THE AGE THAT WE REALLY DIDN'T WANT TO TAKE ON A BIG PROJECT FROM THE ONSET.

WE WERE DETERMINED TO ONLY SELL TO A BUYER WHO WOULD ACTUALLY LIVE IN THE DUPLEX AND BECOME PART OF THE NEIGHBORHOOD.

WE TURNED DOWN SEVERAL LOCAL AND OUT OF STATE INVESTORS.

WE WOUND UP SELLING TO A PERSON WHO SAID HE WAS BUYING FOR A FAMILY MEMBER WHO WOULD LIVE IN THE DUPLEX.

INSTEAD, HE TURNED THE PROPERTY THREE UNITS INTO STRS.

WHEN I CALLED THE OWNER, HE SAID, AND I QUOTE PEAKS EDITION HAS LOTS OF STRS.

I CONVERTED ALL OF MY LONG TERM RENTALS TO SHORT TERM RENTALS TO AVOID BAD TENANTS AND TO INCREASE MY PROFITS.

SO WITH THAT BEING SAID, WE'VE BEEN CHALLENGED BY THE CITY STAFF AND BEEN ON A CANCELING PROCEDURES WITH THE TRADEMARK OFFICE IN WASHINGTON DC THAT THE CITY STAFF IS TRYING TO CANCEL OUR CANCELLATIONS, NOT ONLY ONE CANCELLATION THAT WE'VE BEEN GOING THROUGH THE PROCESS FOR THE PAST TWO YEARS AND NOW WE'RE AS A SMALL BUSINESS, WE'VE BEEN OVER $100,000 WORTH OF LEGAL FEES.

IN ADDITION, HE IS SERVING AGAIN ON THE CORRECTIONS COMMITTEE, WHICH IS A HIGH VALUE IN TERMS OF CRIMINAL JUSTICE REFORM, AND WE'RE GRATEFUL FOR THAT FOR A THIRD SESSION.

BUT WE HAVE A NEW COMMITTEE WE'VE BEEN ASSIGNED TO, WHICH IS LAND AND RESOURCE MANAGEMENT.

AND SO THAT MAY RELATE TO YOU AND BE INTERESTING TO SOME OF YOU IN PARTICULAR RELATED TO ISSUES THAT MAY COME UP WITH YOUR DISTRICTS.

A COUPLE OF ITEMS I WANT TO SHARE WITH YOU ABOUT BILLS THAT WE FILED THAT WE'RE LOOKING FORWARD TO WITH A PRIORITY THIS SESSION.

ONE IS THE MINIMUM SALARY FOR OFFICERS BILL, WHICH IS HB 1354.

THERE ARE MANY MUNICIPALITIES UNDER 5000 THAT OFFICERS ARE BEING PAID $25,000, $30,000.

AND WE WANT TO MAKE SURE THAT THE STATE SUPPLEMENTS TO MAKE SURE THAT'S A MINIMUM IN THOSE CITIES OF $55,000 TO RECEIVE THE SUPPLEMENTAL SALARY, OFFICERS MUST ANNUALLY FILE AN AFFIDAVIT STATING THAT THEY HAVE NEVER BEEN DISHONORABLY DISCHARGED BY ANY LAW ENFORCEMENT AGENCY AND ARE NOT CURRENTLY UNDER INVESTIGATION FOR ALLEGED MISCONDUCT.

AND SO THIS IS GOING TO UP OUR EXPECTATION OF OUR OFFICERS, BUT IT'S ALSO GOING TO GIVE THEM PAY.

IT'S MORE COMMENSURATE WITH THE RISK THAT THEY TAKE.

ANOTHER BILL THAT WAS JUST FILED YESTERDAY ACTUALLY IS OUR ECONOMIC DEVELOPMENT FOOD DESERTS BILL, WHICH IS GOING TO WORK TOWARD ENSURING THAT SUPPLY CHAIN ISSUES ARE DEALT WITH. AND SO WE HOPE YOU'LL CONTINUE TO TRACK THAT ONE.

AND THE LAST BILL I WANT TO HIGHLIGHT IS OUR AC IN PRISONS BILL, HB 1355, WHICH IS GOING TO ENSURE THAT TEMPERATURES AT THE STATE JAILS ARE KEPT AT AN ADEQUATE TEMPERATURE. RIGHT NOW, TEMPERATURES CAN GET UP TO 100 TO 140 DEGREES AND IT'S CAUSING THE DEATHS AND A LOT OF PROBLEMS WITH OUR INMATES AND ALSO OUR STAFF. AND SO I WANTED TO UPDATE YOU ON THOSE BILLS.

BUT WE CAN EASILY CREATE WITH THIS THESE DOLLARS FROM HUD, WHICH I'M VERY HAPPY TO HAVE IMMEDIATE LOCATIONS THAT SOMEBODY COULD COME OFF OF AN ENCAMPMENT, BE GIVEN A PALLET WHERE THEY'LL HAVE PRIVACY, THEY'LL STILL HAVE COMMUNITY, THEY'LL HAVE WRAPAROUND SUPPORT SERVICES AND ALL THE PROVIDERS OF THE CITY WILL HAVE A FOCUS OF WHERE THEY CAN GO TO HELP PEOPLE BECOME INDEPENDENT AGAIN.

RECENTLY, I POLLED THE NEIGHBORS REGARDING THE FINAL PLANS OF THE SPROUTS DEVELOPMENT AND RECEIVED A UNANIMOUS YES IN FAVOR OF THE DEVELOPMENT TO OCCUR.

NEIGHBORS ARE EXCITED ABOUT THE SUPERMARKET COMING TO OUR AREA, GIVING US ANOTHER WHOLESOME FOOD OPTION ALONG WITH NEW RESTAURANTS AND THE UPGRADE TO THE WHOLE AREA.

WE ARE HAPPY WITH THE LANDSCAPING, THE DRAINAGE PLANS, THE OPEN SPACE AND THE PEDESTRIAN FRIENDLY DESIGN.

I'M HERE TO TALK ABOUT A SURVEY THAT COUNCILMAN WEST OFFICE ASKED BE DEVELOPED AND IMPLEMENTED THROUGHOUT THE REGION, THREE MILE RADIUS OF THE DEVELOPMENT SITE TO GAIN COMMUNITY INPUT.

I'M JUST GOING TO HIT A FEW VERY QUICK POINTS.

FIRST OF ALL, USING SURVEY BEST PRACTICES, WE HAD REPRESENTATIVES OF STEVENS PARK VILLAGE, STEVENS PARK ESTATES AND THE FORT WORTH AVENUE DEVELOPMENT GROUP DESIGNED A DUAL LANGUAGE SURVEY, GAUGING COMMUNITY PERSPECTIVES ON 13 DIFFERENT POSSIBLE ASPECTS OF THE PROJECT AND HOW PEOPLE FELT ABOUT THOSE.

THE SURVEY QUESTIONS WERE WORDED VERY OBJECTIVELY.

FOR EACH QUESTION, RESPONDENTS CHOSE WHETHER THEY CONSIDERED THE ASPECT PRESENTED IN FRONT OF THEM TO BE VERY IMPORTANT, SOMEWHAT IMPORTANT, SOMEWHAT UNIMPORTANT OR NOT IMPORTANT AT ALL.

OR PERHAPS THEY WERE PRESENTED WITH A YES OR NO QUESTION.

COUNCILMAN WEST'S OFFICE MADE THE SURVEY AVAILABLE TO EVERYONE WHO ATTENDED THE THREE TOWN HALL MEETINGS THAT TOOK PLACE ON THE PROJECT DURING NOVEMBER 2022.

IN ADDITION, CITY OF DALLAS RESIDENTS COULD ACCESS THAT DUAL LANGUAGE SURVEY ONLINE FROM NOVEMBER 1ST THROUGH NOVEMBER 23RD.

SO IT WAS UP FOR ABOUT THREE WEEKS.

DURING THAT TIME, MORE THAN 1700 RESPONSES CAME IN TO THE SURVEY.

YOU HEARD THAT RIGHT, MORE THAN 1700 RESPONSES TO THE SURVEY WE CREATED.

THE RESULTS WERE CALCULATED USING A WEIGHTING SYSTEM.

THOSE WHOSE ADDRESS WERE BEYOND TWO MILES FROM THE DEVELOPMENT SITE GOT COUNTED ONCE THOSE BETWEEN 1 AND 2 MILES WERE COUNTED TWICE, AND THOSE WHOSE ADDRESS WAS LESS THAN A MILE FROM THE DEVELOPMENT WERE COUNTED THREE TIMES TO ENSURE THOSE WHO WOULD BE CLOSEST TO THE DEVELOPMENT SITE WOULD HAVE THE GREATEST SAY IN THIS PROJECT.

AND FINALLY, THEY WERE ASKED THOSE WHO ASKED IF THEY APPROVED OF THE DEVELOPERS REQUEST TO REZONE THE PROPERTY SO THE GROCERY COULD SIT AT THE BACK OF THE LOT RATHER THAN AT THE FRONT. 83.5% SAID EITHER YES OR YES, SO LONG AS THE DEVELOPER INCORPORATED THE NEIGHBORHOOD'S WISHES INTO THE DESIGN.

AND 16.5% SAID NO, THEY WERE NOT IN FAVOR OF THE REZONING.

SO THIS IS SORT OF THE KIND OF COMMUNITY INPUT APPROACH WE TOOK.

IT TOOK ABOUT 3 TO 4 MONTHS PERIOD FROM START TO END, AND THOSE ARE THE RESULTS OF THE SURVEY.

THE DEVELOPMENT IS DIRECTLY ACROSS FROM HAMPTON ROAD, FROM STEVENS PARK VILLAGE, WHICH IS THE CLOSEST RESIDENTIAL NEIGHBORHOOD TO THE DEVELOPMENT.

IT WAS CONCERNING AT THE VERY BEGINNING ON HOW FAR THE DEVELOPER WANTED TO STRAY FROM THE PD 714 WHERE THE PROPERTY SITS, BUT THERE HAVE BEEN MANY PUBLIC MEETINGS REGARDING THIS CASE AND A SURVEY PREPARED ON THE DEVELOPMENT.

THE DEVELOPER HAS MET WITH THE NEIGHBORHOOD GROUPS, INCLUDING STEVENS PARK VILLAGE, SEVERAL TIMES, TO DISCUSS THE PLAN AND ANSWER QUESTIONS, AND WE REALLY APPRECIATE THEIR WILLINGNESS TO DO THAT.

THE DEVELOPER HAS MADE STRIDES TO MAKE THE DEVELOPMENT MORE FRIENDLY TO THE SURROUNDING NEIGHBORHOODS AND ALSO TO COMPENSATE FOR VARYING FROM THE PD 714 BY CREATING A NEW SUBDISTRICT WITHIN THE EXISTING PD.

THEY HAVE AGREED TO REMOVE ONE OF THE DRIVE THRUS ON THE PROPERTY FACING FORT WORTH AVENUE, WHICH IS ALLOWED BY RIGHT TO INCREASE ENVIRONMENTAL FRIENDLINESS OF THE SITE AND ALSO TO INCLUDE OPEN GREEN SPACES ON THE PROPERTY FOR PUBLIC GATHERINGS.

I'M PLEASED TO SEE THE LIGHTING HAS ALSO BEEN INCLUDED IN THE SUBDISTRICT WITH THE STIPULATION.

THAT IT BE DOWNWARD DIRECTIONAL AND AWAY FROM THE STEVENS PARK NEIGHBORHOOD, WHICH WAS A BIG CONCERN OF THE RESIDENTS OF STEVENS PARK VILLAGE.

SIDEWALKS ORIGINALLY STARTED OUT AT ONLY SIX FEET AND THE DEVELOPER HAS AGREED TO MEET THE STANDARDS IN THE PD FOR 12 FOOT AND TEN FOOT SIDEWALKS, WHICH WILL DEFINITELY HELP WITH WALKABLE ACCESSIBILITY TO THE SITE.

WE WOULD LIKE TO SEE THE DEVELOPER INCORPORATE NATURAL AUSTIN STONE INTO THE FACIAL, EXCUSE ME, FACADE AND MATERIALS.

THE PD CALLS FOR BUILDINGS TO AVOID THE SUBURBAN LAYOUT OF PUSHING PARKING LOTS TO THE FRONT OF THE SITE AND INSTEAD REQUIRES STORE FRONTS TO BE PUSHED UP FRONT.

STOREFRONTS WITH LOTS OF WINDOWS AND AND OTHER THINGS TO WELCOME PEDESTRIANS AND MAKE THEM WANT TO WALK ALONG THE CORRIDOR.

IT'S A FANTASTICALLY WRITTEN PD THAT COVERS A LARGE AREA, BUT JUST LIKE ALL PDS, IT DOESN'T ACCOUNT FOR EVERY SITUATION IN EVERY PROJECT.

THE BUILDINGS ON THE SITE RIGHT NOW THAT ARE EXISTING DO NOT CONFORM WITH THE PD.

THEY'RE ALL SET BACK FROM THE ROAD WITH THE PARKING LOTS UP FRONT.

SO IF SOMEONE ELSE HAD BOUGHT THIS LOT AND DECIDED TO PUT UP A BURGER KING AND A LONG JOHN SILVER'S, THEY COULD HAVE DONE IT BY RIGHT WITHOUT GOING TO THE PLANNING COMMISSION OR TO US.

ALTHOUGH SPROUTS IS GOING TO BE PUSHED BACK A LITTLE BIT, THE APPLICANT HAS PLACED A SIT DOWN RESTAURANT SITE ALONG FORT WORTH AVENUE MEETING THE WALKABILITY INTENT OF THE PD.

THE RESTAURANT WILL HAVE A PATIO TO WELCOME PEOPLE RIGHT OFF THE SIDEWALK.

WE'VE NEGOTIATED CONTIGUOUS OPEN SPACE, BASICALLY A LAWN FOR THE SITE WITH A PATH CONNECTING PEDESTRIANS TO BOTH SPROUTS AND TO FORT WORTH AVENUE.

I BELIEVE THIS REVISED SITE PLAN, WITH THE ADDITION OF THE LAWN TO EXCEED THE WALKABILITY REQUIREMENTS CURRENTLY IN THE PD.

THE SECOND MAJOR REASON IS BECAUSE THE PD DID NOT CONTEMPLATE COMMUNITY INTERESTS THAT ARE MODERN TODAY.

THE PD WAS WRITTEN BEFORE THE CITY CONTEMPLATED OUR ENVIRONMENTAL PLAN.

THE COMMUNITY SURVEY SHOWED OVERWHELMING SUPPORT, LIKE THE NUMBER ONE MOST IMPORTANT THING FOR ENVIRONMENTAL ENHANCEMENTS.

AND WE LOVE THAT IN OAK CLIFF.

AND AND THOSE HAVE ALL BEEN ADDED.

STAFF'S LANGUAGE INCLUDES REQUIREMENTS FOR PERMEABLE PAVEMENT AND BIOSWALES, ALONG WITH MORE LANDSCAPING AND MORE TREES AND A PROBLEM WE'VE HAD IN NORTH OAK CLIFF.

WELL BEFORE I MOVED IN THE NEIGHBORHOOD, WAS THAT SHOPPING CARTS GETTING DUMPED AT RANDOM PLACES AROUND THE NEIGHBORHOOD AND JUST LEFT THERE.

THIS AMENDMENT ADDS A REQUIREMENT FOR SHOPPING CARTS TO INCLUDE A FEATURE TO LOCK THE WHEELS IF THE CARTS ARE PULLED OFF SITE.

OTHER REQUESTS LIKE DOWN LIGHTING, LIGHTS POINTING DOWN INSTEAD OF SHINING IN NEIGHBOR'S YARDS.

SPEAKER BOX POSITIONING ARE INCLUDED IN THE REVISED LANGUAGE.

THE COMMUNITY WAS VERY CLEAR IN THE SURVEY RESPONSES THAT THEY RESPECT THE ZONING AND DON'T WANT TO GIVE AWAY THE FARM TO DEVELOPERS.

BUT 89% OF THE 1480 PEOPLE WITHIN THREE MILES OF THE SITE SAID THEY WANTED A GROCERY STORE HERE.

SO I TOOK THAT AS A CLEAR DIRECTIVE TO GET AS MUCH AS I COULD FOR THE RESIDENTS WITHOUT PUSHING THIS GROCERY STORE AWAY.

AND I BELIEVE THAT THIS AMENDMENT MEETS THAT INTENT WITH THE REMAINING TIME.

AND WE'RE GOING TO RECOGNIZE A COUPLE OF PEOPLE.

THE DISD TEAM LED BY BRANT ALFRED, HELD COMMUNITY MEETINGS TO HEAR FROM THE NEIGHBORS AND PRESENT POSSIBLE SOLUTIONS TO EACH OF THESE ISSUES.

THEY WERE VERY CREATIVE AND THEIR PROBLEM SOLVING ULTIMATELY REACHING THE REVISED PLANS THAT ARE BEFORE YOU.
