[00:00:01]
GOOD MORNING. THE TIME IS NOW 9:04, AND I CALL THE QUALITY OF LIFE, ARTS AND CULTURE COMMITTEE
[Quality of Life, Arts and Culture Committee on March 20, 2023.]
MARCH 20TH TO ORDER.THE FIRST ORDER OF BUSINESS IS THE APPROVAL OF MINUTES FROM FEBRUARY 21ST, 2023.
SECOND. THERE'S BEEN A MOTION AND A SECOND.
IS THERE ANY DISCUSSION? SEEING NONE.
HEARING NONE. ALL THOSE IN FAVOR SAY AYE? AYE. ALL THOSE OPPOSED? SAME SIGN. THE MINUTES PASS UNANIMOUSLY.
BUT JUST FOR CONTEXT, I'M GOING TO GO AHEAD AND GET OUR BRIEFING MEMO OUT OF THE WAY RIGHT AFTER THIS PRESENTATION SO THAT WE HAVE THE MAJORITY OF OUR COMMITTEE TIME TODAY TO DISCUSS SHORT TERM RENTALS.
WITH THAT, I WILL TURN IT OVER TO YOU, BENJAMIN.
BENJAMIN ESPINO, ASSISTANT DIRECTOR OF THE OFFICE OF ARTS AND CULTURE.
IT IS MY PLEASURE TO INTRODUCE THE PANEL FROM THE DALLAS MUSEUM OF ART HERE TO UPDATE US.
SORRY. SHARMA IS PRESIDENT OF THE BOARD OF TRUSTEES AT THE DALLAS MUSEUM OF ART.
WITH US, WE ALSO HAVE AGUSTIN ARTEAGA, THE EUGENE MCDERMOTT, DIRECTOR OF THE DALLAS MUSEUM OF ART.
TAMARA FORSYTH WOOTTON, DEPUTY DIRECTOR.
CORRECT ME IF I'M WRONG, SO I'M GOING TO TURN IT OVER TO THEM.
GOOD MORNING AND THANK YOU VERY MUCH FOR HAVING US.
I AM AGUSTIN ARTEAGA, THE EUGENE MCDERMOTT, DIRECTOR OF THE DALLAS MUSEUM OF ART.

YEAH. OUR GLOBAL COLLECTION INCLUDES MORE THAN 25,000 WORKS, SPANS 5000 YEARS OF HISTORY AND REFLECTS WORK OF CULTURES. THE DMA IS A NONPROFIT WORKING IN A CITY OWNED BUILDING ON CITY OWNED LAND AND THAT THE CITY OWNS. ALSO 7000 WORKS IN OUR WORLD CLASS COLLECTION.

AN ADDITIONAL, ALMOST 17,000 GUESTS VISITED FROM AREA CODES PRIORITIZING THE DALLAS CULTURAL PLAN.
IN 2022, OVER 40,000 NORTH TEXAS STUDENTS PARTICIPATED IN 1000 SCHOOL PROGRAMS ON SITE AT THE DMA, AND WE HOSTED 2000 OUR EDUCATION PROGRAMS WELCOMING OVER 100,000 PARTICIPANTS.
LOCAL ARTISTS ARE VERY IMPORTANT TO OUR MISSION.
IN 2022, WE FEATURE THREE 387 LOCAL ARTISTS AT THE DMA.
WE ARE MOST PROUD OF THE WORK WE DO SERVING THE DALLAS COMMUNITY OUT AND ABOUT IN THE COMMUNITY.
[00:05:02]
AS YOU CAN SEE ON THIS MAP, IN 2022, WE MADE ART MORE ACCESSIBLE WITH OUR GO VAN GOGH PROGRAM AND OUR AFTER SCHOOL PROGRAMS REACHING NEARLY 40,000 DALLAS COMMUNITY MEMBERS THROUGH OUR OFFSITE PROGRAMS. NEXT SLIDE.I ALSO WANT TO HIGHLIGHT THE ECONOMIC IMPACT ON THE CITY OF DALLAS FROM ALL THAT WE DO.
THERE ARE ALSO KEY ECONOMIC DRIVERS FOR THE CITY OF DALLAS.
DALLAS ARTS AND CULTURE IS ROUGHLY $400 MILLION DOLLAR INDUSTRY GENERATING OVER $45 MILLION DOLLARS IN TAX REVENUE OVER A FIVE YEAR PERIOD, MORE THAN DOUBLING THE CITY'S OFFICE OF ARTS AND CULTURE FUNDING LEVEL FOR ORGANIZATIONS LIKE THE DMA.
AND NOW I'M GOING TO TRANSITION TO TAMARA FOR A CURRENT UPDATE OF THE DMA.
THANK YOU. NEXT SLIDE, PLEASE.
2022 WAS A VERY TOUGH YEAR FOR US AND IT BROUGHT SEVERAL CHALLENGES.
WE HAD THE BREAK IN ON JUNE 1ST AND THEN WE HAD A CATASTROPHIC FLOOD ON AUGUST 22ND.
AND WE'D LIKE TO GIVE YOU SOME UPDATES ON OUR RESPONSE TO BOTH INCIDENTS HERE TODAY.
BUT FIRST, WE WANT TO EXPRESS HOW GRATEFUL WE ARE TO THE MAYOR, TO COUNCILMEMBER RIDLEY, TO THE CITY STAFF AND TO THE DALLAS POLICE DEPARTMENT FOR THEIR SUPPORT THROUGHOUT ALL OF THESE INCIDENTS.
AND WE'RE GRATEFUL TO EVERYONE HERE WHO REACHED OUT TO US DURING THESE TIMES.
AND THROUGH THE CITY BOND FUNDED IMPROVEMENTS THAT ARE ONGOING CURRENTLY WE ARE INSTALLING SECURITY WINDOW FILM ON THE MOST VULNERABLE AREAS TO STRENGTHEN AND ENHANCE THE SAFETY OF THE GLASS.
WE ARE ALSO WORKING WITH THE OFFICE OF ARTS AND CULTURE AND THE BUILDING SERVICES DIVISION TO IDENTIFY HIGH PRIORITY BUILDING NEEDS SUCH AS BOLLARDS AND SECURITY GATES THAT CAN ALSO BE IMPLEMENTED.
AND WE HIRED A THIRD PARTY FIRM FOR WHOLESALE SECURITY ASSESSMENT.
THIS WAS A LONG AND EXHAUSTIVE REPORT AND IT WAS NOT MEANT AS A RESPONSE TO THE SINGLE INCIDENT, BUT INSTEAD WAS AN OVERARCHING REVIEW OF ALL OF OUR SECURITY OPERATIONS. THEY IDENTIFIED THREE AREAS FOR US TO FOCUS ON.
ONE, THE PROCEDURAL AND STRATEGIC.
TWO, OUR PERSONNEL, AND THREE OUR SYSTEMS AND FACILITY.
AS YOU CAN IMAGINE, KEEPING OUR VISITORS, STAFF AND ART SAFE IS CRUCIAL, AND IT REQUIRES A COMPREHENSIVE EFFORT THAT'S GOING TO INCLUDE IMPLEMENTING STAFF WIDE TRAINING TO ENSURE THAT WE ARE ALWAYS ABLE TO RESPOND TO THE CHANGING LANDSCAPE OF THREATS.
WE WILL ALSO BE IMPLEMENTING SEVERAL SYSTEMS AND FACILITY UPDATES LIKE THE BALLISTIC FILM AS WELL AS THE OTHER PERIMETER SECURITY IMPROVEMENTS, THE BOLLARDS AND THE SECURITY GATES AROUND OUR PHYSICAL PLANT TO ENSURE THE SAFETY OF THE BUILDING THAT WE MENTIONED EARLIER.
AND OUR FIRE CONTROL SYSTEM IS IN NEED OF HELP AS WELL.
AND THESE ARE JUST SOME OF THE HIGHLIGHTS OF WHAT WE ARE DOING AS A RESULT OF THE ASSESSMENT.
NEXT SLIDE. THE AUGUST 22ND FLOOD WAS DEVASTATING.
[00:10:05]
FLOOR. THOSE ARE OUR MOST VISITED GALLERIES AND ARE THE HUB OF OUR FAMILY AND SCHOOL CHILDREN PROGRAMS. ALL OF THESE GALLERIES HAVE BEEN CLOSED TO THE PUBLIC SINCE THEN BECAUSE THE DAMAGE MADE THEM UNSAFE FOR VISITORS AND STAFF.AGAIN, WE WANT TO THANK YOU ALL, ESPECIALLY DALLAS CITY COUNCIL, FOR THE EMERGENCY CITY COUNCIL APPROPRIATION TO PRESERVE NEARLY 2000 WORKS OF ART IN OUR COLLECTION THAT WERE ON VIEW IN THE SPACES THAT SUSTAINED DAMAGE.
WE ARE WORKING WITH THE CAPITAL IMPROVEMENTS DEPARTMENT OF THE BUILDING SERVICES DIVISION AT THE CITY OF DALLAS ON PLANS FOR THE REBUILD, INCLUDING THE HIRING OF AN ARCHITECT WHICH IS CURRENTLY BEING REVIEWED BY LEGAL COUNSEL.
IN THE INTERIM TO PRESERVE OUR SUMMER ART CAMPS AND OTHER PROGRAMING THAT WE TYPICALLY HOLD IN THE C3 GALLERIES WE'VE MADE PLANS TO USE OTHER SPACES OF THE BUILDING AND HAVE HAD POP UPS THROUGHOUT THE SPACE, INCLUDING DURING THIS PAST SPRING BREAK WEEK, WHERE WE SERVED MORE THAN 10,000 VISITORS.
ON BEHALF OF THE DMA TRUSTEES, THANK YOU FOR YOUR TIME.
WE'RE EXCITED TO BE CELEBRATING 120 YEARS AS THE CITY'S ART MUSEUM WITH YOU.
OUR GOAL IS TO HAVE THE ARCHITECT CHOSEN BY THE END OF THE SUMMER.
EQUITY AND DIVERSITY ARE MAIN PRIORITIES FOR THIS COMPETITION.
FINALISTS WILL NEED TO FOCUS ON ENVIRONMENTAL SUSTAINABILITY AND AN EQUITABLE ART EXPERIENCE.
OUR PROCESS WILL ALSO INCLUDE COMMUNITY ENGAGEMENT AS WE WORK TOWARDS OUR FINAL DESIGN.
ON THE SCREEN, YOU WILL SEE THE TIMELINE OF OUR PROJECT COMPETITION.
THE DMA WILL REQUEST A PUBLIC BOND DOLLARS FOR CRITICAL INFRASTRUCTURE NEEDS OF THE EXISTING COMPLEX, SUCH AS ELECTRICAL, HVAC, SECURITY UPDATES AND FIRE CONTROL, MANY OF WHICH ARE OUTDATED SYSTEMS AT THE END OF THEIR LIFE CYCLE.
WE LOOK FORWARD TO CONTINUING THIS TRADITION OF WORKING TOGETHER WITH THE CITY TOWARD AN EQUITABLE, SUSTAINABLE BUILDING FOR THE FUTURE THAT WILL MAKE DALLAS AND ITS RESIDENTS PROUD. WE ARE HAPPY TO TAKE ANY QUESTIONS NOW.
THANK YOU SO MUCH FOR YOUR PRESENTATION.
MR. RIDLEY. THANK YOU, MR. CHAIR. THANK YOU VERY MUCH FOR YOUR PRESENTATIONS.
I WANT TO COMPLIMENT YOU AND YOUR STAFF FOR ITS PROMPT AND THOROUGH RESPONSE TO THESE DUAL CRISES THAT YOU FACED IN 2022. I JUST HAVE A QUESTION ABOUT THE SECURITY UPGRADES.
YOU MENTIONED THAT YOU WERE IN THE PROCESS OF INSTALLING AND RETROFITTING THOSE.
DO YOU HAVE A TIMEFRAME FOR WHEN THAT WORK WILL BE COMPLETED? WE ARE CONTINUING TO PUT RESOURCES FORTH TO IMPROVE THOSE SYSTEMS. I DON'T KNOW THAT THERE'S A COMPLETE TIME FRAME.
I THINK THIS IS A CONTINUOUS PROCESS THAT WILL GO ON FOR SOME TIME.
SIR, CAN YOU ALSO GET CLOSER TO THE MIC, SIR? WE HAVE PEOPLE WHO ARE VIRTUAL AND PEOPLE AT HOME AND WE WANT TO MAKE SURE THAT EVERYTHING'S ON RECORD.
THANK YOU. ABSOLUTELY. AS I SAID, THIS IS GOING TO BE AN ONGOING PROCESS FOR A LONG TIME.
YOU'RE GOING TO HAVE TO CONTINUALLY UPGRADE THESE SYSTEMS AS NEW TECHNOLOGY COMES ALONG, AS CHANGES ARE MADE IN THE BUILDING, AS EXHIBITIONS CHANGE, THERE'LL BE A CONTINUOUS PROCESS IN THIS. I DON'T KNOW THAT THERE'S AN END DATE FOR IT, QUITE HONESTLY.
[00:15:04]
OKAY. SO YOU MENTIONED THAT YOU WERE GOING TO USE EXISTING RESOURCES.DO YOU HAVE SUFFICIENT FUNDS BUILT INTO YOUR BUDGET FOR THE THINGS LIKE INSTALLING THE BALLISTIC FILM, INSTALLING THE BOLLARDS AND THE SECURITY GATES? NOT IN OUR BUDGET CURRENTLY, NO.
SO ARE YOU PLANNING TO INCLUDE THAT IN YOUR NEXT BUDGET REQUEST? WE ARE HOPING FOR SOME CITY SUPPORT, PARTICULARLY WITH THE EXTERNAL BUILDING AND THE HARD SURFACES.
WITH THAT, WE ARE INCREASING OUR CURRENT SECURITY BUDGET TO HELP WITH THE INTERIOR, ELECTRONICS AND THOSE AREAS, AS WELL AS LOOKING FOR SIGNIFICANT GRANTS FOR LARGER PROCESSES. OKAY.
AND I WAS CURIOUS ABOUT THE SECURITY GATES.
WHERE WOULD THOSE BE INSTALLED AND WHAT WOULD THEY CONSIST OF? THOSE WOULD BE ACTUAL GATES ON OUR LOADING DOCK AREA SO THAT WE COULD BETTER SECURE THE AREAS WHERE WE BRING IN AND LOADING AND UNLOAD ART.
OKAY, SO THEY WON'T BE IN PUBLIC INTERFACE LOCATIONS LIKE AT THE ENTRANCES? NO, SIR, NOT AT THIS POINT.
ALL RIGHT. THANK YOU VERY MUCH.
THANK YOU, MR. CHAIRMAN. THANK YOU, MR. RIDLEY. MR. WEST.
YOU CAN'T. BUT YOU'VE GOT TO DO YOUR BEST TO MITIGATE THE RISKS AND TO PUT PROCEDURES IN PLACE TO TO MAKE IT VERY DIFFICULT FOR THEM TO COMMIT CRIMES AND TO HURT OUR WONDERFUL WORKS OF ART.
THANK YOU. THANK YOU, MR. WEST. AND I DON'T SEE ANY OTHER QUESTIONS OR COMMENTS.
YOU KIND OF GRAZED THROUGH WHAT YOUR NEEDS ARE GOING TO BE WITH THE BOND.
THERE'S NO FIGURES THAT WERE PRESENTED TO US.
DO YOU HAVE ANY SPECIFICS OF WHAT IT IS YOU'RE GOING TO BE LOOKING FOR? YES, WE DID A FULL SCALE FACILITIES ASSESSMENT IN 2019 IN ADVANCE OF OUR STRATEGIC PLAN, AND THAT FACILITIES ASSESSMENT IDENTIFIED SEVERAL END OF LIFE SYSTEMS THAT GALLERY MENTIONED, LIKE OUR FIRE CONTROL, SOME HVAC, ELECTRICAL, ET CETERA.
AND THAT AMOUNTED TO $85 MILLION DOLLARS IN NEEDS.
AND HOW MUCH OF THAT ARE YOU LOOKING TO LEVERAGE FROM THE PRIVATE SECTOR? WE ARE THIS AMOUNT, THE $85,000 IS WHAT WE EXPECT.
THAT WOULD BE THE THE COST OF KEEPING THE BUILDING IN A OPERATIONAL WAY AS IT IS TODAY.
ALL THE FUNDRAISING FOR THE POSSIBLE TRANSFORMATION EXPANSION OF THE BUILDING WILL COME FROM PRIVATE MONEY, AND WE CONSIDER THAT THAT WOULD BE AT LEAST DOUBLE THAT AMOUNT AROUND $190 MILLION DOLLARS.
OKAY. IT'S KIND OF STICKER SHOCK.
AND I THINK THAT THAT SPEAKS TO ABOUT 10% OF THE CAPACITY WE HAVE FOR OUR ENTIRE BOND.
SO IT'S DEFINITELY SOMETHING THAT WE WANT TO MAKE SURE IS EQUITABLE WITH OUR ENTIRE ARTS COMMUNITY.
SO I LOOK FORWARD TO THOSE CONVERSATIONS CONTINUING.
BUT I DO WANT TO REITERATE THAT WE'VE GOT TO LOOK AT SPREADING ALL THE LOVE, ESPECIALLY WITH WHAT WE'RE GOING TO BE FUNDING FROM A BOND WITH THE ARTS COMMUNITY. SO I WOULD LIKE TO SEE THERE BE A BIGGER PUSH FOR THOSE PRIVATE DONORS TO COME TO THE TABLE TO GIVE SOME OF THESE IMPROVEMENTS.
WE'VE BEEN PRESENTED HERE RECENTLY WITH IMPROVEMENTS TO PROPOSED FOR THE KALITA HUMPHREYS AND THERE'S A LOT OF NEEDS AND A LOT OF WANTS AND A LOT OF REQUESTS THAT ARE OUT THERE, BUT THERE'S ONLY SO MUCH BOND CAPACITY.
SO LET'S LET'S CONTINUE THIS CONVERSATION.
BUT THANK YOU ALL SO MUCH FOR THIS PRESENTATION.
AND I APOLOGIZE FOR GETTING IN LATE.
I HAD ZERO PLANS TO ASK ANY QUESTIONS, BUT THE BOND ISSUE CAME UP, AND WE.
BUT WHEN WE'RE TALKING ABOUT $190 MILLION FOR.
SO IF YOU CAN CLEAR THAT UP BECAUSE 190 IS A SCARY NUMBER, THAT'S NOT GOING TO HAPPEN.
SO THAT IS THE MONEY THAT WE ARE GOING TO FUND RAISE FROM INDIVIDUALS.
OKAY. SO WHAT WE'D LIKE TO SEE AND HOW MUCH ARE YOU GOING TO BECAUSE I DON'T I GET THAT PART.
[00:20:05]
SO HOW MUCH ARE YOU GOING TO BE ASKING FOR IN THE BOND? WELL, THE EXPENSES CLIMB UP TO $85 MILLION RIGHT NOW JUST SO YOU'RE GOING TO BE ASKING FOR $85 MILLION DOLLARS IN THE BOND. WE LIKELY WILL.SO 85 MILLION IS, YOU KNOW, YOU MIGHT AS WELL CALL IT A PIPE DREAM.
SO YOU'RE GOING TO REALLY HAVE TO FOCUS ON HOW DO YOU GET MORE PRIVATE DOLLARS, BECAUSE JUST AS THE CHAIRMAN SAID, WE'VE GOT 1 BILLION TOTAL.
AND SO IF YOU'RE ASKING FOR 85 MILLION, THAT'S 5% OF THE ENTIRE BOND CAPACITY THAT WE HAVE.
SO GO BACK AND LOOK AT IT AGAIN.
THE CHAIRMAN JUST MENTIONED KALITA HUMPHREYS.
WE HAVE THINGS LIKE THE LATINO CULTURAL CENTER.
WE HAVE, YOU KNOW, OTHER BLACK BOX THEATERS.
WE HAVE OTHER THINGS THAT WE NEED TO FOCUS ON, ON REPAIRING AND FIXING AS WELL.
SO JUST TAKE IT AS A PLEASE RE-DOUBLE, CHECK YOUR NUMBERS AND COME BACK WITH SOMETHING THAT WE KNOW THE VOTERS CAN LIVE WITH AND THAT THE VOTERS WILL SAY YES TO. BECAUSE THAT'S THE WHOLE POINT IS I DEFINITELY AM IN FAVOR OF YOU ALL GETTING SOME BOND MONEY.
IT'S JUST THAT WE'VE GOT TO LOOK AT THE REAL PICTURE.
AND WHEN WE HAVE 4 BILLION I'M SORRY, 4 TO 4.
YEAH, $4 BILLION IN DEFERRED MAINTENANCE JUST ON STREETS AND 2 BILLION IN DEFERRED MAINTENANCE ON ALLEYS AND 2 BILLION IN DEFERRED MAINTENANCE ON SIDEWALKS. THE VOTERS WANT THEIR STREETS, ALLEYS AND SIDEWALKS REPAIRED FIRST.
AND SO WE'RE GOING TO HAVE TO BE VERY CAREFUL HOW WE'RE GOING TO DO THAT.
AND I DEFINITELY WANT WE HAVE TO GET MONEY FOR ARTS AND CULTURE.
BUT ONE ORGANIZATION CANNOT SUCK UP ALL THE DOLLARS.
WE'VE GOT TO SPREAD IT OUT TO EVERYONE.
THANK YOU, DEPUTY MAYOR PRO TEM.
ARE THERE ANY OTHER QUESTIONS OR COMMENTS FROM COMMITTEE MEMBERS? SEEING NONE. THANK YOU ALL SO MUCH FOR THE PRESENTATION TODAY.
NEXT GOING TO HAVE ASSISTANT CITY MANAGER CARL SIMPSON FOR OUR CITY OF DALLAS YOUTH AND SENIOR PROGRAMING UPDATE BRIEFING BY MEMORANDUM.
ARE THERE ANY QUESTIONS OR COMMENTS? I SEE, COUNCILMEMBER WEST.
WE'RE ONE OF THE THREE LIBRARIES IN NORTH OAK CLIFF THAT'S GETTING THAT.
I'M JUST WONDERING WHEN THOSE ARE ACTUALLY GOING TO BE DELIVERED.
I KNOW IT SAYS MARCH HERE AND CAN WE GET FLIERS TO GET OUT TO MY SENIORS? HI, GOOD MORNING. THIS IS JO GIUDICE, DIRECTOR OF THE DALLAS PUBLIC LIBRARY.
AND I'M HAPPY TO TELL YOU THAT THE KITS ARE PLANNED TO GO OUT NEXT WEEK.
AND YES, WE CAN MOST DEFINITELY SEND YOU FLIERS.
ALSO, JO, SINCE I'VE GOT YOU ON HERE, THIS IS THE KIDS SECTION.
I HAD NOT HEARD ABOUT THE READY READING PLACE SPACES, WHICH SOUNDS PRETTY COOL.
IT'S A PLAY SPACES FOR KIDS AND PRE READING SKILLS THAT ARE GOING TO BE.
WHERE ARE THOSE GOING TO BE AT? SO THE READING READY PLAY SPACES ARE IN EVERY SINGLE LOCATION.
SO THE MUNSON FAMILY FOUNDATION FUNDED THIS IN AN EXCESS OF OVER $100,000 AND CREATED THESE SPACES IN EVERY SINGLE LOCATION OF THE DALLAS PUBLIC LIBRARY.
AND THEY'RE ALREADY INSTALLED.
I THINK I KNOW WHICH ONE IT IS IN NORTH OAK CLIFF.
OKAY, THAT'S IT. THE SPACES WITH THE PLAY KITCHENS AND ALL THE SENSORY TOYS.
OH WELL THAT'S GREAT. THANK YOU TO THE FOUNDATION THEN FOR DOING THAT.
HOW AWESOME. THANK YOU SO MUCH.
THANKS CHAIR. SURE. YOU'RE WELCOME.
THANK YOU. COUNCIL MEMBER WEST.
ARE THERE ANY OTHER QUESTIONS ON OUR BRIEFING MEMORANDUM? I WANT TO SAY THANK YOU TO STAFF FOR PUTTING THIS ALL TOGETHER AND THANK YOU TO ALL OF THE DEPARTMENTS WHO ARE PRIORITIZING PROGRAMING FOR OUR YOUTH AND SENIORS.
SO WITH THAT, WE'RE GOING TO MOVE ON TO THE MEAT OF TODAY, WHICH IS ITEM B, SHORT TERM RENTAL ZONING AND REGULATION ORDINANCES.
[00:25:02]
WE'RE GOING TO GO AHEAD AND HEAR THE BRIEFING FIRST, AND THEN I WILL ENTERTAIN AN OPPORTUNITY FOR US TO GO TO EXECUTIVE SESSION, WHICH IS ITEM D, AND WE'LL TABLE THE DISCUSSION UNTIL AFTER OUR EXECUTIVE SESSION AND COME BACK TO HAVE OUR DISCUSSION.WITH THAT, I'LL TURN IT OVER TO MR. CHRISTIAN FOR THE REGULATION PIECE AND TO JULIA RYAN FOR THE ZONING COMPONENT.
CHAIR CHRIS CHRISTIAN, DIRECTOR OF CODE COMPLIANCE SERVICES.
JULIA IS ACTUALLY GOING TO START WITH THE ZONING PORTION AND THEN WE'LL MOVE TO A REGISTRATION.
GOOD MORNING, CHAIR, MEMBERS OF THE COMMITTEE.
JULIA RYAN, DIRECTOR OF PLANNING AND URBAN DESIGN.
SO, CLAIRE, NEXT SLIDE, PLEASE.
SO TODAY WE'LL WALK THROUGH THE PROPOSED CITY PLAN COMMISSION CODE AMENDMENT, AND WE'LL WALK THROUGH THE BACKGROUND OF HOW THAT WAS CREATED AND MOVE FORWARD.
AND THEN I'LL TURN IT OVER TO CODE COMPLIANCE TO TALK ABOUT THE REGISTRATION PIECE.
NEXT SLIDE. SO THE PURPOSE OF TODAY, AGAIN, IS TO WALK THROUGH THOSE RECOMMENDATIONS FROM THE CITY PLANNING COMMISSION AND THEN TO PROVIDE THAT OVERVIEW OF THE REGISTRATION ORDINANCE AND ENFORCEMENT PROCESS.
NEXT SLIDE. SO I JUST WANTED TO GIVE A LITTLE BIT OF TIMELINE ON THE OVERALL PROCESS OF THIS TOPIC.
AND I REALLY WANT TO FOCUS SPECIFICALLY ON THE PLANNING AND URBAN DESIGN PIECE.
SO SPECIFICALLY IN 2021, IN DECEMBER, THE CITY PLANNING COMMISSION AUTHORIZED VIA THREE SIGNATURE MEMO, A CODE AMENDMENT TO DEFINE SHORT TERM RENTALS AS A LODGING USE.
NEXT SLIDE. SO IN 2022, WITH THE QUALITY OF LIFE TASK FORCE AND BRIEFINGS, WE THEN MOVED ON TO THE ZONING ORDINANCE ADVISORY COMMITTEE AND CITY PLANNING COMMISSION PROCESS WITH THE CODE AMENDMENT.
SO JUNE THROUGH SEPTEMBER, WE WORKED WITH THE ZONING ORDINANCE ADVISORY COMMITTEE OR ZOAC.
OCTOBER WE MADE A RECOMMENDATION OR THE ZOAC MADE A RECOMMENDATION TO CITY PLANNING COMMISSION.
NEXT SLIDE. SO JUST A LITTLE BIT MORE DETAIL ABOUT THE AUTHORIZED CODE AMENDMENT.
AND IN DECEMBER 8TH, 2022, THE CITY PLANNING COMMISSION VOTED NINE FOUR TO RECOMMEND AN AMENDMENT TO SECTION 51 A FOR LODGING USES, AND I'LL WALK THROUGH SPECIFICALLY THEIR RECOMMENDATION.
NEXT SLIDE. SO THE DEFINITION RECOMMENDED BY CITY PLANNING COMMISSION.
FULL OR PARTIAL BUILDING CONTAINING ONE OR MORE KITCHENS, ONE OR MORE BATHROOMS, ONE OR MORE BEDROOMS THAT IS RENTED TO OCCUPANTS FOR FEWER THAN 30 CONSECUTIVE DAYS PER RENTAL. THAT THE DISTRICTS ALLOWED WOULD BE BY RIGHT AND MID-RANGE OFFICE, GENERAL OFFICE, CENTRAL AREA, MIXED USE, MULTIPLE COMMERCIAL AND URBAN CORRIDOR DISTRICTS. NOTE THAT THOSE ARE NON RESIDENTIAL ZONING DISTRICTS THAT THERE IS REQUIRED OFF STREET PARKING ONE SPACE PER FULL OR PARTIAL UNIT RENTED TO OCCUPANTS.
NEXT SLIDE. THE CONTINUATION THAT THE USE MUST COMPLY WITH THE SHORT TERM RENTAL REGISTRATION ORDINANCE, THAT THE NUMBER OF UNITS IN A SINGLE UNIT BE NOT MORE THAN ONE.
AND THAT ALSO A SHORT TERM RENTAL MUST NOT BE USED AS COMMERCIAL AMUSEMENT, RESTAURANT OR OTHER SERVICE UNLESS IT'S LOCATED WITHIN A ZONING DISTRICT IN WHICH THE USE IS PERMITTED AND A CERTIFICATE OF OCCUPANCY IS ISSUED FOR THAT USE.
NEXT SLIDE. AND FINALLY, THAT THE SHORT TERM RENTAL LODGING IS PROHIBITED IN A MULTIFAMILY STRUCTURE OR DEVELOPMENT THAT HAS RECEIVED AND UTILIZED A MIXED INCOME UNIT HOUSING BONUS.
NEXT SLIDE. THERE WAS SOME ADDITIONAL DISCUSSION ON ADDITIONAL OPTIONS WITH BOTH IN ZOAC AND CITY PLANNING COMMISSION WITHIN ZOAC AN ACCESSORY USE OPTION WAS REQUESTED BY ZOAC, BUT IT WAS VOTED TO NOT MOVE FORWARD AND THAT IS THE USE OF A PROPERTY AS AN STR ONLY IF THERE IS A PRIMARY RESIDENT THAT LIVES IN THE PROPERTY.
[00:30:08]
ENACTING ORDINANCE, BUT NOT WITHIN CHAPTER 51 A.AND I WON'T READ THAT IN DETAIL.
NEXT SLIDE. SO THIS IS A MAP SHOWING THE DISTRICTS THAT WOULD BE PERMITTED UNDER THAT CURRENT UNDER THE RECOMMENDED ZONING ORDINANCE BY CITY PLANNING COMMISSION SHOWING IN PINK THE AREAS WHERE SHORT TERM RENTALS WOULD BE ALLOWED BY RIGHT.
AND DO NOTE THAT THERE MAY BE EXISTING RESIDENTIAL PROPERTIES AND USES WITHIN THOSE AREAS.
NEXT SLIDE. SO THIS IS A HEAT MAP AND ALSO AN OVERVIEW OF SHORT TERM RENTALS AND THE SPECIFIC ZONING DISTRICTS WITH RED BOXES AND THE OUTLINES OF WHERE THOSE SHORT TERM RENTALS WOULD BE ALLOWED UNDER THE RECOMMENDED ORDINANCE.
AND NOTE THAT 48 OR 1.8% OF THE OPERATING PAYING HOT PAYING STRS WOULD BE PERMITTED.
WE ARE NOT INCLUDING PDS WITHIN THAT CALCULATION BECAUSE WE ARE NOT GOING THROUGH THE 1200 PDS TO UNDERSTAND OR READ WHETHER THEY ARE OR NOT ALLOWED. GENERALLY, THOUGH, MOST OF THE PDS THAT DO NOT INCLUDE SHORT TERM RENTALS AS A USE WOULD DEFER BACK TO CHAPTER 51 A. BUT AGAIN, WE'RE NOT GOING TO BE REVIEWING ALL OF THOSE PDS TO FIGURE THAT OUT.
NEXT SLIDE. ON THE PUBLIC COMMENT.
THESE ARE THE NUMBER OF REGISTERED SPEAKERS AND EMAILS WE RECEIVE FOR BOTH ZOAC AND CPC.
AND NOTE THERE ARE DUPLICATES.
SO SOME PEOPLE DID COME AND SPEAK NUMEROUS TIMES AT THE ZOAC AND CPC MEETINGS AND WE DID NOT CHARACTERIZE WHETHER THEY WERE IN SUPPORT OR OPPOSITION TO THE CODE AMENDMENT.
AND SO FOR THAT WE COPIED THE OPT IN OPTION FOR THE ADU PROCESS, SPECIFICALLY THAT IT IS AN OPPORTUNITY FOR PROPERTY OWNERS OF A MAJORITY OF THE LOTS TO SIGN IN.
THE PROCESS IS LISTED ON THE SLIDE HERE THAT IS BASED ON THE ACCESSORY DWELLING UNIT CODE AMENDMENT.
AT THIS POINT, NO ADU CODE AMENDMENT OPT INS HAVE BEEN REQUESTED.
NEXT SLIDE. I WILL TURN IT OVER TO CODE.
THANK YOU. CHRIS CHRISTIAN, DIRECTOR OF CODE COMPLIANCE SERVICES.
WE WANT TO ADD CHAPTER 42B SHORT TERM RENTALS TO THE DALLAS CITY CODE.
THAT WOULD REQUIRE SHORT TERM RENTAL OWNERS AND HOSTS TO REGISTER THROUGH AN APPLICATION PROCESS ANNUALLY, PROVIDE ALL THE PERTINENT INFORMATION AS STANDARD IN OUR REGISTRATIONS.
WE WANT TO ENSURE THAT THEY ARE CURRENTLY REGISTERED AND PAYING HOT TAX.
SO WE WILL ASK FOR THAT REGISTRATION NUMBER AS WELL.
WE WOULD ALSO REQUIRE STR OWNERS AND HOSTS TO PAY AN ANNUAL REGISTRATION FEE THAT'S CURRENTLY $214.
UPON APPLICATION AND PAYING THE $214 REGISTRATION FEE THAT WOULD ALLOW CODE TO CONDUCT ITS INITIAL INSPECTION OF THE PROPERTY TO MAKE SURE THE PROPERTY IS IN COMPLIANCE WITH CHAPTER 27 MINIMUM PROPERTY STANDARDS AND THE ZONING REGULATIONS.
NEXT SLIDE, PLEASE. THE ORDINANCE WILL REQUIRE STR OWNERS AND HOSTS TO BE GOOD NEIGHBORS.
NO AMPLIFIED SOUND EQUIPMENT AUDIBLE BEYOND THE PROPERTY LINE BETWEEN THE HOURS OF 10 P.M.
AND 7 A.M., A MINIMUM RENTAL PERIOD OF TWO NIGHTS.
A LIMITED MAXIMUM NUMBER OF VEHICLES AT THE PROPERTY FOR OFF STREET PARKING SPACES.
[00:35:03]
VEHICLES ALLOWED AND THE CITY'S REGULATIONS RELATED TO PARKING ON UNAPPROVED SURFACES AND OVERSIZE VEHICLES.NEXT SLIDE CLAIRE. THE NEW CHAPTER 42B SHORT TERM RENTALS WILL REQUIRE STR OWNERS AND HOSTS TO PROVIDE AN EMERGENCY CONTACT. IDENTIFY A LOCAL RESPONSIBLE PARTY THAT MAY BE CONTACTED 24 HOURS, SEVEN DAYS A WEEK IN THE EVENT OF AN EMERGENCY CONDITION AT THE PROPERTY.
ANY CHANGE IN THIS RESPONSIBLE PARTY MUST BE NOTIFIED TO THE CITY WITHIN TEN DAYS, AND WE WANT THE CERTIFICATE OF REGISTRATION TO BE POSTED IN A COMMON AREA OF THE PROPERTY. NEXT SLIDE, PLEASE.
NEXT SLIDE, PLEASE. HERE ARE SOME REASONS THAT WE WOULD DENY THE REGISTRATION OF AN APPLICANT.
NONCOMPLIANCE WITH THE REQUIREMENTS.
MAKING FALSE STATEMENTS ON THE APPLICATION.
FAILED INSPECTION OR DON'T MEET THE ZONING OR MINIMUM PROPERTY STANDARDS.
SHOULD SHORT TERM RENTALS BE ALLOWED TO REMAIN IN RESIDENTIAL ZONING? WE'RE REQUIRING A 2000 FEET FEET DENSITY REQUIREMENT.
NEXT SLIDE, PLEASE. SOME REASONS WE WOULD REVOKE ACTIVE REGISTRATION, THREE OR MORE CITATIONS FOR VIOLATIONS OF THE DALLAS CITY CODE WITHIN A 12 MONTH PERIOD.
THE OCCURRENCE OF AN EGREGIOUS OFFENSE ON THE PROPERTY.
OWNER WILL BE NOTIFIED OF THE REVOCATION IN WRITING AND THEIR RIGHT TO APPEAL.
REVOCATION IS FINAL UNTIL THE PERMANENT LICENSE APPEAL BOARD MAKES FINAL DECISION.
NEXT SLIDE, PLEASE. THIS DIAGRAM DOCUMENTS WHAT OUR REGISTRATION PROCESS WOULD LOOK LIKE.
SO BASICALLY, AN APPLICANT WOULD SUBMIT THEIR APPLICATION AND PAY THEIR APPLICATION FEE.
CODE COMPLIANCE WITH CONDUCT AN INITIAL INSPECTION TO MAKE SURE THE PROPERTY IS IN COMPLIANCE WITH CHAPTER 27 MINIMUM PROPERTY STANDARDS AND THE ZONING REGULATIONS AND DENSITY REQUIREMENTS.
SHOULD SHORT TERM RENTALS BE ALLOWED TO REMAIN IN RESIDENTIAL ZONING CODE WILL BE REQUESTING A NIGHT INSPECTION TEAM TO ASSIST WITH ENFORCING VIOLATIONS IN NIGHTTIME HOURS UP TO 2:00 A.M..
ENFORCEMENT OF VIOLATIONS TO INCLUDE CITATIONS FOR NOISE, LITTER, EXCEEDING THE OCCUPANCY LIMITS, PARKING, AMONGST OTHER THINGS, COULD LEAD TO A REVOCATION OF REGISTRATION AND NOTIFICATION OF THE APPEAL PROCESS.
GOOD MORNING, COMMITTEE. JEREMY REED, ASSISTANT DIRECTOR FOR CODE COMPLIANCE.
I'LL JUST BE TAKING IT FROM HERE AND DISCUSSING A LITTLE BIT ABOUT WHAT CODE COMPLIANCES ROLE WILL BE SHOULD THESE REGULATIONS AND ZONING ORDINANCE BE ACCEPTED OR REJECTED BY CPC'S RECOMMENDATIONS? NEXT SLIDE, PLEASE.
SO FIRST, JUST TO GIVE A QUICK LAY OF THE LAND FOR WHERE CURRENT HOT PAYING SHORT TERM RENTAL OPERATORS ARE PER THE CITY CONTROLLER'S OFFICE BY BY COUNCIL DISTRICT THROUGHOUT THE CITY. JUST A QUICK VISUAL TO UNDERSTAND WHERE THEY ARE IN THE CITY.
WHAT CODE COMPLIANCE WOULD DO WITH THOSE IN THOSE RESIDENTIAL AREAS WAS IF CPC WAS TO BE RECOMMENDED WAS TO BE ACCEPTED, WE WOULD ISSUE NOTICES OF VIOLATION AND POTENTIALLY CITATIONS FOR ILLEGAL OPERATORS IN THOSE ZONES.
AND AGAIN, THAT WOULD BE ABOUT 95% OF THE STOCK.
AND THIS IS AGAIN HOT PAYING SHORT TERM RENTAL OPERATORS CURRENTLY.
[00:40:05]
CITY DATA SHOWS THAT THERE'S PROBABLY AT LEAST TWICE THAT NUMBER OF ACTUAL OPERATORS.SO THIS IS JUST USING THE DATA THAT WE DO HAVE.
WE DO BELIEVE, REGARDLESS OF THE NUMBER, THAT IT'S LIKELY, 95% WOULD BE A GOOD ESTIMATE FOR HOW MANY WOULD BE NOT ALLOWED SHOULD CPC RECOMMENDATIONS BE ACCEPTED . IN THOSE AREAS WHERE THEY ARE ALLOWED WE WOULD WE WOULD DO COMPLAINT BASED ENFORCEMENT FOR THE REGULATIONS THAT WOULD BE PROPOSED UNDER CHAPTER 42B, IF WE HAD THE COMPLIANCE AND ENFORCEMENT SOFTWARE THAT WE'RE GOING TO BE ASKING FOR, WE COULD DO PROACTIVE ENFORCEMENT AS WELL, ENFORCEMENT SOFTWARE THAT ALLOWS US TO COLLECT DATA OVER MANY DIFFERENT BOOKING PLATFORMS AND ALLOWS US TO COLLECT HISTORICAL BOOKING INFORMATION FROM THOSE SITES TO BE ABLE TO ACTUALLY PURSUE PROPERTIES IN COURT AND FIND THEM FROM THE BEGINNING.
AND WE WOULD BE I'LL GO TO THE NEXT SLIDE, PLEASE.
WE WOULD, BECAUSE OF THE LARGE NUMBER OF OPERATORS CURRENTLY THAT WOULD BE ZONED OUT, WE WOULD RECOMMEND A DELAY IN THE ENFORCEMENT AND EFFECTIVE DATE OF THE ORDINANCE AND CODE COMPLIANCE WOULD NEED A DELAY ANYWAYS TO GET THIS PROGRAM OFF THE GROUND BASED ON STAFFING AND FUNDING AND THE ENFORCEMENT SOFTWARE AND THE REGISTRATION SOFTWARE COMING ONLINE. NEXT SLIDE, PLEASE.
SO WE'RE CPC'S RECOMMENDATIONS TO BE REJECTED.
JUST TO SHOW YOU THE DIFFERENT POSSIBILITIES HERE.
WE WOULD STILL PROCEED WITH REGISTRATION ORDINANCE FOR ALL OF THOSE THAT WOULD BE POTENTIALLY ALLOWED, WHICH WOULD AT THAT POINT BE INCLUDING POTENTIALLY THE ZONES OF RESIDENTIAL.
IT'S ESSENTIALLY THE SAME ENFORCEMENT PRACTICE.
IT'S JUST A VERY DIFFERENT STOCK.
SO THOSE POTENTIALLY 1700 TO 6000 SHORT TERM RENTALS, WE WOULD THEN BE REGISTERING AND INSPECTING UNDER THE PROGRAM RATHER THAN JUST ENFORCING AGAINST ILLEGAL OPERATORS AND THEN ANYTHING THAT WERE STILL UNAPPROVED.
THESE CODE OFFICERS WOULD BE LARGELY DAY SHIFT AS WE CURRENTLY CONCEIVE OF THE PROGRAM.
AS PER STATED CURRENT HOT PAYING STRS IN THE ZONES THAT WOULD BE APPROVED UPON CPC'S RECOMMENDATIONS IS SOMEWHERE AROUND 50 RIGHT 48 NOT INCLUDING THE PDS WHERE USING THE FEE STUDY ESTIMATE OF ABOUT 150.
THAT'S THE 90. THAT'S THE 5% OF OUR ESTIMATED STOCK OUT THERE.
AND SO FOR THOSE THAT ARE ALLOWED IN THOSE ZONES, THE INSPECTORS, THOSE SEVEN INSPECTORS WOULD LARGELY ONLY BE NEEDED DURING THE DAYTIME BECAUSE THOSE WOULD BE THE THE REGISTRATION AND FOLLOW UP INSPECTIONS.
FOR ANY ILLEGAL OPERATORS THEY WOULDN'T NECESSARILY NEED TO BE HERE AT NIGHT.
AS LONG AS WE HAD THAT SOFTWARE THAT WOULD POINT US TO WHERE THOSE ILLEGAL OPERATORS WERE OPERATING.
SO STAFFING, SHOULD WE CALL IT, REJECT OR MODIFY? THIS IS ESSENTIALLY IF CPC'S RECOMMENDATIONS WERE NOT ACCEPTED AND THEY WERE THEN ALLOWED WHERE THEY'RE BY AND LARGE OPERATING NOW.
SO AGAIN, THINKING OF THAT STOCK BEING UPWARDS OF 3,000, WE WOULD THEN BE REQUESTING A MANAGER, A SUPERVISOR, AGAIN, AN ADMIN SPECIALIST TO HANDLE THE CLERICAL SUPPORT AND REGISTRATION DATABASE.
BUT THEN WE'D BE ASKING FOR 14 INSPECTORS, SEVEN AGAIN FOR THE DAYTIME INSPECTIONS OF REGISTRATION, THE REGISTRATION PROCESS INSPECTIONS AND FOLLOW UP INSPECTIONS TO BE ABLE TO MEET WITH OWNERS, WALK THROUGH THE PROPERTY, MAKE SURE THE PROPERTY HAS IS CODE COMPLIANT FOR THESE POTENTIAL GUESTS.
THE REGISTRATION SOFTWARE WE'VE ALREADY ALREADY BUILT.
IT WAS PUT IN THIS PAST YEAR'S BUDGET AND IT'S BEEN TESTED AND IS PREPARED TO GO LIVE.
[00:45:02]
WE'RE JUST WAITING ON THE PAYMENT CARD INDUSTRY COMPLIANCE AND SO PARTNERING WITH ITS ON WHEN THAT CAN GO LIVE FOR US THE COMPLIANCE ACTIVITY AND ENFORCEMENT SOFTWARE AGAIN THIS IS WHAT I ALLUDED TO EARLIER.THIS IS AN ENHANCED SOFTWARE THAT CAN POINT US TO WHERE POTENTIAL OPERATORS ARE BY SCRAPING VARIOUS PLATFORMS ONLINE, WOULD BE ABLE TO AGGREGATE DATA THAT WE COULD USE AND TAKE TO COURT IF WE NEEDED TO.
IT WOULD TRACK THINGS LIKE THE DENSITY MANAGEMENT, LIKE MR. CHRISTIAN SAID, THE 2000FT BETWEEN DIFFERENT PROPERTIES AND WITH DIFFERENT ASPECTS OF THE REGISTRATION PORTION THAT WE COULD PUT INTO THE SYSTEM, IT WOULD ACTUALLY PING US PROACTIVELY WHEN CERTAIN LISTINGS WERE OUT OF COMPLIANCE.
SO AGAIN, JUST GOING IN A LITTLE DEEPER.
WE'D HAVE REAL TIME REPORTING WITH THIS ENHANCEMENT SOFTWARE.
ONE FEATURE THAT WE'VE LOOKED AT WITH A POTENTIAL VENDOR IS THE IDENTIFICATION OF FUTURE BOOKINGS.
SO WE REALLY THINK THIS WOULD BE HELPFUL FOR THOSE NUISANCE PROPERTIES.
IF WE GOT A CONTINUAL COMPLAINT AT A PARTICULAR PROPERTY, WE COULD ACTUALLY SEE THE NEXT BOOKING THAT THAT PROPERTY WAS GOING TO HAVE AND SO WE COULD PROACTIVELY GO OUT THERE BEFORE THE CALL EVEN CAME IN.
THAT'S SOMETHING THAT THIS TYPE OF SOFTWARE COULD POTENTIALLY GIVE US.
CONSTITUENT PORTAL THE ABILITY FOR CITIZENS OF DALLAS TO GO INTO THE PORTAL AND FIND OUT DIFFERENT PROPERTY REGISTRATIONS AND POTENTIALLY RESPONSIBLE PARTY CONTACT INFORMATION. NEXT SLIDE, PLEASE.
THIS IS THE SEVEN OFFICER MODEL.
THIS ENDS UP WITH A TOTAL EXPENSE OF ABOUT 1.4 MILLION ESTIMATED REVENUE FOR THAT, ABOUT $40,000 BECAUSE OF THE VERY LOW AMOUNT OF ACTUAL REGISTRANTS THAT WE WOULD GET UNDER THAT MODEL.
THE REJECT CPC MODEL ON THE RIGHT, THE SECOND OPTION THAT WE TALKED ABOUT HAS THE 14 CODE OFFICERS.
YOU DO SEE THE BOTH SOFTWARE ENHANCEMENTS IN HERE AS WELL WITH A TOTAL COST OF ABOUT 2.3 MILLION WITH ESTIMATED REVENUE OF ABOUT $910,000. NEXT SLIDE, PLEASE.
SO FINALLY, I JUST WANT TO ADD THAT CODE COMPLIANCE CERTAINLY INTENDS TO ENGAGE WITH THE PUBLIC PRIOR TO THE ENFORCEMENT OF THIS BECAUSE IT DOES REPRESENT A MAJOR CHANGE IN OUR ENGAGEMENT WITH SHORT TERM RENTALS.
SO WE WOULD BE LOOKING TO COLLABORATE WITH THE COMMUNICATIONS TEAM, DO SOCIAL MEDIA BROADCASTS, HOST STAKEHOLDER COMMUNITY MEETINGS, POSSIBLY REQUEST THAT NOTIFICATIONS GO OUT IN CITY COUNCIL NEWSLETTERS IF AMIABLE, MAILERS TO ALL CURRENT REGISTERED PROPERTIES SO THAT THEY WOULD UNDERSTAND THE NEW LEVEL OF ENFORCEMENT THAT WOULD BE CONDUCTED AND ADVERTISE ON THE CODE COMPLIANCE WEBSITE.
