FARLOW, WILL YOU PULL THAT MIC UP TO YOU? SO I'LL JUST GIVE YOU A LITTLE BIT OF OVERVIEW ABOUT, UH, SOME OF THE, THE PURPOSE AND THE FINANCIAL INFORMATION, UH, BACKGROUND AND PROJECT PURPOSE, UH, THAT WE WILL BE WORKING FROM FOR THIS DEVELOPMENT CODE OVERHAUL.

AND THEN THE NEXT STEPS THAT WE'LL BE, UH, WORKING THROUGH.

UM, SO TODAY WE'RE, WE'RE GONNA BRIEF YOU, UH, JUST ABOUT THE, UH, THE BACKGROUND AND THE INFORMATION REGARDING THE TWO-YEAR CONSULTANT CONTRACT THAT YOU'LL BE RECEIVING ON YOUR AGENDA ON JUNE 14TH.

UH, WHAT WE HAD PROPOSED IS THAT THIS WILL BE, UH, UH, UH, AN EFFORT TO STREAMLINE AND UPDATE AND MODERNIZE THE CITY'S DEVELOPMENT CODE, UH, SO THAT WE ARE IN ALIGNMENT WITH, UH, THE CITY'S ADOPTED PLANS AND POLICIES.

OUR CONTRACT AMOUNT IS JUST A LITTLE OVER $2 MILLION THAT WAS ALLOCATED VIA MID-YEAR BUDGET ADJUSTMENT, UH, LAST MAY.

UH, NEXT SLIDE, PLEASE.

AND SO, AS I MENTIONED, THIS IS A, UH, THE NINTH LARGEST CITY IN THE COUNTRY.

AND, UM, I BROUGHT OUR DEVELOPMENT CODE WITH ME.

THIS, UH, VERY LARGE BOOK HERE.

UH, THAT WAS, UH, UH, A CODE THAT'S BEEN LAST UPDATED IN FULL IN 1987 THAT WAS BASED ON A 1960S DEVELOPMENT CODE.

UH, AND SO THIS IS A VERY OLD APPROACH, UH, TO PLANNING.

AND WE HAVE BEEN LEFT WITH THE RESULT OF A NUMBER OF INCREASING PDS PLAN DEVELOPMENTS, WHICH HAS HAD A LOT OF, UH, RESULTING ISSUES IN, UH, OTHER AREAS OF THE CITY.

UH, NEXT SLIDE.

SO THIS IS JUST AN OVERVIEW OF THE DEVELOPMENT PROCESS, UH, THAT YOU MAY HAVE SEEN.

UH, IT'S DEFINITELY, UH, A VERY LONG AND CONVOLUTED PROCESS.

UM, THIS, THIS DEVELOPMENT CODE THAT I HAVE IN FRONT OF ME, IF YOU WANT TO DO ANYTHING IN THE CITY, YOU NEED TO UNDERSTAND, UH, THAT PAGE IS WITHIN THIS CODE.

UM, AND, UH, WE DO HAVE THE OTHER OPTION OF DOING A PLAN DEVELOPMENT.

BUT WHAT HAPPENS IS THAT, UH, THE, THE ITEMS THAT COME IN THROUGH A PD, SO THERE ARE, THINK OF A PD AS, UH, BASICALLY YOUR OWN, UH, CUSTOMIZED ZONING DISTRICT, AND WE'VE GOT 1100 OF THEM.

AND WHEN YOU HAVE 1100 OF SOMETHING THAT IS, UH, PART OF THE DEVELOPMENT PROCESS AND THE CITY'S PROCESS, SO THIS BLEEDS OVER INTO THINGS LIKE SANITATION AND CODE COMPLIANCE DEVELOPMENT SERVICES, THAT WE HAVE A NUMBER OF DIFFERENT STANDARDS AND REQUIREMENTS THAT MAY BE YOU'RE IN A PD, UH, BUT ACROSS THE STREET IS A LITTLE BIT DIFFERENT.

AND SO YOUR CODE COMPLIANCE OFFICER IS GONNA HAVE TO UNDERSTAND THAT.

AND WE WANNA MAKE SURE THAT WHATEVER WE DO IS, IS MODERN AND IT'S SIMPLE FOR EVERYONE TO BE ABLE TO UNDERSTAND.

SO WHAT WE WANNA DO WITH THIS CODE REFORM IS, UH, FIRST TO PROVIDE CLARITY.

UM, SO MANY OF OUR CURRENT ORDINANCES ARE VERY VAGUE OR COMPLICATED, AND I KNOW I'VE SPENT A NUMBER OF HOURS WITH OUR EXPERTS,

UH, TRYING TO UNDERSTAND AND PARSE OUT SOME OF THE LANGUAGE WITHIN A SPECIFIC, UH, LANGUAGE, UH, ORDINANCE OR SENTENCE, UM, THAT IF WE CAN'T EVEN UNDERSTAND, UM, IT'S, IT'S GONNA BE DIFFICULT FOR OUR PUBLIC TO UNDERSTAND.

WE ALSO WANNA IMPROVE THE EFFICIENCY IN THE DEVELOPMENT PROCESS.

AND SO MAKING SURE THAT WHATEVER WE DO IS CLEAR AND REMOVES BARRIERS, REMOVES REQUIREMENTS WHERE NECESSARY TO BE ABLE TO, UH, MAKE SURE THAT OUR DEVELOPMENT HAPPENS QUICKER.

SO, WITHIN THE ZONING PROCESS, WITHIN THE PERMITTING PROCESS, WE ALSO WANNA ELIMINATE BARRIERS TO EQUITABLE DEVELOPMENT.

UH, ONE OF THE THINGS THAT WE'VE TALKED ABOUT RECENTLY WAS THE NEIGHBORHOOD STABILIZATION OVERLAY PROCESS AND THE ORDINANCE.

AND THIS IS A PROCESS AND ORDINANCE THAT IS NEIGHBORHOOD DRIVEN.

AND SO THE NEIGHBORHOOD HAS TO BE ABLE TO UNDERSTAND, UH, THE REQUIREMENTS WITHIN THIS NSO TO BE ABLE TO IMPLEMENT IT AND UNDERSTAND WHAT THAT MEANS FOR THEIR NEIGHBORHOOD.

UH, THESE ARE THINGS THAT ARE VERY COMPLICATED AND THE PROCESS IS COMPLICATED AND, AND, UH, VERY, UM, CONFUSING.

AND THAT, UH, YOU KNOW, WE'VE SEEN CONCERNS FROM NEIGHBORS WHO, UH, DON'T REALLY UNDERSTAND WHAT THOSE NSO REQUIREMENTS MEANT, UM, AND HOW THEY'VE BEEN APPLIED, UH, TO THEIR DEVELOPMENT.

WE ALSO WANNA MODERNIZE THE ZONING DESIGNATION.

SO WE WANNA MAKE SURE THAT THE DEVELOPMENT THAT HAPPENS WITHIN AN AREA IS CONTACT SENSITIVE.

SO WE WANNA MAKE SURE THAT THE SCALE AND THE FORM IS CONSISTENT WITH THE SURROUNDING SCALE AND FORM.

UH, BUT WE ALSO WANNA MAKE SURE THAT, UM, YOU KNOW, DIFFERENT AREAS OF DALLAS CAN LOOK DIFFERENTLY.

WE DON'T WANT A ONE SIZE FITS ALL APPROACH, BUT WE ALSO WANNA MAKE SURE THAT YOUR NEIGHBORS ARE GONNA BE IN CONTEXT WITH, UH, YOUR ADJACENT NEIGHBORS.

AND THEN FINALLY, ADVANCE THE GOALS OF FORWARD DALLAS, THAT WE WANNA MAKE SURE THAT ALL OF OUR ADOPTED POLICIES AND PLANS AND HOW WE'RE PLANNING FOR THE FUTURE, UH, ARE ALL COORDINATED WITH THIS DEVELOPMENT CODE UPDATE.

AND THIS INCLUDES, UH, MAKING SURE THAT WE'RE IN ALIGNMENT WITH OUR HOUSING POLICY, WITH OUR ECONOMIC DEVELOPMENT POLICY, WITH OUR CCAP AS WELL.

SO WE ISSUED A REQUEST FOR COMPETITIVE SEALED BID IN NOVEMBER OF 2022.

AND SO WE'LL BE GOING, UH, FORWARD ON JUNE 14TH WITH A REQUEST FOR A CONTRACT.

AND THAT IS AGAIN, TO, UH, SUPPORT THE COMPREHENSIVE REFORM OF THE DALLAS DEVELOPMENT CODE.

SO AGAIN, UH, COUNCIL ACTION IS JUNE 14TH.

UH, WE WILL BE WORKING THEN FOR A PROJECT KICKOFF, UH, SOMETIME IN THE SUMMER.

AND WE ARE LOOKING AT ABOUT A TWO YEAR PROCESS FOR THIS, UM, TO, TO BE ABLE TO, UH, PROVIDE A DRAFT CODE, UH, SUMMER OF NEXT YEAR, AND THEN A FINAL CODE IN THE SUMMER OF 2025.

AND SO, YOU KNOW, THE REASON THESE WERE, UM, UH, CREATED, I MEAN, YOU KNOW, WE'VE, WE'VE SEEN OVER THE YEARS, I MEAN, NEIGHBORS HAVE COME TOGETHER, UM, YOU KNOW, TO JUST, THIS IS, THIS IS THE MECHANISM THEY USED TO INFLUENCE HOW THEY WANTED TO SEE DEVELOPMENT GO OR NOT GO IN THEIR NEIGHBORHOODS.

AND SO I'M SURE THIS WILL GIVE CONCERN AROUND SOME OF THOSE, UH, MAYBE THE MORE RECENT ONES THAT HAVE BEEN DEVELOPED.

UM, SOME THAT WE'VE ENCOUNTERED JUST DON'T SEEM LIKE THEY'RE IN STEP WITH THE TIMES YET THEY RULE.

SO, UM, I UNDERSTAND THE NEED FOR THIS, BUT MY QUESTION WOULD BE AROUND, UM, I, I'M SURE THE QUESTION WILL COME UP ABOUT GRANDFATHERING PDS.

HOW WOULD YOU BEGIN TO GET AT THIS SO THAT NEIGHBORS CAN STILL FEEL LIKE THOSE WISHES OF THE CHARACTER OF THEIR NEIGHBORHOOD, ET CETERA, WOULD BE RESPECTED? YEAH, THAT'S A, A GREAT QUESTION.

UM, I THINK THAT WHAT WE'LL BE PROPOSING HERE, SO THIS IS, THIS IS THE CODE THAT OVERSEES THE DEVELOPMENT OF THE CITY.

UM, THIS UPDATE WON'T PROPOSE TO DELETE OR CHANGE ANY OF THOSE PDS.

NOW, WE'RE, WE MAY SEE SOME OF THAT COME IN AS WITH FORWARD DALLAS, AND IF THERE ARE SOME AREAS THAT DO NEED TO BE ADDRESSED VIA LAND USE, UM, BUT THROUGH, THROUGH THIS EFFORT, THE DELETION OF ANY PDS IS

NOT GOING TO HAPPEN.

WHAT WE'RE PROPOSING IS, AND WHAT WE'RE HOPING IS THAT WITH THIS UPDATE, WE CAN MOVE BACK INTO BASE ZONING, UM, SO THAT WE HAVE, UM, LESS PDS THAT COMPLICATE THE PROCESS.

AND SO BY UPDATING THE CODE AND SIMPLIFYING THE PROCESS, MODERNIZING AND MAKING SURE THAT ALL OF THE STANDARDS AND FORMS AND, AND OTHER THINGS THAT ARE PART OF ZONING ARE IN 2025 STANDARDS, THAT THEN WE CAN SPEED UP THE DEVELOPMENT AS IT MOVES FORWARD.

UM, THE, THE EXISTING PDS ARE LIKELY TO NOT CHANGE, UM, UNLESS THERE IS, UH, SOMETHING LIKE AN AUTHORIZED HEARING WHERE WE OPEN UP THE ZONING AND MOVE THAT FORWARD SPECIFICALLY.

UM, BUT REALLY LOOKING AT THOSE EXISTING BASE ZONE, UH, UH, UH, ZONING DISTRICTS AND THEIR REQUIREMENTS AND THE PROCESSES THAT WE USE TO DO ZONING CHANGES AND, UM, DEVELOPMENT REVIEW AND THINGS LIKE THAT.

UH, BUT AGAIN, I DON'T, I DON'T SEE THAT THOSE EXISTING PDS WILL NECESSARILY CHANGE AT THIS TIME.

SO, I MEAN, THE WHOLE IDEA IS TO MAKE THE PROCESS SIMPLER, SMOOTHER TO GET THROUGH.

I MEAN, WE KNOW IT BOGS US DOWN.

UM, SO YOU'RE SAYING THESE 1100 WOULD STAND, I MEAN, WHEN A ZONING CASE COMES BEFORE US, IS THAT GONNA BE AN OPPORTUNITY TO OPEN THIS UP AND RUN IT UP AGAINST WHATEVER OUR NEW DEVELOPMENT CODE IS? OR, I MEAN, IS THIS SOMETHING THAT YOU WOULD EXPECT THIS CONSULTANT TO GIVE US AN POINT OF VIEW ON? SO WHAT, WHAT WE PROPOSE IS THAT, UM, YOU KNOW, I THINK WITH FORWARD DALLAS, WE'LL BE ABLE TO UNDERSTAND A LITTLE BETTER WHERE THE LAND USE AND ZONING, UM, ARE MISMATCHED AND BE ABLE TO ADDRESS IT FROM THERE.

UM, SPECIFICALLY WITH, UH, WITH NEW ZONING CASES, WHAT WE WOULD HOPE TO SEE IS WITH A NEW DEVELOPMENT CODE, THAT MORE APPLICANTS WOULD MOVE FORWARD WITH A BASE ZONE RATHER THAN A PD.

UM, AND THAT SPECIFICALLY WOULD HELP IMPROVE THAT PROCESS BECAUSE A BASE ZONE HAS A MUCH LESS REQUIREMENTS AND MUCH LESS IMPACT ON THE DEVELOPMENT PROCESS THAN A PD.

SO I GOTTA FIND SOME KINDA WAY LEGALLY THAT WE CAN PROTECT NEIGHBORHOODS BECAUSE WE ARE GOING TO THE NEIGHBORHOOD AND, AND TELLING THEM WHAT WE WANT OR WHAT A DEVELOPER WANT IN THEIR NEIGHBORHOOD AND SAY, OKAY, THIS BOOK, TWO YEARS AGO, 1987, THIS IS A LAW.

WE'RE NOT GONNA CHANGE THE LAW UNTIL TWO YEARS DOWN THE ROAD, BUT IN THE MEANTIME, WE'RE GONNA BE A WILD, WILD WEST.

YEAH.

AND THAT IS, UM, THAT IS A CONCERN OF OURS AS WELL.

AND THAT IS THEIR RIGHT WITH THE ZONING THAT THEY HAVE ON, UH, ON THE LAND.

AND SO WHAT WE ARE REALLY LOOKING FORWARD TO IS, IS, AND IT'S, YOU KNOW, A PHASED APPROACH IS, IS REALLY THE BEST APPROACH, I THINK.

UM, SO THAT WE'RE NOT CRAMMING ALL OF THESE THINGS IN AT ONCE WITH THE CODE AND FOR DALLAS AND ALL OF THE CHANGES THAT ARE GONNA COME INTO PLAY ONCE THOSE ALL GET ADOPTED.

UM, SO PHASED APPROACH WHERE WE WANNA ESTABLISH WHAT THAT FUTURE LAND USE IS, UH, WHAT KINDS OF USES ARE APPROPRIATE THERE, AND THEN START LOOKING AT THE CODE AND HOW THE CODE CAN THEN MATCH UP WITH THOSE THINGS IN FORWARD DALLAS AND THEN IMPLEMENT THAT CODE, UM, AND THEN FROM THERE START IMPLEMENTING THROUGH AUTHORIZED HEARINGS.

AND WE WOULD HAVE TO GO THROUGH AUTHORIZED HEARINGS IN ORDER TO, UH, CHANGE THE UNDERLYING ZONING ON A LOT OF THESE CASES.

UM, AND SO THERE'S, THERE'S A LOT OF WORK TO BE DONE BECAUSE WE'VE REALLY, YOU KNOW, KICKED THE CAN DOWN THE ROAD FOR SO MANY YEARS THAT, UM, YOU KNOW, IT'S, IT'S REALLY A DIFFICULT SITUATION THAT WE FOUND OURSELVES IN.

SO NOW THEY'RE IN A POSITION WHERE THEY'RE ABLE TO RESUME MAKING PAYMENTS.

AND THIS LOAN WORKOUT AGREEMENT WILL ALLOW THE CITY TO, UM, IT PROVIDES THE CITY ADDITIONAL SECURITY, AND IT PROVIDES A WAY FOR THE BORROWER TO REPAY THE CITY FOR ALL THE FUNDS THAT WERE LENT TO THEM.

SO WE'LL BE MADE WHOLE ON THIS? YES.

AND THEN CARES ACT, IT SAID THAT THAT IS GOING TO BE REPAID.

SO DURING THE PERIOD OF TIME THAT THE BORROWER WAS UNABLE TO MAKE PAYMENTS, THE COUNCIL AUTHORIZED THE USE OF CARE FUNDS TO PAY HUD.
