IN FACT, I'VE STATED ON PUBLIC RECORD SEVERAL TIMES THAT I AM IN SUPPORT OF YOUR STANCE.

I'M HERE TODAY TO RAISE AWARENESS TO THE ANIMAL CRISIS IN DALLAS AND TO IMPLORE THE MEMBERS OF OUR CITY COUNCIL TO SUPPORT THE RESCUE OF THESE ANIMALS IN OUR CITY.

I AM AWARE OF SITUATIONS WHERE DALLAS ANIMAL SERVICES HAS FALLEN SHORT OF THEIR CRITICAL MISSION IN OUR CITY TO LEAD THE NATION IN COMPASSIONATE CARE OF ANIMALS WHILE FINDING POSITIVE OUTCOMES FOR ALL PLACEABLE PETS THROUGH INNOVATIVE SHELTER OPERATIONS AND COMMUNITY ENGAGEMENT.

DESPITE AN $18 MILLION BUDGET, ONE OF THE LARGEST IN THE COUNTRY, ALMOST 2500 DOGS IN OVER 800 CATS WERE EUTHANIZED LAST YEAR.

DOGS HAVE DIED IN THEIR KENNELS UNDER THE CARE OF DALLAS ANIMAL SERVICES.

CITIZENS HAVE WAITED FOR DAYS FOR ASSISTANCE FROM DALLAS ANIMAL SERVICES WHEN THEY THEMSELVES ARE HELPING STRAY ANIMALS ON THEIR OWN DIME AND SACRIFICING THEIR OWN TIME.

DOGS HAVE DIED TETHERED TO TREES IN OUR COMMUNITY WITH NO SHELTER OR WATER BECAUSE NOBODY CAME TO SAVE THEM.

PUPPIES ARE EUTHANIZED FOR BEHAVIOR WHEN THEY'RE REALLY JUST SCARED.

ANIMALS ARE ABUSED, NEGLECTED AND FORGOTTEN IN THE STREETS OF OUR CITY.

CAPACITY LEVELS HAVE BEEN BLAMED FOR AN INCREASE IN EUTHANASIA LEVELS AT DALLAS ANIMAL SERVICES, BUT EVEN WHEN INTAKES ARE LOW, EUTHANASIA LEVELS ARE AT HIGH.

WHY? IN 2020, UNDER THE DIRECTION OF ED JAMISON, DALLAS ANIMAL SERVICES ACHIEVED A LIVE RELEASE RATE OF 93%.

UNFORTUNATELY, NOW THE CURRENT LIVE RELEASE RATE IS AT A DISMAL 76%.

MOST DAYS, DOZENS OF ANIMALS ARE ADMITTED INTO DALLAS ANIMAL SERVICES, SOMETIMES EVEN AS MANY AS A HUNDRED.

THIS SEEMS HOPELESS.

IT SEEMS LIKE AN IMPOSSIBLE SITUATION.

HOW CAN WE FIND HOMES FOR SO MANY ANIMALS? I DON'T KNOW, BUT WHAT I DO KNOW IS THAT OUR CITY NEEDS TO BE PROACTIVE, NOT REACTIVE.

SIMPLY REACTING TO THIS PROBLEM IS CAUSING HORRIFYINGLY HIGH RATES OF EUTHANASIA AND THOUSANDS OF NEGLECTED AND ABUSED ANIMALS IN OUR CITY.

DALLAS CAN DO BETTER.

THERE'S A REASON ANIMAL LAWS HAVE BEEN PUT INTO PLACE.

IRRESPONSIBLE PET OWNERS WHO BREAK THE LAW SHOULD BE TICKETED.

DALLAS ANIMAL SERVICES IS NOT ONLY HERE TO HELP, BUT TO ENFORCE, AND THEN IF THESE CITIZENS SHOW UP TO COURT AND PROVE THEY MADE THINGS RIGHT, BE FAIR AND DISSOLVE THEIR TICKET. THE HOPE IS NOT TO PUNISH PEOPLE, BUT TO CREATE CHANGE, TO TEACH THEM TO BE BETTER, AND WHAT ABOUT GRANTS FOR NOTRILLIONEDUCED BUT FREE SPAY AND NEUTER PROGRAM? FIRST, ON ITEM SIX, IT'S A PUBLIC FACILITIES CORPORATION FOR MY DISTRICT IN AN AREA THAT IS RAPIDLY INCREASING IN COST FOR FOR RENTERS, AND I WANT TO COMMEND STAFF AND OUR DALLAS PUBLIC FACILITIES CORPORATION FOR PUTTING THIS DEAL TOGETHER.

WE'RE SEEING PRICING.

A LOT OF PEOPLE ARE GETTING PRICED OUT OF THE NORTH OAK CLIFF AREA AND THIS IS GOING TO BE AN OPPORTUNITY FOR LONG TERM AFFORDABLE HOUSING WITH THIS PROJECT.

THERE'S 279 NEW RESIDENTIAL UNITS THAT WILL BE COMING IN, AND OF THIS MIX, 50% WILL BE MARKET RATE, WHICH I BELIEVE IN, IN MIXING MARKET RATE ALONG WITH WORKFORCE HOUSING AND NOT JUST PUTTING ALL OF ONE TOGETHER.

OF THE REMAINING 50% OF THE UNITS WILL HAVE 10% AT THE 60% AMI LEVEL AND 40% AT THE 80% AMI LEVEL.

I KNOW THERE WAS A RECENT REPORT PUBLISHED BY CHILD POVERTY ACTION LAB THAT SAID WE ARE DRASTICALLY BEHIND AT THE BELOW 60% AMI LEVEL OF RENTAL HOUSING AND IT'S GOING TO GET WORSE IN TERMS OF LIKE 30,000 PLUS IN THE YEARS TO COME OF OF NOT MEETING THE NEED FOR THIS. SO WE WANT TO CONTINUE TO PUSH THESE PROJECTS OUT IN A RESPONSIBLE WAY, BEING THOUGHTFUL TO THE TAX DOLLARS THAT WE ARE GIVING UP TO PUT IN THIS AFFORDABLE HOUSING. I'M VERY PLEASED THAT WE'RE GETTING THIS ASSISTANCE FROM THE STATE AND THAT WE'RE USING IT TO AUGMENT OUR GROWING FLEET OF ELECTRIC VEHICLES.

THE SECOND ITEM IS BRIEFLY ITEM FIVE, WHICH HAS ALREADY BEEN ACKNOWLEDGED BY COUNCILWOMAN STEWART, BUT I'D LIKE TO HIGHLIGHT THE FACT TWO FACTS ABOUT THIS.

ONE IS THAT IT REPRESENTS COOPERATION BETWEEN AND COLLABORATION BETWEEN THE CITY AND THE COUNTY TO ADDRESS A JOINT CONCERN FOR THE HOMELESS, AND SECONDLY, THAT IT WILL BE UTILIZING $3 MILLION FROM THE MIXED INCOME HOUSING DEVELOPMENT BONUS FUND, WHICH WE AUTHORIZED A YEAR AGO IN MAY THROUGH IN-LIEU PAYMENTS BY DEVELOPERS IN-LIEU OF BUILDING THE AFFORDABLE HOUSING UNITS.

I THINK THIS REPRESENTS A VERY CONSTRUCTIVE USE OF THE FUNDS THAT WERE CREATED IN THAT FUND FROM DEVELOPMENTS IN MY DISTRICT, AS IT TURNS OUT, AND I'M LOOKING

THE PANEL DISMISSED FIVE OF THE EIGHT ALLEGATIONS, BUT FOUND BY CLEAR AND CONVINCING EVIDENCE THAT MR. GAMEZ'S CONDUCT DID NOT VIOLATE OR DID VIOLATE THE FOLLOWING PROVISIONS OF THE CODE OF ETHICS, AND THOSE PROVISIONS ARE AS FOLLOWS.

SECTION 12A-3 A CITY EMPLOYEE IN THE PERFORMANCE OF THAT PERSON'S OFFICIAL DUTIES SHALL FULFILL THE EMPLOYEES' FIDUCIARY DUTY TO THE CITY.

GAMEZ WAS A CITY EMPLOYEE ON THE DATES OF THE CONDUCT IN QUESTION, HE HAS SINCE RESIGNED HIS POSITION AT THE CITY, AND SO THAT'S WHY WE TURN TO CODE SECTION 12A-59E, WHICH PROVIDES THE OPTIONS FOR THE CITY COUNCIL TO CHOOSE FROM WHEN SANCTIONING A FORMER CITY EMPLOYEE WHO HAS BEEN FOUND TO HAVE VIOLATED THE CODE OF ETHICS.

THE OPTIONS RELEVANT TO A FORMER CITY EMPLOYEE ARE A LETTER OF NOTIFICATION, LETTER OF ADMONITION, REPRIMAND, RESOLUTION OF CENSURE, REFERRAL FOR DAMAGES OR INJUNCTION OR REFERRAL FOR CRIMINAL PROSECUTION.

THE ETHICS ADVISORY COMMISSION PANEL HAS RECOMMENDED THAT THIS FORMER CITY EMPLOYEE RECEIVE A REPRIMAND THAT THE MATTER BE REFERRED TO THE CITY ATTORNEY FOR DAMAGES.

IN COMING TO THIS RECOMMENDATION, THE PANEL CITED SOME CONCERNS ABOUT MR. GAMEZ'S ASSERTION THAT HE FELT HIS CONDUCT CAUSED NO HARM TO THE CITY.

THEY ALSO DISCUSSED THAT HIS CONDUCT VIOLATED THE PUBLIC TRUST AND THAT HE FAILED TO USE TAX DOLLARS WISELY.

THE PANEL RECOMMENDED A REPRIMAND BECAUSE THE PANEL FOUND THAT THE VIOLATIONS WERE NOT MINOR AND WERE COMMITTED INTENTIONALLY AND THROUGH THE RECKLESS DISREGARD OF THE CODE OF ETHICS. THE PANEL ALSO EXPRESSED THEIR DESIRE FOR MR. GAMEZ TO PAY BACK THE CITY ANY UNEARNED OVERTIME THAT WAS PAID TO HIM AND THIS AMOUNT WAS ESTIMATED BY THE DIVISION OF THE INSPECTOR GENERAL TO BE ROUGHLY $1,300.

FOR THIS REASON, THE PANEL RECOMMENDED THE MATTER BE REFERRED TO THE CITY ATTORNEY FOR POSSIBLE RECOVERY OF THOSE POTENTIAL DAMAGES.

SECTION 1259 A PROVIDES GUIDANCE FOR THE CITY COUNCIL WHEN MAKING A DETERMINATION ON FINAL SANCTIONS.

THE CITY COUNCIL SHALL TAKE INTO CONSIDERATION THE RECOMMENDATION OF THE PANEL AND THE FOLLOWING FACTORS.

NUMBER ONE, THE CULPABILITY OF THE PERSON CHARGED TO THE HARM TO PUBLIC OR PRIVATE INTERESTS RESULTING FROM THE VIOLATION.

I MEAN, TIME THAT WAS RECORDED ON HIS CITY WORK, WORK, PROGRESS, AND THAT'S BASICALLY THE MOST SIGNIFICANT PART OF THE FINDINGS WAS THAT HE MISREPRESENTED HIS TIME ON CERTAIN DAYS AND TIMES AND THAT WAS THE BASIS FOR THE RECOMMENDATION TO SEEK THE CITY ATTORNEY'S ASSISTANCE IN RECOUPING THAT AMOUNT THAT WAS NOT PROPERLY RECORDED, AND WHAT WAS THE EVIDENCE PRESENTED IN SUPPORT OF THAT ACTION? RANDOM VIOLENCE BETWEEN FAMILIES THAT WERE WATCHING THE FIREWORKS AND UPSET RESIDENTS UNABLE TO MANEUVER TO AND FROM THEIR HOMES DUE TO THE CLUSTER OF TRAFFIC BY NONRESIDENT VEWERS.

WITH ALL THIS IN MIND, I STARTED BACK IN APRIL, EARLY APRIL OF THIS YEAR TO ADDRESS THIS ISSUE WITH THE FEW LIMITED CONTACTS THAT I HAD TO GET LAW ENFORCEMENT TO COME UP WITH A STRATEGY TO HELP OUT WITH PUBLIC SAFETY CHAOS ON THIS PARTICULAR NIGHT, THE 4TH OF JULY.

TO MY DISAPPOINTMENT, ANOTHER YEAR HAS PASSED BY WITH NO LAW ENFORCEMENT HELP.

SOUTH FITZHUGH AVENUE IS A NARROW TWO WAY STREET BUT ON THIS NIGHT IT IS MADE IN AN ILLEGAL WAY INTO A ONE WAY STREET WITH CARS PARKED ON BOTH SIDES OF SOUTH FITZHUGH.

EVENTS STARTED AFTER WE WITNESSED.

WE STARTED THIS AFTER WE WITNESSED PARADE ATTENDEES CHEERFULLY RAGING AT THE GROUP FOR THEIR HATEFUL RHETORIC.

ONE OF MY FAVORITE ANNUAL EVENTS IS THE STATE FAIR.

IF YOU'VE BEEN TO THE FAIR, YOU MAY HAVE NOTICED A BOOTH WITH A SIGN SAYING MILLION DOLLAR EYE TEST.

WHAT YOU MAY NOT KNOW IS THAT THE SPONSOR IS THE FULL GOSPEL BUSINESSMEN'S ASSOCIATION BECAUSE THE BOOTH IS NOT IDENTIFIED AS SUCH.

FOR SEVERAL YEARS I'VE STOPPED BY THE BOOTH.

I'VE FOUND NICE PEOPLE THERE, SOME WHO HAVE NO INTEREST IN TALKING WITH ME AT ALL, AND OCCASIONALLY SOMEONE WHO IS HOSTILE.

I TRY TO ENGAGE THEM CALMLY FOR A FEW MINUTES BEFORE I MOVE ON.

IN 2021, I TALKED WITH A YOUNG MAN WHO HAD A VERY MOVING STORY AND WE HAD A GOOD DISCUSSION.

AN OLDER MAN CAME OVER TO LISTEN.

AT ONE POINT I ASKED HIM ABOUT THE DECEPTION OF PRETENDING THEY WERE HOLDING A CONTEST.

HE ADMITTED THAT WAS EXACTLY THE INTENT TO LURE PEOPLE INTO THE BOOTH.

HE ASKED ME WHAT CHURCH I GO TO.

I USUALLY DON'T SAY, BUT I DID.

THAT DAY, THE OLDER MAN IMMEDIATELY LET LOOSE A STRING OF HOMOPHOBIC AND SEXUALLY EXPLICIT COMMENTS AGAINST MEMBERS OF MY CHURCH FAMILY.

I SAID THAT JESUS SAID NOTHING ABOUT HOMOSEXUALITY, AND THE MAN CITED THE OBSCURE BOOK OF JUDE AND CALLED SECURITY.

I STEPPED OUT OF THE BOOTH AND MET A VERY NICE MAN DOING SECURITY WHO TOLD ME THAT THEY HAD PAID FOR THE BOOTH, AND THOSE PEOPLE, THE FOLKS THERE COULD DO ANYTHING THAT THEY WANTED. I CONTACTED FAIR ADMINISTRATION AND AFTER TELLING THE STORY TO A STAFF MEMBER, I WAS ENCOURAGED TO WRITE UP WHAT HAPPENED.

MY ASK WAS NOT THAT THE GROUP BE BANNED, BUT THAT THEY BE PROPERLY LABELED AND TO REMOVE THE DECEPTIVE CONTEST TEST LANGUAGES SIGNAGE.

I HAVE OFTEN SEEN YOUNG TEENAGERS THERE AND WORRY ABOUT WHAT THEY TELL LGBTQ PLUS YOUTH OR THOSE WITH LGBTQ PLUS FAMILY MEMBERS.

I DOUBT TEENS WOULD GO INTO THE BOOTH IF IT WERE PROPERLY HAD PROPER SIGNAGE.

IN 2022, I WALKED BY THE BOOTH AGAIN AND SAW THAT NOTHING HAD CHANGED.

I ADMIT THAT I WAS VERY ANGRY THAT THE FAIR, BY NOT REQUIRING ANY CHANGES, APPROVED OF THE BEHAVIOR OF THE GROUP MEMBER WHO ATTACKED MY CHURCH, I DID TELL THEIR VOLUNTEERS THAT THEY SHOULD NOT ATTACK ANYONE'S CHURCH, AND WHEN I REALIZED HOW ANGRY I HAD BECOME, I BECAME VERY ANGRY.

I DISENGAGED BECAUSE I KNEW I WAS TOO FRUSTRATED.

AFTER ABOUT AN HOUR, I WALKED OUT OF A BUILDING TO SEE TWO 12 TO 13 YEAR OLD GIRLS IN THE BOOTH.

I WAS CALMER BY THEN AND I APPROACHED THEM, SHARING SOMETHING OF THE TEACHINGS OF JESUS ABOUT FEEDING THE HUNGRY AND CARING FOR THE SICK AND INVITING IN IMMIGRANTS.

THE LEADER THAT DAY CALLED ME OVER AND TOLD ME TO LEAVE OR HE WOULD NOTIFY SECURITY.

I DID PUSH BACK, BUT SOON STEPPED OUT OF THE BOOTH.

I WAS NO LONGER IN THE BOOTH WHEN I WAS APPROACHED BY TWO OFF DUTY POLICE OFFICERS, ONE OF THEM TOLD ME I SHOULD NOT BE ARGUING.

ABOUT TEN YEARS AGO, I HELPED START A GROUP CALLED MOTHERS AGAINST POLICE BRUTALITY IN DALLAS, AND THE FIRST CASE I WORKED ON AS AN INDIVIDUAL WAS BACK IN THE 1970S.

OVER THE DECADES. I GUESS I CAN SAY THAT THE CONSCIENCE IS ALWAYS SHOCKED, BUT I'M NO LONGER.

RECENT REPORTING IN THE DALLAS MORNING NEWS REVEALED THAT OFFICER CHRISTOPHER HESS HAD AN EXTENSIVE RECORD OF USING EXCESSIVE FORCE IN THE YEARS BEFORE HE KILLED GENEVIEVE DOSS.

IN 2017, BUT THIS HAS BEEN A PATTERN FOR HALF A CENTURY.

BACK IN THE 1970S, OFFICER DARRELL CAIN SHOT TO DEATH AN UNARMED BLACK YOUTH MICHAEL MOORHEAD.

THREE YEARS BEFORE HE KILLED SANTOS RODRIGUEZ.

IN THE 1980S, CORPORAL MELVIN COSBY SHOT FIVE SUSPECTS, KILLING TWO PEOPLE PRIOR TO KILLING MICHAEL FROST.

IN 1983.

OFFICER ROGER [INAUDIBLE] HAD MORE THAN A DOZEN COMPLAINTS OF EXCESSIVE FORCE, RACIAL PROFILING AND HARASSMENT.

BY 2012, BEFORE HE AND TWO OTHER OFFICERS FIRED 30 SHOTS INTO A SUSPECTED STOLEN CAR, KILLING LUIS ESCALANTE.

ONE OF THE OTHER OFFICERS WHO FIRED HIS WEAPON AT ESCALANTE THAT NIGHT WAS JASON CROWE.

CROWE, IN TURN, WAS CHRISTOPHER HESS' PARTNER.

TWO YEARS LATER, IN 2014, IN THE SEVERE BEATING AND INJURY OF TERRY MORRIS.

OFFICER CLARK STOLLER, WHO KILLED CLINTON ALLEN IN 2013, TRIED TO RUN OVER A SUSPECT IN HIS SQUAD CAR IN 2011, BREAKING THE SUSPECT'S ANKLES. AMONG OTHER MISCONDUCT FOR USING IT, OFFICER AMBER GEIGER, WHO KILLED BOTHAM JEAN IN 2018, HAD BEEN TRAINED AND MENTORED BY SENIOR CORPORAL MARTIN RIVERA AS A PATROL OFFICER.

RIVERA HAD KILLED AN UNARMED BLACK YOUTH, BRANDON WASHINGTON, IN 2007 BEFORE HIS PROMOTIONS.

GEIGER HERSELF HAD INJURED A SUSPECT WITH HER TASER.

THE YEAR BEFORE SHE SHOT MR. JOHN. THIS PATTERN SHOULD BE UNCOVERED BY DPD'S INTERNAL INVESTIGATIONS, BUT IT IS NOT, AND WE RECENTLY READ THAT THE INVESTIGATIVE STANDARDS ARE NOT UP TO THE GUIDELINES AND BEST PRACTICES OF THE DEPARTMENT OF JUSTICE.

WE HAVE CALLED ME AND MY HUSBAND COLLECTIVELY AT LEAST A MINIMUM OF 20 TIMES TO GET SOME ASSISTANCE WITH THE INCREASED HOMELESS POPULATION, THE DRUG ACTIVITY THAT WE CAN SEE BLATANTLY IN OUT IN THE STREETS AND TO NO AVAIL, JUST TO BE TOLD THAT THE POLICE ARE UNDERSTAFFED, THAT THEY CAN'T DO ANYTHING ABOUT IT, THEY CAN'T MOVE THE HOMELESS PEOPLE FROM THE LOT NEXT DOOR TO US, ALTHOUGH WE KNOW THAT IT'S A VACANT LOT OWNED BY THE CITY.

WE WOULD BUY IT, CLEAN IT, PUT A FENCE AROUND IT, BUT WE'RE NOT ALLOWED TO DO THAT.

RECENTLY, JUST AS OF AUGUST 1ST, MY HOUSE WAS BROKEN INTO BY THREE ARMED ASSAILANTS WITH LONG ARMED GUNS.

LUCKILY, NOBODY WAS HURT, BUT DOES IT HAVE TO GET THAT FAR FOR US TO GET SOME TYPE OF HELP? WE UNDERSTAND THE CAPACITY OF THE POLICE.
