I'M GONNA GO AHEAD AND CALL THIS MEETING TO ORDER.

WE HAVE A SHORT AGENDA.

THE MEETING STARTS WITH, UM, APPROVAL OF THE MINUTES.

IS THERE A MOTION TO APPROVE THE MINUTES? SO MOVED.

SO WE HAVE TWO BRIEFING ITEMS. THE FIRST ONE IS THE STATUS ON CODE AMENDMENTS BASED ON THE 88TH LEGISLATURE AND CODE SECTION SUGGESTED FOR REVISION OR REPEAL.

SO WE HAD THIS PRESENTATION PREVIOUSLY, UM, BUT WE'RE LOOKING TO SEE WHERE WE'RE AT, MAKING SURE WE'RE MAKING PROGRESS.

AND IT LOOKS LIKE CASEY BURGESS IS GONNA BE LEADING THIS DISCUSSION.

I'M JOINED BY BERT VANDENBERG.

UH, IF WE COULD SKIP UP A COUPLE OF SLIDES.

ONE MORE.

THERE WE GO.

SO THE 88TH, UH, LEGISLATURE RAN THIS YEAR BETWEEN JANUARY AND MAY.

UM, AND AFTER EACH LEGISLATIVE SESSION, WE GET A LIST OF ALL OF THE BILLS.

WE SIFT THROUGH THOSE AND WE SEE WHICH ONES MIGHT AFFECT US HERE AT THE CITY.

UH, THIS YEAR THERE WERE, I BELIEVE, OVER 300 BILLS THAT AFFECTED CITIES.

IF WE CAN SKIP DOWN TO THE NEXT SLIDE.

UH, WE WENT THROUGH THOSE AND WE IDENTIFIED 140 THAT COULD POTENTIALLY AFFECT US HERE AT THE CITY OF DALLAS.

WE WERE ABLE TO TOSS OUT A LOT OF THOSE BECAUSE THEY WERE THINGS THAT OBVIOUSLY DIDN'T AFFECT US.

THEY WERE, YOU KNOW, THINGS LIKE CITIES THAT HAVE ELECTRIC UTILITIES, THINGS LIKE THAT.

UM, WE PUT TOGETHER A GREAT BIG MEMO FOR YOU GUYS.

I BELIEVE THAT WAS CLOSE TO 80 PAGES, UM, EXPLAINING ALL OF THOSE BILLS AND HOW THEY COULD POTENTIALLY AFFECT US.

AND OUT OF THOSE WE IDENTIFIED 17 THAT COULD POTENTIALLY, UH, REQUIRE SOME SORT OF CODE AMENDMENT.

UH, BUT FORTUNATELY WE DON'T EVEN NEED TO DO AN AMENDMENT FOR ALL 17 OF THOSE BILLS.

SO WE'RE GONNA DO A QUICK RUN THROUGH OF THOSE, UH, IF WE CAN SKIP TO THE NEXT SLIDE.

UH, SO THE FIRST BILL WE'VE BEEN LOOKING AT AS SB 9 29.

THIS IS A BILL THAT AFFECTS ZONING NOTICE AND NON-CONFORMING USES.

UM, THIS BILL HAS BEEN GOING THROUGH THE PROCESS.

IT WAS BRIEFED A COUPLE OF TIMES TO ZAC.

THEY VOTED TO MOVE IT ON TO CPC ON NOVEMBER 14, AND WE'RE ANTICIPATING THIS ORDINANCE TO MOVE ON TO CPC IN JANUARY.

IF WE CAN GO TO THE NEXT SLIDE.

UH, HB 1526.

THIS IS ANOTHER, UH, REALLY BIG ORDINANCE THAT WE'VE BEEN WORKING ON.

THIS ONE, UH, AFFECTS PARKLAND DEDICATION FOR MULTIFAMILY AND HOTEL AND MOTEL DEVELOPMENTS.

UH, SO THIS ONE'S BEEN MOVING ALONG TO, UH, THE PARK BOARD IS BRIEFED IN OCTOBER.

UH, THE PARKS TRAILS ENVIRONMENT COMMITTEE WAS BRIEFED IN NOVEMBER.

IF WE CAN SKIP TO THE NEXT SLIDE.

UM, LAST MONTH THERE WAS A COUNCIL RESOLUTION DESIGNATING THE DWELLING UNIT FACTOR AND THE DENSITY FACTOR.

AND THEN ON WEDNESDAY, YOU GUYS WILL BE LOOKING AT, UH, DOING A PUBLIC HEARING TO DESIGNATE AREAS OF SUBURBAN, URBAN, OR CENTRAL BUSINESS DISTRICT.

SO THIS IS ONE THAT'S BEEN REQUIRING SEVERAL STEPS.

UH, THEN, UH, AFTER YOUR ACTION ON WEDNESDAY, THAT'LL BE THE LAST STEP, UH, THAT WE NEED IN ORDER TO START PUTTING ACTUAL ORDINANCE TOGETHER.

AND, UH, THOSE WILL BE MOVING ON TO ZAC, CEBC AND COUNCIL SOMETIME IN EARLY 2024, UH, HB 1922 AND 34 92.

THESE ARE BILLS THAT AFFECTED BUILDING PERMIT FEES AND PLATING FEES.

UM, DEVELOPMENT SERVICES ALREADY WORKING ON A BIG FEE ORDINANCE THAT'LL BE COMING TO YOU GUYS ON WEDNESDAY.

AND THE CHANGES THAT WERE NEEDED FOR THOSE WERE JUST ROLLED INTO THAT ORDINANCE.

SO YOU GUYS WILL BE VOTING ON THAT LATER THIS WEEK.

THIS IS A BILL, UH, AFFECTING CHARTER SCHOOLS.

AND, UH, THIS IS ANOTHER ONE THAT THE DEPARTMENT WAS ALREADY WORKING ON, A CODE AMENDMENT ON THE SAME SUBJECT.

SO THIS IS BEING ROLLED INTO THAT.

UM, AND WE'LL PROBABLY BE MOVING ON TO ZAC SOMETIME EARLY NEXT YEAR.

HB 7 83.

THIS IS ONE THAT INVOLVES CEMETERIES.

THIS ONE WE HAD TO KIND OF THINK THROUGH A LITTLE BIT BECAUSE, UM, IN TEXAS, TRADITIONALLY CEMETERIES HAVE BEEN PROHIBITED WITHIN CITY LIMITS.

AND WE HAD A REALLY OLD CHAPTER IN THE CITY CODE THAT TALKED ABOUT CEMETERIES AND IT SAID THAT THEY WERE

PROHIBITED.

AND, UH, WE ALSO GOT LOOKING AT THE CODE AND 51 A ALLOWS THEM BY SUP.

SO, UM, INSTEAD OF, UM, REQUIRING TWO PUBLIC HEARINGS, TWO ORDINANCES IN ORDER TO DO AN A CEMETERY UNDER THIS NEW BILL, UH, WE'RE FIGURED OUT A WAY TO COMBINE THE TWO.

WE'RE GONNA BE BRINGING TWO ORDINANCES FORWARD ON THAT.

UH, ONE AMENDING OUR CEMETERY CHAPTER OF THE CODE THAT SAYS THAT IF YOU GET THE SUP, YOU ARE GOOD UNDER THAT CHAPTER TWO.

SO THAT'LL BE COMING ALONG SOMETIME HERE IN THE NEAR FUTURE 1750 AND 29 47.

UH, THESE ARE BILLS THAT AFFECTED AGRICULTURAL OPERATIONS.

AND, UH, AS, AS YOU RECALL, I'M SURE FROM THE BRIEFING BEFORE, THOSE BILLS WERE RATHER BROAD.

UM, UH, THESE COULD POTENTIALLY AFFECT A NUMBER OF THINGS IN THE CODE, BUT RIGHT NOW IT'S KIND OF HARD TO TELL EXACTLY WHY WE WOULD NEED TO CHANGE.

'CAUSE AS PART OF THE BILL, IT SAYS THAT THE TEXAS A AND M AGRILIFE EXTENSION WILL BE GIVING GUIDANCE ON BEST PRACTICES AND WHAT CITIES NEED TO DO WITH THAT.

AND THEY, UH, HAVE NOT ISSUED ANYTHING YET.

CHECK THEIR WEBSITE THIS MORNING.

IT'S STILL NOTHING OUT.

SO WE'RE WAITING ON THAT ONE.

HB 28 78.

UM, THIS ONE INVOLVES FOOD TRUCKS.

UM, SO THE CITY'S CURRENTLY WORKING ON AN INTERLOCAL AGREEMENT WITH DALLAS COUNTY AND THERE MAY BE A CODE AMENDMENT FOLLOWING THAT INTERLOCAL AGREEMENT.

BUT, UH, FROM WHAT I HEAR, DETAILS ARE STILL BEING WORKED OUT ON THAT SB 5 77.

THIS IS A BILL THAT INVOLVES, UH, FOOD SERVICE MANAGERS AND IT'S BASICALLY JUST A, A FEE BILL.

UM, THE BILL SAYS THAT WE CAN'T REQUIRE A FOOD SERVICE MANAGER IF THEY HAVE A STATE FOOD SERVICE MANAGER CARD, ALSO GET A CITY ONE.

UH, SO CODE COMPLIANCE IS AWARE OF THAT, THEY HAVEN'T BEEN REQUIRING THAT FEE.

AND, UH, WE'LL BE BRINGING A CODE AMENDMENT, UH, FORWARD TO YOU GUYS PRETTY QUICK.

UH, THIS IS ONE THAT'S DONE AND I BELIEVE EVERYTHING IS GOOD TO GO ON IT.

UH, SIMILAR FOR HB 26 26.

THIS IS ONE THAT INVOLVES CAMPAIGN FINANCE REPORTS.

UM, IT DOESN'T REALLY REQUIRE THE CITY TO DO ANYTHING THAT WE'RE NOT ALREADY DOING.

IT JUST SAYS THAT FINANCE SUPPORTS NEED TO BE POSTED ON THE CITY'S WEBSITE FOR FIVE YEARS AND THAT THE CITY'S SECRETARY CAN REDACT CERTAIN INFORMATION OF THOSE, UM, ONLINE.

SO WE PUT A CODE AMENDMENT TOGETHER JUST TO INCORPORATE THAT STUFF.

AND THAT WILL BE COMING FORWARD TO YOU GUYS HERE.

AND THEN YOU'RE FUTURE AS WELL.

HB 1819, UH, THIS WAS A BILL THAT SAYS CITIES CAN NO LONGER ENFORCE JUVENILE CURFEWS.

SO WE HAVE A CODE AMENDMENT PUT TOGETHER TO REMOVE THAT SECTION FROM OUR CODE.

AND, UH, IT'S, UH, UNDER REVIEW BY THE POLICE DEPARTMENT AND I'M SURE IT'LL BE COMING, UH, TO YOU GUYS SOMETIME HERE IN THE NEAR FUTURE.

HB 14, UH, THIS WAS A BILL THAT INVOLVED THIRD PARTY REVIEWS AND INSPECTIONS.

UH, SO DEVELOPMENT SERVICES HAS ADDRESSED MUCH OF THIS THROUGH A SERVICE FIRST BULLETIN AND THEY'VE IMPLEMENTED IT.

UH, WE'RE STILL LOOKING TO SEE WHAT KIND OF TWEAKS WE NEED TO MAKE TO THE CODE TO JUST GET EVERYTHING, UM, CLEAR IN THERE AS FAR AS HOW EVERYTHING WOULD WORK.

SB 2 24, THIS IS A, UH, BILL THAT INVOLVED CATALYTIC CONVERTERS.

UH, THIS IS WHEN WE'RE GONNA BE WORKING WITH THE POLICE DEPARTMENT ON TO SEE IF WE NEED TO MAKE ANY SORT OF CHANGES.

UH, WE DON'T KNOW THAT WE NECESSARILY NEED TO, BUT IF ANYTHING, IT'LL PROBABLY BE JUST SOME CHANGES TO PAPERWORK.

METAL RECYCLERS, UH, NEED TO KEEP HB 31 25.

THIS IS A BILL INVOLVING EMERGENCY VEHICLES.

THIS WAS ANOTHER REALLY SIMPLE ONE.

UH, BASICALLY JUST SAID THAT AMBULANCES AND POLICE CARS CAN USE WHITE FLASHING LIGHTS IN ADDITION TO RED ONES.

SO WE MADE THAT SIMPLE, UH, CHANGE TO OUR CODE.

AND THAT ONE WILL BE COMING FORWARD TO YOU GUYS SOMETIME HERE IN THE NEAR FUTURE.

HB 35 26.

UH, THIS WAS A BILL ON SOLAR.

SOLAR WAS, UH, AS WE LOOKED INTO THIS ONE, WE MADE A DETERMINATION.

NO CODE AMENDMENT WAS ACTUALLY NEEDED FOR THIS ONE.

AND, UH, DEVELOPMENT SERVICES HAS ADDRESSED THIS ADMINISTRATIVELY THROUGH A SERVICE FIRST BULLETIN 36 99.

THIS IS A BILL THAT INVOLVES PLATS AND ENGINEERING PLANS.

UH, THIS IS ONE, ANOTHER ONE THAT, UH, DOESN'T LOOK LIKE WE ACTUALLY NEED TO MAKE ANY CODE AMENDMENTS, BUT WE'LL LIKELY BE BRINGING SOME FORWARD.

THIS BILL LOOKS

LIKE IT'S ACTUALLY ONE THAT'S BENEFICIAL TO US, UH, UNDID SOME THINGS THAT THE LEGISLATURE DID A SECTION OR TWO BACK THAT WE'RE KIND OF PROBLEMATIC.

SO WE'LL BE UNWINDING THOSE THINGS.

AND THERE'S SOME OTHER THINGS IN THE BILL THAT WE MAY BE ABLE TO TAKE ADVANTAGE OF TO MAKE THE PROCESS A LITTLE, LITTLE EASIER AND QUICKER FOR PEOPLE.

AND THEN THERE'S ALSO, UH, JUST THREE THINGS WE HAD IN HERE, UM, THAT WERE PARTS OF THE CODE THAT WERE RECOMMENDATIONS FOR REVISION OR APPEAL.

UH, THE FIRST ONE IS CHAPTER 20, EARN PAID SICK TIME.

UH, THIS IS ONE THAT'S ACTUALLY PREEMPTED BY STATE LAW AND HAS ACTUALLY BEEN OVERTURNED BY A COURT.

SO YOU WOULD SUGGEST REMOVING THAT FROM THE CITY CODE.

UH, SIMILARLY FOR SECTION 31 35, THAT'S OUR PANHANDLING AND SOLICITATION, UH, SECTION IN THE CODE.

THAT ONE HAS BEEN OVERTURNED BY THE COURTS.

AND THEN THERE'S A WHOLE CHAPTER IN THE CODE ON RAILROADS, CHAPTER 39.

AND FROM WHAT I CAN TELL, THAT'S BEEN PREEMPTED BY FEDERAL LAW SINCE ABOUT THE 1980S.

SO THAT'S ONE THAT WOULD BE GOOD TO, UH, EITHER TAKE OUT OF THE CODE OR AMEND.

BUT THAT'S THE PRESENTATION.

I MEAN, THAT'S GONNA COST US.

AND THEN IT'S LIKE THEY KNOW EXACTLY WHAT THEY NEED TO DO FOR DALLAS VERSUS SOME OF OUR SISTER CITIES THAT KIND OF JUST LEAVE IT UP, YOU KNOW, AS THEY CALL.

SO, UM, THIS IS A LOT OF WORK, BUT IT'S GOOD WORK THAT ACTUALLY HELPS OUR DELEGATION SO THEY KNOW EXACTLY WHAT WE'RE LOOKING FOR, UM, SO THEY CAN GET SOME THINGS DONE FOR US.

AND WHILE HISTORICALLY THIS COMMITTEE, UM, AND, AND THE MAYOR AND THE CITY MANAGER AND THE CHAIR HAVE SOME DISCRETION DURING SESSION, UM, THAT DISCRETION IS WITHIN THE BOUNDARIES OF WHAT THE COUNCIL'S APPROVED.

SO LET'S JUST SAY THERE WAS AN ITEM THAT YOU AND I PERSONALLY OR PROFESSIONALLY DON'T AGREE ON, BUT THE WILL OF THE COUNCIL WAS WHAT YOU WERE TALKING ABOUT.

THE CHAIR WOULD NOT BE ADVOCATING FOR SOMETHING DIFFERENT.

SO IT IT'S JUST AS SIMPLE AS THAT.
