THIS DECREASE WOULD GREATLY AFFECT THE COMPANY'S ABILITY TO CONTINUE THE MUCH NEEDED SUPPORT IN OUR COMMUNITY.

THANK YOU VERY MUCH FOR YOUR TIME AND CONSIDERATION ON THIS MATTER.

THANK YOU.

MS. BANKSTON.

UH, YOU MENTIONED, UH, THE, THE LONG-TERM COMMITMENT OF, UH, KEVIN'S EMPLOYEES.

UH, CAN YOU TELL US A LITTLE BIT ABOUT, UH, UH, THE TENURE OF THOSE EMPLOYEES AND HOW THEY'RE TRAINED? WELL, THE INDIVIDUALS THAT WHEN THEY COME TO WORK FOR US, AND WE DO HAVE A VERY LONG-TERM EMPLOYEES

[00:15:01]

THAT HAVE BEEN WITH US 10 PLUS YEARS OR MORE, UH, THE TRAINING IS DONE BY THE MANAGERS OR HEAD BARTENDERS.

UH, THEY ARE, EVERYONE IS TABC CERTIFIED.

UH, AND WE, UH, THE JOB DUTIES ARE ANYWHERE FROM, UH, DOOR PERSONNEL TO FLOOR PERSONNEL TO BARTENDERS, TO ENTERTAINERS, AND EVERY, EVERYONE BROUGHT ON BOARD IS GIVING A TRAINING PROGRAM.

OKAY.

UH, AND HOW LONG HAS, UH, STATION FOUR OPERATED IN ITS, UH, PRESENT LOCATION? IF I HAVE MY NUMBERS CORRECT, IT'S 36 OR 37 YEARS.

OKAY.

AND HAS THE CLUB, UH, HAD, UH, A LATE HOURS PERMIT THROUGHOUT ITS OPERATIONS? IT HAS.

OKAY.

UM, AND DOES THE CLUB HAVE A LONG-TERM LEASE, UH, ON ITS PREMISES? UH, YES, IT DOES.

UH, AS MOST OF YOU KNOW, THERE WAS A CHANGE IN OWNERSHIP FOR THE COMPANY THREE YEARS AGO, AND MR. WYNN TOOK OVER AND, UH, WE USED, WE WERE AN EMPLOYEE OWNED COMPANY.

WE NOW RENT FROM THE GENTLEMAN WHO BOUGHT THE PROPERTY.

AND, UH, IT IS A LONG TERM, UH, UH, LEASE AND HIS PLANS FOR THE FUTURE ARE, UH, GOING TO BE BUILT AROUND THE CLUBS.

OKAY.

AND SO THE PLAN IS, IS TO BUILD A, UH, MULTI-USE, UH, DEVELOPMENT THAT THE CLUBS WILL BE IN THE CENTER OF, BUT THEN THERE WILL BE HIGH RISE, UH, LIVING QUARTERS BEHIND THE CLUBS.

IS THAT CORRECT? AT SOME POINT? THAT IS CORRECT, YES.

OKAY.

UH, TELL ME A LITTLE BIT ABOUT, UH, SOME OF THE, UH, INVESTMENTS THAT STATION FOUR HAS MADE RECENTLY IN ITS FACILITY TO, TO MAKE SURE IT'S, UH, UP TO SPEED AND, UH, A SAFE FACILITY.

WE HAVE HAD TWO THINGS THAT HAVE HAPPENED OVER, UH, THE LAST YEAR AND A HALF.

UH, WE DID SOME MAJOR, UH, IMPROVEMENTS ON THE INTERIOR, UH, IN THE AMOUNT OF, UH, APPROXIMATELY $300,000.

WE ALSO, UH, WITH STATION FOUR AND OUR OTHER THREE CLUBS HAVE PUT IN ABOUT $250,000 TO UPGRADE ALL OF THE SPRINKLER SYSTEMS, UH, FIRE RETARDANT ON ANY OF THE, UH, CURTAINS OR FABRIC THAT ARE USED IN THE ENTERTAINMENT AREAS.

UH, WE DID REDID THE HOIST THAT IS, UH, CONTROLS THE GRID OVER THE DANCE FLOOR, SO ALMOST, UH, A LITTLE OVER $500,000 THAT'S BEEN SPENT IN THE LAST YEAR AND A HALF.

OKAY.

UH, AND WOULD ANY OF THOSE CHANGES, UH, AFFECT THE, UH, SOUNDPROOFING OF THE BUILDING? WELL, ALL OF OUR SOUNDPROOFING IN THE BUILDING IS ALREADY TOTALLY INTACT.

ANY, ANY NEW SOUND EQUIPMENT THAT WOULD BE PUT IN WOULD BE AS OUR OTHER SOUND EQUIPMENT AND IT FACES INTO THE BUILDING NOT OUT.

OKAY.

SO LET ME, UH, IF I COULD SHARE MY SCREEN FOR A MINUTE, LET ME, UH, TURN YOUR ATTENTION TO TABS THREE AND FOUR IN EXHIBIT ONE.

I DON'T KNOW IF I'M SHARING THAT OR NOT.

UH, I DON'T, OH, HERE I DON'T SEE IT YET.

ONE, ONE SECOND.

THERE WE GO.

LET ME TAKE YOU TO TAB THREE.

UH, AND MS. STON, UH, WHAT DO THE, THE PHOTOS IN TAB THREE, UH, REFLECT? THIS IS THE BACK OF, UH, STATION FOUR, AND IT'S A, A, A GOOD REPRESENTATION OF HOW THE BUILDING IS BUILT.

UM, IT IS ALL STONE THAT HAS BEEN PUT OVER, UH, CONCRETE BLOCK AND REBAR WITH CONCRETE GOING, UH, INTO THE OPENINGS OF THE, UH, CINDER BLOCK.

UH, THERE IS, UH, NO WINDOWS THAT, AS YOU CAN TELL, UH, WHAT YOU'RE LOOKING AT THERE IS THE BACK DOOR GOING, UH, INTO THE PATIO, INTO STATION FOUR.

EVERYTHING IS BUILT TO GO INWARDS RATHER THAN GOING OUT TOWARDS THE STREET.

OKAY.

I'M GONNA SCROLL DOWN HERE TO SHOW FURTHER PICTURES OF THE EXTERIOR.

AND THIS IS THE EXTERIOR FACING TO THE REAR TOWARDS THE RESIDENTIAL AREA, IS THAT CORRECT? CORRECT.

YES.

IT, YES.

OKAY.

AND, UH, WHAT, IS THERE ANYTHING ABOUT THE CONSTRUCTION THAT ENHANCES THE, UH, SOUNDPROOFING OTHER THAN THE LACK OF, UH, WINDOWS ON THE, THAT AREA? WELL, THE STONE, THE, UH, CINDER BLOCK, THE REBAR, UH, THE REINFORCEMENT OF THE CEMENT THAT GOES

[00:20:01]

INTO THE OPENINGS OF THE CINDER BLOCK, ALL OF THAT MAKES FOR A, UH, VERY STRONG AND SOUND POOF, EXTERIOR.

OKAY.

UH, TO YOUR KNOWLEDGE, HAS, UH, STATION FOUR EVER RECEIVED ANY COMPLAINTS ABOUT NOISE, UH, LEVELS FROM, UH, THE CITY OR FROM THE POLICE DEPARTMENT? NO.

UH, HAVE YOU EVER RECEIVED ANY COMPLAINTS ABOUT NOISE FROM, UH, THE RESIDENTIAL NEIGHBORS, UH, THAT ARE, UH, NEARBY? NO, AND WE'VE NEVER RECEIVED A CITATION.

OKAY.

UH, AND DO YOU, UM, UH, DOES STATION FOUR MONITOR THE SOUND COMING FROM THE, UH, LOCATION? UH, YES.

UH, ABOUT A YEAR AND A HALF AGO OR SO, UH, MR. WYNN HAS, UH, AT ONE 30 QUARTER TO TWO, THEY GO OUT AND, UH, CHECK.

THEY GO ALL THE WAY TO THE BACK BUSHES AS YOU SEE THERE, TO CHECK THE SOUND TO MAKE SURE THAT, UH, THE DECIMALS ARE WITHIN RANGE OF, UM, LEGALITY.

OKAY.

AND, AND SO WE'RE CHECKING FOR DECIMAL LEVELS IN THE, AROUND THE 85, UH, DECIMAL LEVEL, IS THAT CORRECT? THAT IS CORRECT.

AND, AND THAT'S ABOUT THE NOISE, UH, LEVEL OF A, UH, UM, UH, REGULAR CONVERSATION BETWEEN PEOPLE, IS THAT CORRECT? CORRECT.

CORRECT.

OKAY.

UH, LET ME ASK YOU TO TURN, I'M REFLECT, I'M GOING TO TAB SIX NOW.

UH, AND PAGE, UH, 45 OF THE, UH, EXHIBIT BOOK.

UH, IS THIS THE LOG THAT YOU WERE SPEAKING OF? YES.

OKAY.

AND IT LOOKS LIKE, UH, EVERY DAY THAT YOU ARE OPEN LATE HOURS, THEY'RE CHECKING FOR NOISE LEVELS, IS THAT CORRECT? THAT IS CORRECT.

OKAY.

AND THE NOISE LEVELS THAT THEY'RE PICKING UP FROM THE EXTERIOR AREAS ARE NOT JUST THE NOISE FROM THIS CLUB, THERE ARE ALSO STREET NOISES AND NOISE, OTHER BUSINESSES IN THE AREA, IS THAT CORRECT? CORRECT.

OKAY.

UM, LET'S TALK FOR A LITTLE BIT ABOUT THE, UH, SECURITY THAT IS MAINTAINED.

WELL, FIRST OF ALL, GOING BACK TO SOUND, UH, DO YOU MAKE ANY CHANGES IN, UH, WHERE YOU BROADCAST SOUND, UH, AFTER MIDNIGHT? WELL, THE, UH, THE SPEAKERS THAT ARE ON THE PATIO ARE, UH, UH, TURNED OFF.

OKAY.

SO AFTER MIDNIGHT, ALL OF THE MUSIC THAT IS PLAYED IS PLAYED IN THE INTERIOR OF THE BUILDING ON THE DANCE FLOOR, IS THAT CORRECT? THAT IS CORRECT.

OKAY.

LET ME, UH, WE'RE GOING BACK TO TAB FOUR.

UH, THERE IS A PHOTO, WELL, FIRST OF ALL, LET'S LOOK AT THE PHOTO ON PAGE 26 OF THE BOOKLET.

UH, YOU MENTIONED THAT ONE AREA OF THE, OF THE CLUB HAD RECENTLY BEEN RENOVATED.

UH, IS, IS THIS THE RENOVATED AREA OF THE CLUB? YES, THAT IS.

OKAY.

AND, AND, AND IS THAT, UH, IT HAS A, A CATCHY, UH, GAMER NAME? I THINK, UH, IT, IT'S, IT'S CALLED THE CHEAT CODE LOUNGE.

OKAY.

AND, AND THIS IS NOT WHERE GAMBLING IS TAKING PLACE? NO.

ARE THERE ANY GAMES BEING PLAYED? UH, YES.

YES.

OKAY.

IT HAS, IT HAS OVER A THOUSAND DIFFERENT GAMES THAT YOU CAN PLAY THAT GOES ALL THE WAY BACK TO, UH, YOU KNOW, THE POKEMON AND, AND THE, THE OLD STYLE GAMES.

OKAY.

UH, EVEN HAS MONOPOLY, DOESN'T IT? YES.

OKAY.

OKAY.

SO IT'S BOARD A FAMILY BOARD TYPE GAMES THAT ARE PLAYED IN THIS ROOM? YES.

IS THAT CORRECT, BOARD AND VIDEO? CORRECT.

OKAY.

AND IS THIS ROOM HEAVILY USED DURING THE AFTER HOURS, UH, PROGRAM? UH, THAT ROOM, AS WITH ANYTHING ELSE, IS, UH, OPEN FOR AFTER HOURS, AND IT'S USED AS A WIND, WIND DOWN AREA SO PEOPLE CAN, UM, UH, FINISH THEIR GAMES IF THEY STARTED, UH, CLOSE TO TWO.

BUT IT, IT'S, UH, IT'S LIKE ALL OF OUR OTHER SITUATIONS, IT'S, IT'S USED TO WIND DOWN, FINISH UP WHAT YOU'RE DOING AND THEN GO ON HOME.

OKAY.

UM, LET'S TALK A LITTLE BIT MORE ABOUT THE SECURITY THAT'S IN PLACE AT THE CLUB.

UM, YOU, YOU MENTIONED THAT YOU HAD SECURITY GUARDS THAT WERE STATIONED WITHIN THE CLUB, BUT THEN YOU ALSO HAD ROAMING SECURITY GUARDS IN, IN THE PARKING LOT AREAS.

IS THAT CORRECT? THAT IS CORRECT.

AND THE PARKING LOT AREAS ARE UTILIZED BOTH BY CABIN PATRONS AND BY PATRONS OF OTHER, UM, BUSINESSES IN THE AREA, IS THAT CORRECT? THAT IS CORRECT.

ALL OF OUR PARKING IS MULTI-USE FOR EVERYONE.

OKAY.

AND,

[00:25:01]

AND IS THERE A LOT THAT IS A PAID LOT THAT IS OPERATED BY KEVIN, UH, SOME OF THE PROCEEDS OF WHICH ARE USED FOR YOUR CHARITABLE ENDEAVORS? UH, THAT IS CORRECT.

OKAY.

AND, UM, UH, DOES STATION FOUR HAVE A, UH, COPPER STAR CERTIFICATION? DOES? YES.

OKAY.

AND, AND IS THAT A RECOGNITION OF, UH, THE, UH, THE SAFE BUSINESS PRACTICES OF THE, UH, UH, RESTAURANT OR THE BAR? YES.

OKAY.

UH, AND YOU MENTIONED THAT ALL OF THE TRAINERS ARE TABC CERTIFIED.

IS THAT CORRECT? YES.

OKAY.

AND AFTER 2:00 AM ARE, ARE ANY ALCOHOLIC BEVERAGES SOLD? NO.

YOU ARE NOT ALLOWED TO SERVE ANY ALCOHOL AFTER TWO? UM, TWO TO FOUR, UH, WHEN WE ARE OPEN IS, UM, UH, BOTTLED WATERS, GATORADE, GATORADE, UH, RED BULL, UH, A GOOD VARIETY OF NON-ALCOHOLIC BEVERAGES.

OKAY.

AND YOU MENTIONED THAT IF YOU WEREN'T ABLE TO OPERATE WITH THE LATE HOUR PERMIT, THAT YOUR REVENUES ON AN ANNUAL BASIS WOULD BE DOWN BETWEEN 30 AND 40%? YES.

UM, IS, IS THAT LINKED TO THE SALES OF THE NON-ALCOHOLIC BEVERAGES AND TO, UH, COVER CHARGES? YES, THAT IS CORRECT.

OKAY.

UH, WHY IS IT HELPFUL TO HAVE, UH, AFTER HOURS FOR CUSTOMERS, UM, OR LATE HOURS FOR CUSTOMERS? UH, AS WE'VE DISCUSSED, UH, UH, IN, IN OTHER MEETINGS THAT WE'VE HAD ABOUT THIS, UM, WE HAVE YOUNGER PEOPLE WHO ARE COMING OUT AND THEY ARE A LOT OF TIMES NOT A LOT OF SERVICE INDUSTRY WORKERS, AND THEY'RE NOT GETTING OUT UNTIL 1130, MIDNIGHT, SO THEIR NIGHT IS JUST BEGINNING.

AND, UH, CONSEQUENTLY, UH, THEY'RE PREPARED TO HAVE SOME FUN AND DANCE, UH, INTO THE LATE HOURS.

OKAY.

UH, AND DOES THIS, UH, OPERATING AFTER 2:00 AM DOES THAT ALLOW, UH, CUSTOMERS TO HAVE A COOL DOWN PERIOD WHERE THEY CAN, UH, DRINK SOFT DRINKS, DRINK NON-ALCOHOLIC BEVERAGES FOR A COUPLE HOURS BEFORE THEY GO HOME? CORRECT.

OKAY.

AND, UH, DO YOU THINK IT ALLEVIATES TRAFFIC IN THE AREA BY HAVING, UH, CA THE, UH, CLUB STAY OPEN UNTIL 4:00 AM? I THINK IT'S, I THINK IT'S VERY MUCH A, UH, UH, AN ASSET TO THE AREA, UH, BECAUSE THERE ARE OTHER, UH, BUSINESSES, CLUBS ON THE STREET THAT CLOSE IT TOO, SO CONSEQUENTLY, YOU DON'T HAVE EVERYONE EMPTYING OUT ALL AT THE SAME TIME.

OKAY.

UH, MS. STON, LET ME, UH, TURN TO, UH, TABS EIGHT AND NINE, UH, OF THE, UM, UH, EXHIBIT BOOK, UH, ARE CABINS EXHIBIT ONE, UH, UH, IT APPEARS THAT THESE ARE IN TAB EIGHT AND, AND PART OF TAB NINE ARE RESIDENTIAL AND MIXED USE DEVELOPMENTS THAT ARE, UH, HAVE BEEN CONSTRUCTED, UH, AND ARE UNDER CONSTRUCTION, UH, NEAR STATION FOUR.

IS THAT CORRECT? CORRECT.

AND, UH, COULD YOU TELL THE, UH, THE BOARD WHO TOOK THESE PHOTOS OR, AND WHAT THESE PHOTOS REPRESENT, BUT I DON'T WANT TO TAKE YOU THROUGH EVERY PHOTO, BUT JUST GENERALLY WHAT DO THEY REPRESENT? UM, I TAKE THE PHOTOS AND I DO NOT REUSE PHOTOS FROM OTHER PACKETS THAT WE HAVE.

UH, EVERY YEAR I REDO THE PHOTOS SO THAT YOU CAN SEE THE QUALITY OF THE NEIGHBORHOOD AND SEE, UH, A LOT OF THE PICTURES ARE SHOWN EACH YEAR BECAUSE THEY ARE CLOSE TO STATION FOUR, BUT IT SHOWS YOU, UH, THAT PEOPLE STAY IN THE AREA, KEEP THEIR PROPERTY UP, A LOT OF NEW PROPERTY BEING DONE, AND A LOT OF THESE, UH, TOWN HOMES, UH, YOU KNOW, PRICES ARE STARTING AT 350,000 TO $500,000.

OKAY.

AND, AND I'M JUST SCROLLING THROUGH THIS, UH, UNDER THE THEORY THAT A, THAT A PHOTO IS WORTH A THOUSAND WORDS.

UH, THESE ALL APPEAR TO BE VERY HIGH END, UH, UH, AND VERY NEW, UH, DEVELOPMENTS.

IS THAT CORRECT? CORRECT.

OKAY.

AND, UH, DEVELOPMENT IN THE NEIGHBORHOOD IS EVEN CONTINUING TO THIS DATE.

I THINK THERE'S A PHOTO IN HERE OF A DEVELOPMENT THAT THE, UH, UH, PRO COMPANY IS, UH, WORKING ON CURRENTLY.

IS THAT CORRECT? YES, THAT IS CORRECT.

OKAY.

AND, AND I'VE GOT THE PHOTO OF THAT PULLED UP, I THINK IT IS ON PAGE 82 OF THE BOOKLET.

UH, DO YOU KNOW WHAT THIS, UH, STRUCTURE'S GOING

[00:30:01]

TO BE? UH, MR. CROW HAS WHERE THE OLD PARKLAND HOSPITAL WAS, WAS THE FIRST PART OF HIS DEVELOPMENT, AND THIS IS ACROSS THE STREET FROM THAT.

AND HE'S BASICALLY TAKING UP THAT WHOLE END OF, OF THRO MORTON, UH, UH, REAGAN, ALL THE WAY DOWN ON, DOWN TO MAPLE.

AND, UH, IT IS ALL, UH, I DON'T KNOW IF THERE'S RESIDENCES, BUT IT'S ALL, IT'S ONE OF THE BEST BUSINESSES, UH, AREAS FOR BUSINESSES IN THE CITY.

OKAY.

AND, UH, THIS IS ALL DEVELOPMENT TAKING PLACE, UH, WITHIN AND OUTSIDE OF A HUNDRED THOU A THOUSAND FOOT RADIUS OF, UM, UH, STATION FOUR.

IS THAT CORRECT? YES.

BASED ON YOUR OBSERVATION, UH, DO YOU SEE ANY DIFFERENCE IN THE DEVELOPMENT ACTIVITY AND THE PROPERTY VALUES, UH, UH, FOR RESIDENCES AND FOR BUSINESSES THAT ARE WITHIN A THOUSAND FOOT OF, UH, STATION FOUR VERSUS THOSE THAT ARE, UH, OUTSIDE OF THE A THOUSAND FOOT RADIUS? NO.

UH, THE, THE AMOUNT OF CONSTRUCTION IN THE AREA IS, I MEAN, PHENOMENAL.

THERE'S AT LEAST, UH, TWO FOR SURE THAT I KNOW OF HIGH RISES THAT ARE GOING TO BE GOING IN, UH, OVER THE NEXT COUPLE OF YEARS THAT ARE ALL WITHIN, UH, HALF A MILE FROM STATION FOUR.

IT'S NOT STOPPING ANYONE FROM COMING IN AND BUILDING.

OKAY.

UH, AND YOU MENTIONED THAT, UH, REVENUE FROM THE AFTER HOURS OR LATE HOURS PERMIT, UH, OPERATIONS ARE UTILIZED TO SUPPORT CHARITABLE ORGANIZATIONS AND THAT CHARITABLE ORGANIZATIONS USE THE LATE HOUR PERMIT FOR THEIR FUNDRAISING ACTIVITIES.

IS THAT CORRECT? THAT IS CORRECT.

OKAY.

AND, UH, IN TAB TWO OF THE, UH, EXHIBIT BOOK, UH, YOU'VE COMPILED VARIOUS LETTERS OF APPRECIATION, UH, AND, AND I'D ALSO BRING YOUR ATTENTION TO EXHIBIT TWO, WHICH IS ALSO A LETTER OF APPRECIATION FROM, UH, UH, DR.

BELTON, WHO IS THE PRINCIPAL OF SAM HOUSTON ELEMENTARY, UH, DATED JULY OF THIS YEAR.

UH, BUT THESE LETTERS ALL COME FROM CHARITIES THAT HAVE, UH, BEEN SUPPORTED BY STATION FOUR AND, AND CA, UH, EITHER BY CASH OR BY PROVIDING FACILITIES FOR THEM TO HOLD FUNDRAISERS.

IS THAT CORRECT? THAT IS CORRECT.

OKAY.

AND, UH, AGAIN, I, DUE TO THE TIME CONSIDERATIONS, WE'RE NOT GOING TO TO GO THROUGH EACH AND EVERY LETTER, UH, MEMBERS OF THE BOARD, BUT WE BELIEVE THAT THE EXHIBITS SHOW THAT, UH, ALL OF THESE ENTITIES SUPPORT, UH, C'S APPLICATION, UH, FOR, UH, AN EXEMPTION FROM THE, UH, LOCATIONAL RESTRICTIONS AND FOR A TWO YEAR, UH, LOCATIONAL RESTRICTION, UH, WAIVER.

UM, ALSO, TAB SEVEN REFLECTS, UH, SOME OF, UH, KEVIN'S, UH, EFFORTS IN, UM, CHARITABLE AND EDUCATIONAL, UH, AREAS.

IS THAT CORRECT? CORRECT.

OKAY.

AND, AND THIS ALL DEALS WITH THE SECRET SANTA PROJECT.

COULD YOU TELL THE BOARD A LITTLE BIT ABOUT WHAT THAT IS AND HOW IT TIES INTO THE LATE HOUR OPERATIONS AT CABIN? UH, YES.

I WOULD LIKE THE BOARD TO, UH, KNOW THAT OUR INVOLVEMENT WITH, UH, SAM HOUSTON, WHICH IS RIGHT DOWN THE STREET FROM OUR CLUBS, UH, WE ADOPTED SAM HOUSTON OVER 25 YEARS AGO, AND ONE OF OUR BIGGEST AND, UH, MOST ENJOYABLE PROJECTS WITH THE SCHOOL IS THE SECRET SANTA PROJECT, AND THERE'S A, A BRIEF DESCRIPTION OF HOW WE DO IT, BUT BASICALLY EVERY, EVERY CHILD, UH, GETS, UH, A GIFT.

UH, ALL OF THE TEACHERS AND THE WORKING STAFF AT SAM HOUSTON GET A $25 GIFT CARD.

UH, WE HAVE A, A GENTLEMAN WHO COMES IN HIS SANTA CLAUS, UH, WITH, UH, GREAT, GREAT FUN FOR THE, FOR THE KIDS, AND IT'S, UH, IT'S, UH, IT'S TRULY A WONDERFUL EXPERIENCE AND THE EXTRA TOYS, AND THERE ARE A LOT OF EXTRA TOYS.

WE THEN TAKE THOSE TO, UH, SCOTTISH W RITE OVER HERE OFF OF, UH, OAK LAWN.

UH, AND THEY USE THOSE TOYS ALL YEAR LONG, UH, FOR THE KIDS THAT COME IN FOR SERVICES.

OKAY.

UH, AND, AND WOULD YOU BE ABLE TO CONTINUE THIS TYPE OR THE, THE DEGREE THAT THIS PROGRAM RUNS, UH, IF YOU DIDN'T HAVE THE ADDITIONAL REVENUE FROM THE LATE HOURS PROGRAM? WELL, IF YOU LOSE REVENUE, YOU LOSE YOUR ABILITY TO DO THINGS THAT YOU'VE DONE FOR MANY YEARS.

OKAY.

SO, UH, I'M GOING TO

[00:35:01]

LEAVE THE BOOKLET FOR A MOMENT, UM, AND ASK YOU SOME QUESTIONS RELATED TO OUR REQUEST FOR THE TWO YEAR EXEMPTION.

UH, HAS STATION FOUR BEEN GRANTED AN EXEMPTION FROM THE LOCATIONAL RESTRICTIONS OF SECTION 14, UH, DASH 3.1 OF THE DANCE HALL ORDINANCE FOR AT LEAST THE LAST THREE CONSECUTIVE YEARS? YES.

IT'S ACTUALLY BEEN 36 YEARS THAT YOU'VE HAD AT LAID HOUR PERMIT, IS THAT CORRECT? CORRECT.

OKAY.

AND, UH, HAS STATION FOUR EVER HAD A DANCE HALL LICENSE SUSPENDED, REVOKED, OR DENIED? NO.

UH, HAS STATION FOUR OR ANY OF ITS EMPLOYEES EVER VIOLATED CHAPTER 14 OF THE DALLAS CITY CODE, WHICH RELATES TO DANCEHALL OPERATIONS? NO.

UH, ARE YOU SEEKING TODAY A TWO YEAR EXEMPTION FROM THE LOCATIONAL RESTRICTIONS OF SECTION 14 DASH THREE DASH 0.1 OF THE ORDINANCE? YES.

OKAY.

UH, WITH THAT, I'LL, UH, PASS THE WITNESS FOR CROSS-EXAMINATION OR, AND QUESTIONS FROM THE BOARD.

UH, FIRST, MR. WILKINS, DOES THE CITY HAVE ANY QUESTIONS? NO QUESTIONS, MR. CHAIR.

ALL RIGHT.

WE WILL PROCEED WITH BOARD QUESTIONING, UM, IN ORDER, MS. AYALA, DO YOU HAVE ANY QUESTIONS? NO, NO QUESTIONS.

MS. WILLOW, DO YOU HAVE ANY QUESTIONS? NO, I DON'T.

UH, VICE CHAIR TORRES, DO YOU HAVE ANY QUESTIONS? NONE AT THIS TIME.

CHAIR.

THANK YOU, MR. ILLA.

I JUST HAD A FEW QUESTIONS.

UM, YOU'RE RECOGNIZED, WANTED TO UNDERSTAND THE DIFFERENCE BETWEEN BLUE ANGEL INC AND CABIN ENTERPRISES.

BLUE ANGEL INC.

OWNS OR OWNS THE CONCEPT STATION FOUR.

IS THAT AN ACCURATE EXPLANATION? KEVIN IS, KEVIN IS THE, UH, PARENT, UH, EACH OF THE CLUBS HAS THEIR OWN LICENSES AND, UH, UH, UH, BLUE ANGEL INC.

STATION FOUR IS A, UH, ONE OF THOSE CONCEPTS? YES, SIR.

OKAY.

THAT, THANK YOU.

THAT WAS REALLY WHAT I WANTED TO UNDERSTAND, AND DIFFERENT ENTITIES AND THE, AND THE, UM, I GUESS THE CONCEPTS.

THANK YOU.

THAT'S IT.

UH, MR. JEFFS NO QUESTIONS, MR. HAYES? NO QUESTIONS.

MR. QUINT? NO QUESTIONS.

CHAIR, MS. SHIN? NO QUESTIONS.

UM, I, I, I HAVE ONE QUESTION, AND THAT IS, UM, IN THE, UH, EXHIBIT ATTACHED TO THE TABC APPLICATION, THERE ARE SOME CRIMINAL BACKGROUND CHECKS.

UM, I, I ASSUME THESE ARE OF THE PEOPLE WHO ARE INVOLVED IN RUNNING THE CLUB.

UH, SOME OF THEM SEEM TO HAVE CRIMINAL HISTORY OF, UH, DRUG RELATED OFFENSES.

UH, I'M WONDERING IF YOU COULD JUST, JUST PLEASE BRIEFLY ADDRESS THAT AND LET US KNOW WHAT, UH, Y'ALL DO WITHIN THE CLUBS TO MAKE SURE THAT THERE'S NOT ANY KIND OF DRUG ACTIVITY GOING ON WITHIN THE CLUBS.

UH, YOU KNOW, CHRISTINE, THIS MAY BE ONE THAT MIGHT BE BETTER FOR MIKEY TO HANDLE.

UM, OKAY.

UH, BECAUSE HE, UH, IS, IS I THINK ONE OF THE PEOPLE THAT, UH, HAS THE, THE HISTORY, UM, MR. WYNN, UH, YOU ARE THE OWNER, CURRENT OWNER OF CABIN ENTERPRISES, AND IN TURN, THE VARIOUS, UH, CONCEPTS THAT OPERATE UNDER CABIN.

IS THAT CORRECT? YES.

UH, AND, UH, I THINK THERE IS SOME, UH, OLDER CRIMINAL ACTIVITY IN YOUR BACKGROUND, UH, CHECK, IS THAT CORRECT? YES.

FROM 2 0 0 4, I BELIEVE.

OKAY.

SO IT'S, IT'S BEEN 20 YEARS OR SO.

UH, AND WAS ANY OF THAT DRUG RELATED? YES.

OKAY.

HAVE YOU BEEN CONVICTED OF ANY DRUG RELATED DEFENSE SINCE THAT TIME? NO.

UH, ARE YOU USING, DO YOU CURRENTLY USE ILLEGAL DRUGS? NO.

UM, DO YOU TAKE STEPS TO MAKE SURE THAT PEOPLE ARE NOT USING ILLEGAL DRUGS AT STATION FOUR? UH, AND IF SO, WHAT, WHAT STEPS ARE YOU TAKING? ABSOLUTELY.

WE, WE EMPLOY MONITORS THAT ACTUALLY WALK THE CLUBS THROUGHOUT THE EVENING

[00:40:01]

AND TWO TO THREE AT ANY KNOWN TIME IN EVERY SECTION OF THE CLUB.

IN ADDITION, SECURITY MONITORS, THE LICENSED SECURITY OFFICERS, THEY MONITOR ALL THE AREAS THROUGHOUT THE CLUBS TO ENSURE THAT NO ONE'S DOING ANYTHING ILLEGAL.

IN ADDITION TO THAT, IT ADDS TO THE SAFETY AND VISIBILITY OF THE SECURITY GUARDS THROUGHOUT THE CLUBS TO REDUCE ANY CONFRONTATION OR ANYTHING ALONG THAT LINES.

YEAH.

TO YOUR KNOWLEDGE, IS THERE ANYBODY WHO IS IN THE MANAGEMENT POSITION OF THE CLUB THAT HAS BEEN CONVICTED OF A DRUG OFFENSE, SAY IN THE LAST 10 YEARS? NO.

OKAY.

UH, AND, UH, UH, DO YOU, UH, UH, DO BACKGROUND CHECKS ON EMPLOYEES, UH, AS PART OF THE VARIOUS APPLICATION PROCESSES THAT YOU, UH, ENGAGE IN? YES.

UH, AND IN EACH OF THOSE BACKGROUND CHECKS, UH, HAVE THEY BEEN APPROVED BY, FOR EXAMPLE, THE TABC? UH, THEY ALL GO THROUGH THE TABC CERTIFICATION.

THEY ALL GO THROUGH, UH, THEY'D ALL TAKE THE HEALTH CLASSES AND ALL THE DIFFERENT CLASSES RELATED TO TABC, BUT AS FOR BACKGROUND CHECKS, THAT GOES THROUGH THE HR DEPARTMENT, WHICH WE HAVE A SEPARATE DEPARTMENT THAT VERIFIES EVERYTHING FROM THE SOCIAL SECURITY VALIDITY FOR LEGALITIES, AND THEN ALL THE WAY DOWN TO BACKGROUND CHECKS.

OKAY.

UH, CHAIRMAN SNICK, I, I HOPE I'VE ANSWERED YOUR, WE'VE ANSWERED YOUR QUESTION.

YES.

THANK YOU.

YES, THANK YOU.

UM, ALL RIGHT.

WE'LL GO BRIEFLY THROUGH, IF ANYBODY, EXCUSE ME, UH, FOR THE SECOND ROUND IF ANYBODY HAS ANY QUESTIONS.

UH, MS. AYALA? OH, NO QUESTIONS.

MS. WILLIS? UH, , VICE CHAIR TORRES? NO QUESTIONS.

MR. ILLA? NO QUESTIONS.

MR. JEFFS? NO QUESTIONS.

MR. HAYES? NO QUESTIONS.

MR. QUINT? NO QUESTIONS.

MR. CHAIR.

MS. SHIN QUESTIONS.

THANK YOU.

AND I HAVE NO FURTHER QUESTIONS WITH THAT.

UM, MR. WILKINS, YOU MAY CAN BEGIN YOUR PRESENTATION.

ALRIGHT, THE CITY CALLS DETECTIVE SONYA HAYNES.

UM, CAN YOU PLEASE STATE YOUR NAME FOR THE RECORD? YES, SONIA HAYNES.

AND HOW ARE YOU EMPLOYED? WITH THE DALLAS POLICE DEPARTMENT AS AN OFFICER, HOW LONG HAVE YOU BEEN EMPLOYED IN THAT CAPACITY? FOR 16 YEARS.

WHAT UNIT ARE YOU CURRENTLY WORKING IN? I'M CURRENTLY IN VICE LICENSING.

AND WHAT ARE YOUR RESPONSIBILITIES AND VICE LICENSING? UM, THEY'RE REVIEW REVIEWED THE RENEWALS AND THE APPLICATIONS THAT COME THROUGH FOR, UH, THE SEXUAL ORIENTATED BUSINESSES FOR DANCEHALL LICENSE AND LATE HOURS.

ALRIGHT.

UM, DID YOU REVIEW THE APPLICATION FOR STATION FOUR'S DANCEHALL LATE HOURS PERMIT? YES, I DID.

ALRIGHT.

TURNING TO TAB ONE OF THE BINDER, UM, THIS IS THE APPLICATION HISTORY FOR THIS LOCATION, ISN'T THAT CORRECT? YES.

ALRIGHT.

AND THIS APPLICATION HISTORY SHOWS IT GOES BACK TO 2020 AND SHOWS THAT IN 2020 THEY WERE GRANTED THERE LATE HOURS WITH A TWO YEAR EXEMPTION, RIGHT? YES, THAT'S CORRECT.

AND THEN THEY WERE ALSO GRANTED, UH, THE EXEMPTION AGAIN IN 2022, IS THAT RIGHT? YES.

SO STARTING IN 2024, UH, THERE, THE APPLICATION WAS SUBMITTED FOR RENEWAL ON JUNE 4TH? YES, THAT'S CORRECT.

AND, UM, THE DANCE HALL WAS APPROVED, RIGHT? YES, IT WAS.

BUT THE, UH, THE LATE HOURS WAS DENIED, RIGHT? YES.

WHY WAS THE LATE HOURS DENIED? IT WAS DENIED BECAUSE IT WAS WITHIN THE, THE 1000 FEET OF A RESIDENTIAL AREA.

OKAY.

AND IS THAT, UH, DISCRETIONARY OR MANDATORY, THAT DENIAL? NO, IT'S MANDATORY.

OKAY.

SO TURNING TO TAB SIX, UM, DOES THIS TAB DOCUMENT CALLS FOR SERVICE AT THE LOCATION? YES.

ALRIGHT.

AND TURNING TO TAB SEVEN, IS THIS THE RESULTING POLICE REPORTS? YES, THAT'S CORRECT.

ALRIGHT.

UM, LOOKING THROUGH THESE POLICE REPORTS, IT LOOKS AS IF MOST OF THEM WERE REPORT THAT WERE SELF-REPORT.

THAT'S THE, THE, UH, SECURITY AT THE CLUB IS, IS REPORTING, YOU KNOW, TRYING TO EITHER GET PROBLEM CUSTOMERS OUT OR KEEP PROBLEM CUSTOMERS FROM GOING IN.

WOULD THAT, UH, BE YOUR IMPRESSION? YES, IT IS.

ALRIGHT.

UM, IS THIS NUMBER OF, IS THE NUMBER OF INCIDENTS GENERATED HERE UNUSUALLY HIGH FOR THIS TYPE OF BUSINESS? NO.

ALRIGHT.

UM, BASED ON THE INCIDENT REPORTS, DO YOU THINK THERE'S A PATTERN OF CRIME AT THIS LOCATION? NO,

[00:45:01]

I DON'T.

NOT AT THIS TIME.

OKAY.

WELL, SO ASIDE FROM THE LOCATIONAL RESTRICTION OF BEING WITHIN A THOUSAND FEET OF A RESIDENCE, IS THERE ANY OTHER REASON TO DENY THE APPLICANT'S STANCE HALL LATE HOURS PERMIT? NO.

NO FURTHER QUESTIONS.

THANK YOU.

YOU CAME IN UNDER, UNDER TIME.

UM, ALRIGHT.

I, UM, MR. BIRCH, DO YOU HAVE, UH, ANY QUESTIONS FOR DETECTIVE HAYNES? I I HAVE NO QUESTIONS FOR DR.

UH, FOR DETECTIVE HAYNES.

THANK YOU.

UH, WE'LL GO THROUGH, UM, THE BOARD MEMBERS FOR FIRST, FOR THREE MINUTES.

UH, MS. AALA, DO YOU HAVE ANY QUESTIONS? UH, NO QUESTIONS.

MS. WILLIS? I HAVE A QUESTION.

YES, I DID WANT TO ASK THE DETECTIVES AGAIN, THE ONLY REASON, CAN YOU GUYS HEAR ME OKAY? YES.

YES MA'AM.

OKAY.

THE ONLY REASON THE DANCE HALL WAS DENIED THE LATE HOURS, UH, PERMIT WAS BECAUSE OF THE DISTANCE FROM THE RESIDENCE.

IS THERE ANY OTHER REASON? NO, MA'AM.

THAT WAS IT.

OKAY.

THANK YOU, CHAIR.

THANK YOU MS. WILLIS.

UM, VICE CHAIR TORRES, NO QUESTIONS.

JUST THANK YOU FOR BEING HERE, DETECTIVE.

THANK YOU.

THANK YOU, MA'AM.

MR. CCHI, NO QUESTIONS.

MR. JEFFS? NO QUESTIONS.

MR. HAYES? NO QUESTIONS.

AND I REITERATE THANK YOU, DETECTIVE FOR YOUR SERVICE.

THANK YOU, SIR.

MR. QUINT, NO QUESTIONS.

CHAIR, MS. SHIN? NO QUESTIONS.

THANK YOU.

DETECTIVE PAYNES.

THANK YOU, MA'AM.

AND, UH, DETECTIVE, I JUST, UH, THANK YOU, APPRECIATE, UH, YOU TAKING THE TIME TO BE HERE THIS MORNING, AND I JUST WANT TO CONFIRM IF YOU COULD HAVE GRANTED THE LATE HOURS PERMIT YOU WOULD HAVE.

IS THAT CORRECT? YES, SIR.

OKAY.

THAT'S CORRECT.

THANK YOU.

UM, ALL RIGHT, WE'LL GO THROUGH QUICKLY AGAIN JUST TO MAKE SURE NOBODY STILL HAS ANY QUESTIONS.

MS. AYLA? NO QUESTIONS.

MS. WILLIS, NO QUESTIONS.

VICE CHAIR TORRES CILLA.

NO QUESTIONS? NO QUESTIONS.

JEFF? NO QUESTIONS.

HAYES? NO.

QUINT.

HOW QUESTION SHARE SHIN QUESTIONS.

THANK YOU.

ALRIGHT, UH, WE WILL NOW HEAR CLOSING STATEMENTS.

UH, IF THERE ARE ANY, UH, MR. BIRCH, DO YOU HAVE A BRIEF CLOSING STATEMENT? ABSOLUTELY.

UM, WE APPRECIATE THE BOARD'S TIME, UH, TODAY.

UH, IT'S ALWAYS A PLEASURE TO APPEAR BEFORE THE BOARD AND, AND WE, UH, HOPE THAT WE, UH, CONTINUE TO MEET THE STANDARDS THAT WE'VE MET, UH, IN RUNNING THE CLUBS, UH, IN THE PAST, UH, TO WARRANT THE CLUB'S CONFIDENCE IN GIVING US, UH, AN EXEMPTION FROM THE LOCATIONAL RESTRICTION, UH, AND GRANTING US THE TWO YEAR EX, UH, EXEMPTION.

I THINK THE TESTIMONY SHOWS THAT THE CLUB IS WELL RUN.

THERE'S ADEQUATE SECURITY.

THIS DOESN'T CREATE A PROBLEM WITH CRIME IN THE NEIGHBORHOOD.

UH, IF YOU LOOK AT THE PROPERTIES AND THE DEVELOPMENT AROUND THE THE CLUB, THERE'S NO REAL DIFFERENCE BETWEEN DEVELOPMENT AND, AND PROPERTIES WITHIN THE A THOUSAND FOOT RADIUS AND THOSE THAT ARE OUTSIDE THE A THOUSAND FOOT RADIUS.

UH, AND WHILE THE, UH, CHIEF OF POLICE IS REQUIRED BECAUSE OF THE ORDINANCE, UH, IN THE WAY IT'S DRAFTED TO DENY THE PERMIT EACH YEAR, UH, THIS BOARD HAS THE AUTHORITY UNDER THE ORDINANCE TO GRANT AN EXEMPTION AND GRANT THE, UH, LATE HOURS PERMIT, UH, FOLLOWING A HEARING, WHICH IS WHY WE'RE HERE TODAY.

UH, ALSO UNDER SECTION FOUR POINT, UH, FOUR DASH TWO OF THE ORDINANCE, UH, THE BOARD HAS THE RIGHT, UH, HAS THE, UH, DISCRETION TO, UH, GRANT A TWO YEAR EXEMPTION, WHICH IT HAS DONE, UH, PRETTY CONSISTENTLY IN THE PAST FOR STATION FOUR.

UH, BECAUSE THE, UH, UH, UH, LOCATION DOESN'T HAVE A DETRIMENTAL EFFECT, UH, AND BECAUSE IT HAS, UH, HAD EXEMPTIONS FOR AT LEAST THE PRECEDING CONSE THREE CONSECUTIVE YEARS, UH, HAS NOT HAD ANY DANCEHALL LICENSE SUSPENDED, REVOKED, OR DENIED, AND THAT THERE HAVE BEEN NO VIOLATIONS, UH, OF THE, UH, DANCEHALL ORDINANCE, UH, COMMITTED BY STATION FOUR OR ANY EMPLOYEE OF STATION FOUR, UH, IN THE PAST.

UH, WITH THAT,

[00:50:01]

WE RESPECTFULLY ASKED THE BOARD TO, UH, GRANT OUR REQUEST FOR AN EXEMPTION FROM THE UH, THOUSAND FOOT, UH, LOCATIONAL RESTRICTION CONTAINED IN THE, UH, DANCE HALL ORDINANCE.

UH, AND IN ADDITION TO, UH, GRANT US THAT EXEMPTION FOR A PERIOD OF TWO YEARS.

AND AGAIN, WE THANK THE BOARD FOR ITS PATIENCE IN CONSIDERATION.

THANK YOU, MR. BIRCH.

UH, MR. WILKINS, DO YOU HAVE A CLOSING? JUST BRIEFLY, UM, REGARDING THE FOUR PRONGS THAT NEED TO BE ESTABLISHED HERE, UM, THE CITY HAS PROVIDED TESTIMONY THAT THE LOCATION OF THE DANCE HALL DOES NOT HAVE A DETRIMENTAL EFFECT ON NEARBY PROPERTY, UH, SUCH THAT IT'S CONTRARY TO PUBLIC SAFETY OR WELFARE.

UH, REGARDING NUMBER FOUR, WE HAVE NO EVIDENCE OF PREVIOUS VIOLATIONS OF CHAPTER 14.

UH, REGARDING NUMBERS TWO AND THREE, UH, THE APPELLANT PROVIDED TESTIMONY, WE HAVE NO EVIDENCE TO CONTROVERT IT.

SO, UH, IN CONCLUSION, THAT'S ALL WE GOT.

THANK YOU, SIR.

WITH THAT, WE WILL MOVE ON TO THE BOARD'S PORTION AND MOTIONS.

UH, DOES ANYONE HAVE A MOTION REGARDING THE DENIAL OF THE DANCE HALL LATE HOURS PERMIT FOR STATION FOUR? I MOVE THAT WE GRANT A TWO YEAR EXEMPTION FROM THE APPLICABLE ORDINANCE.

MR. HAYES MOVES TO REVERSE THE DECISION OF THE CHIEF OF POLICE AND GRANT A TWO YEAR EXEMPTION.

UH, AND A SECOND.

SECOND, UH, WAS THAT MR. QUINT? YES, SIR.

ALRIGHT.

UH, MR. HAYES, DO YOU WANT TO SPEAK IN FAVOR OF YOUR MOTION? JUST BRIEFLY? I APPLAUD ALL THE EFFORTS THAT, UH, THIS ORGANIZATION IS TAKING TO SUPPORT CHARITIES AND TO RUN AN ABOVE BOARD QUEEN ESTABLISHMENT THAT ACTUALLY PROBABLY BENEFITS THE COMMUNITY.

THANK YOU.

THANK YOU.

MR. HAYES.

IS THERE ANYBODY WHO'D LIKE TO SPEAK AGAINST THE MOTION? ANYBODY WHO'D LIKE TO SPEAK ON THE MOTION? MR. QUINT, YOU'RE THE SECOND.

WOULD YOU LIKE TO SPEAK IN FAVOR OF THE MOTION? PROBABLY VERY, VERY, VERY BRIEF.

I ECHO JACK'S SENTIMENTS.

THEY'RE, THEY'RE ACTUALLY SUCH A NICE ASSET TO THE COMMUNITY, EVEN DOWN TO THE GROUNDS.

THEY'RE SPOTLESS OUTSIDE, THEY WANNA MAKE SURE THEY'RE DOING IT RIGHT, EVEN WITH DECIBEL LEVELS.

UM, THE SCHOOL BENEFITS IT.

IT'S JUST SUCH A, A, A NICE ORGANIZATION AND WE'RE HAPPY TO HAVE 'EM IN OUR CITY.

THANK YOU, MR. QUINT.

UM, IS THERE ANYBODY ELSE WHO WOULD LIKE TO SPEAK, UH, ON OR AGAINST THE MOTION? UH, VICE CHAIR TORRES? YEAH, I'D LIKE TO SPEAK ON THE MOTION.

UM, I DEFINITELY AGREE.

UH, ONE OF MY FAVORITE PARTS ABOUT THIS IS THE COLLABORATION AND ADOPTION OF SAM HOUSTON, UM, PREP PL PREP.

I THINK THAT THAT'S JUST A GREAT, UM, WONDERFUL STORY AND IT SEEMS TO HAVE GONE ON FOR SO MANY YEARS, AND SO WE KNOW THAT IT WILL CONTINUE ON.

AND SO I JUST ALSO ENCOURAGE ANYONE THAT VIEWS, UH, THESE WEBEX VIDEOS AND IN PREPARATION FOR COMING IN IN FRONT OF THE BOARD.

UM, YOU KNOW, I THINK STATION FOUR IS AN EXEMPLARY, UH, EXAMPLE OF REASONS TO, YOU KNOW, GIVE AN EXEMPTION FOR THE TWO YEAR.

AND, YOU KNOW, IT'S JUST, IT'S, I LOVE THE BUSINESS BEHIND IT, BUT MOST IMPORTANTLY, I LOVE WHAT THEY'RE DOING IN THE COMMUNITY, ESPECIALLY WITH THE ELEMENTARY SCHOOL AND ITS ADOPTION BECAUSE, UM, DISD IS ALWAYS IN NEED OF SUPPORT IN THAT, IN THAT MANNER.

SO, UM, YOU DO IT SO WILLINGLY AND WITHOUT, YOU KNOW, ANY REQUIREMENTS.

SO JUST APPLAUD YOU FOR THAT.

THANK YOU.

THANK YOU.

VICE CHAIR.

UH, IS THERE ANYBODY, WHERE ARE WE? ANYBODY ELSE WHO WOULD LIKE TO SPEAK IN FAVOR OF THE MOTION? I WILL SPEAK VERY BRIEFLY IN FAVOR OF THE MOTION, JUST TO ECHO THE PROCEEDING COMMENTS THAT, UM, I DO APPRECIATE WHAT A GOOD STEWARD OF THE COMMUNITY THE BUSINESS IS.

AND, UH, I ALSO, UH, WOULD LIKE TO EXPRESS MY APPRECIATION, UH, TO MS. BANKSTON AND MR. BIRCH FOR, UH, PRESENTING US ALL THE INFORMATION, UH, THAT'S NEEDED FOR THE BOARD TO MAKE THIS DECISION IN A VERY, UH, WELL, UH, PRESENTED IN SUCCINCT MANNER.

[00:55:01]

IT'S CLEAR THAT YOU GUYS, UM, REALLY DO CARE ABOUT THE COMMUNITY AND YOUR PARTICIPATION IN IT.

SO I DO APPRECIATE THAT ON BEHALF OF THE BOARD.

UM, IF THERE ARE NO FURTHER DISCUSSIONS, WE WILL VOTE ON MR. HAYES'S MOTION TO REVERSE THE DECISION OF THE CHIEF OF POLICE AND GRANT A TWO YEAR EXEMPTION TO THE LOCATIONAL RESTRICTIONS FOR LATE HOUR PERMIT.

UM, ALL BOARD MEMBERS, PLEASE MAKE SURE YOUR CAMERAS AND MICROPHONES ARE ON.

ALL THOSE IN FAVOR, PLEASE SAY AYE.

AYE.

AYE.

ANY OPPOSED? PLEASE SAY NAY.

UH, THE MOTION PASS.

MOTION PASSES UNANIMOUSLY.

UM, FOR THOSE BOARD MEMBERS WHO ARE REMOTE, PLEASE REMEMBER TO, UH, MONITOR YOUR EMAIL.

YOU'LL GET THE FINDINGS FOR YOUR SIGNATURE.

THIS MEETING IS NOW CONCLUDED AT 9:28 AM.
