IS THERE A MOTION RECORDING THE MEETING MINUTES FROM THE NOVEMBER 24TH, 2024 MEETING CHAIR? I MOVE TO APPROVE THE MINUTES FROM NOVEMBER 7TH.
[00:05:03]

THE BURDEN OF PROOF IS ON THE APPELLANT AT THIS TIME.
UH, ANY WITNESSES WHO WISH TO TESTIFY IN THE HEARING, PLEASE RAISE YOUR RIGHT HAND SO THAT YOU MAY BE SWORN IN AND I GUESS EVERYBODY'S IN THE ROOM WHO'S GONNA TESTIFY? MM-HMM
DO YOU SOLEMNLY SWEAR THAT TO THE BEST OF YOUR KNOWLEDGE, THE TESTIMONY YOU WILL GIVE BEFORE THIS BOARD TODAY WILL BE THE TRUTH? I DO.
AND, UH, MR. ALBRIGHT, FOR THE RECORD, HOW MUCH TIME DO YOU THINK YOU NEED? UH, 20 MINUTES, UH, OF CARE, BUT I BET I DO A LOT LESS OF THAT, BUT OKAY.
AND MR. WILKINS FOR MUCH CASE IN CHIEF? FIVE.
UM, MR. ALBRIGHT, I'VE GOT ONE EXHIBIT OF EIGHT PAGES, IS THAT RIGHT? UH, YES.
MR. CARE AND MR. WILKINS, I'VE GOT, UH, ONE EXHIBIT FROM YOU AS WELL WITH A BUNCH OF TABS.
THOSE ARE ACCEPTED INTO EVIDENCE.
UM, MS. CARLISLE, WOULD YOU PLEASE READ THE RELEVANT ORDINANCE TODAY? EXCUSE ME.
TODAY YOU HAVE, BEFORE YOU AN APPEAL OF A DENIAL OF A DANCE HALL LATE HOURS PERMIT.
THE BOARD MAY REVERSE THE DECISION OF THE CHIEF OF POLICE AND GRANT A ONE YEAR EXEMPTION FROM LOCATIONAL RESTRICTIONS FOR LATE HOURS PERMIT.
IF THIS BOARD FINDS THE FOLLOWING, THAT WHEN THE LOCATION OF THE PROPOSED DANCE HALL WILL NOT HAVE A DETRIMENTAL EFFECT ON NEARBY PROPERTY, OR BE CONTRARY TO THE PUBLIC SAFETY OR WELFARE TO THE LOCATION OF THE PROPOSED DANCE HALL, WILL NOT DOWNGRADE THE PROPERTY VALUE OR QUALITY OF LIFE IN ANY ADJACENT AREA, OR ENCOURAGE THE DEVELOPMENT OF URBAN FLIGHT.
THE LOCATION OF THE PROPOSED DANCE HALL OPERATING UNDER A LATE HOURS PERMIT IN THE AREA WILL NOT BE CONTRARY TO ANY PROGRAM OF NEIGHBORHOOD CONSERVATION OR INTERVIEWER WITH ANY EFFORTS OF URBAN RENEWAL OR RESTORATION.
AND FOUR, ALL OTHER APPLICABLE PROVISIONS OF THIS CHAPTER WILL BE OBSERVED.
IF THIS BOARD FINDS IN THE CONTRARY TO ANY ONE OF THE PREVIOUS STATEMENTS, THEN THIS BOARD MAY AFFIRM THE DECISION OF THE CHIEF OF POLICE.
AND, UH, MR. ALBRIGHT, YOU HAVE THE BURDEN OF PROOF.
WOULD YOU LIKE TO BEGIN WITH A BRIEF OPENING? UH, UH, MR. CAR? I'LL, UH, I'LL WAIVE OPENING STATEMENT.
MR. WILKINS, DO YOU HAVE AN OPENING? I'LL ALSO WAIVE.
UH, THEN MR. AL, I'LL, I CALL, UH, DON LER.
I'M THE MANAGING MEMBER FOR, IT'LL DO CLUB 43 22 OPERATING LLC.
UH, I'VE OWNED AND OPERATED THE IT'LL DO CLUB SINCE 2019.
PRIOR TO THAT TIME, I OWNED AND OPERATED THE LIZARD LOUNGE, WHICH, UH, HAD A LATE HOURS PERMIT FOR 30 YEARS.
UH, THE SAME MANAGEMENT TEAM THAT OPERATED LIZARD LOUNGE IS STILL IN PLACE.
WE HAVE FOUR KEY PERSONNEL WHO HAVE BEEN WITH ME FOR 27 YEARS.
SO WE HAVE A LONG HISTORY AND A LOT OF EXPERIENCE IN OPERATING LATE HOURS PERMITS, UH, LOCATIONS WITH LATE HOURS PERMITS.
WE UNDERSTAND, UM, WHAT IT TAKES TO, TO DO IT SAFELY AND, AND, AND IN A MANNER THAT THAT
[00:10:01]
WILL NOT VIOLATE ANY OF THE, OF THE, UH, THE CONCERNS, UH, UH, STATED ANY ORDINANCE.UM, TO GIVE YOU A LITTLE BIT OF BACKGROUND ON DO CLUB, IT'S BEEN OPEN SINCE 1949, SO IT'S BEEN OPEN FOR MORE THAN 70 YEARS, AND IT'S BEEN MANY THINGS OVER 70 YEARS.
UM, THE CURRENT, UH, FORMAT FOR DO WE OPERATE AND WE SPECIALIZE IN, UH, IS IN HOUSE MUSIC.
WE, WE OPERATE LIKE A LIVE MUSIC VENUE.
WE'RE A HARD TICKET VENUE, WHICH MEANS YOU HAVE TO BUY A TICKET TO ENTER.
UH, WE BOOK SPECIFIC DJS, NATIONAL AND INTERNATIONALLY FAMOUS DJS.
UM, WE, UM, TYPICALLY WE ARE, WE DO NOT STAY OPEN AND REALLY ARE NOT LOOKING TO STAY OPEN ON A REGULAR BASIS.
AFTER 2:00 AM WE WANT THE, THE AFTER HOURS PERMIT FOR OCCASIONAL EVENTS.
AND WE RUN INTO CERTAIN ISSUES WITH THE, THE DJS THAT WE BOOK OFTEN FLY IN TO DALLAS.
WE DEAL WITH A LOT OF WEATHER ISSUES, FLIGHTS THAT GET DIVERTED.
IT WOULD BE HELPFUL TO US IF WE COULD STAY OPEN PAST TWO ON CERTAIN NIGHTS, BUT IT'S NOT SOMETHING THAT WE INTEND TO DO ON A WEEKLY BASIS.
UM, YOU KNOW, THE IT'LL DO CLUB HAS A BIT OF AN OLDER CROWD BECAUSE WE CATER TO THE HOUSE MUSIC CROWD.
WE, WE DON'T HAVE A BUNCH OF 20-YEAR-OLD KIDS.
UH, OUR CLIENTELE IS 25 TO 40 YEARS OLD.
IF YOU, IF YOU PULL UP TO THE LL DO CLUB, I CAN TELL YOU, YOU BARELY KNOW THE PLACES OPEN.
A VERY HIGH PERCENTAGE OF OUR CUSTOMERS UTILIZE RIDE SHARE SERVICES.
SO WE DON'T HAVE A LOT OF OF PARKING ISSUES.
WE HAVE 120 VALET PARKING SPOTS ON OUR LOT.
UH, WE HAVE VERY FEW CALLS FOR POLICE SERVICE.
UM, AND WE'VE HAD A VERY GOOD OPERATING TRACK HISTORY IN, IN THE FIVE YEARS THAT WE'VE OPERATED, IT'LL DO, UH, WE, WE WOULD ASK THE BOARD THAT THEY GRANT, UH, OUR VARIANCE TO ALLOW US TO BE OPEN AFTER HOURS UNTIL 4:00 AM FOR THE TIMES THAT WE NEED IT.
I DON'T ANTICIPATE IT WOULD BE MORE THAN A HANDFUL OF TIMES EACH YEAR, BUT WHEN WE NEED IT, WE NEED IT.
AND, AND ONE OF THE THINGS, AND ONE OF THE REASONS THAT WE WANT IT IS WE HAVE OPPORTUNITIES TO DO THINGS THAT WOULD CAUSE US TO STAY OPEN.
PAST TWO, RECENTLY, A DJ WAS PLAYING THE AMERICAN AIRLINE CENTER, HAD SOLD OUT TWO SHOWS, 40,000 TICKETS AND CONTACTED US, WANTED TO COME TO DO, TO PLAY AN AFTER SET, BUT WE WERE NOT ABLE TO ACCOMMODATE BECAUSE IT WOULD'VE STARTED AT ONE O'CLOCK AND ENDED AT 3:00 AM.
SO THERE ARE CERTAIN OPPORTUNITIES THAT WE HAVE OCCASIONALLY AND HAVE A NEED TO BE OPEN PAST 2:00 AM BUT IT'S NOT ON A REGULAR BASIS.
UH, AND SO THAT'S WHY WE'RE HERE TODAY, JUST WE WANT THE FLEXIBILITY TO BE ABLE TO STAY OPEN PAST TWO, BUT NOT SOMETHING WE WOULD DO ON A WEEKLY BASIS.
UH, MR. REDLER, LET ME ASK YOU SOME, SOME QUESTIONS TO, TO FLESH SOME OF THAT OUT.
UH, UH, AM I CORRECT THAT ALL OF YOUR EMPLOYEES ARE TABC CERTIFIED? YES.
AND, AND WHAT, WHAT DOES THAT MEAN? THEY'VE ALL BEEN, UH, GONE THROUGH TABC CERTIFICATION TRAINING, UH, AS WELL AS IN-HOUSE TRAINING, BUT THEY HAVE TABC CERTIFICATIONS.
AND YOU HAVE, UH, OR IT'LL DO, HAS WRITTEN POLICIES REGARDING PUBLIC AND TALKS UNDER EGGS, DRINKING, ET CETERA.
AND ALL OF THOSE ARE STRICTLY ENFORCED.
WE DO, AND WE ARE A 21 AND UP VENUE.
WE DON'T ALLOW ANYONE UNDER 21 IN THE VENUE.
AND TO BE CLEAR, YOU WILL, UH, HAVE TO DISCONTINUE ALCOHOL, UH, SALES SERVICE OR CONSUMPTION AT 2:00 AM CORRECT.
AND, AND YOU, UH, IT, SO AS IT, LIKE YOU SAID, IT'LL BE FOR, FOR CERTAIN SHOWS AND IT ALSO ALLOWS FOR SORT OF A COOL DOWN PERIOD AFTER 2:00 AM RATHER THAN EVERYBODY LEAVING AT RIGHT AT TWO, IT SPREADS OUT.
UH, UH, AND YOU ARE, UH, WELL, WELL GENERALLY YOU'RE IN, UH, COMMERCIAL ZONING.
YOU'RE IN CS ZONING AND MOST OF THE FOLKS TO THE WEST, EAST AND SOUTH OF YOU ARE ALL COMMERCIAL USES? CORRECT.
AND YOU'RE BASICALLY ON THE, THE, THE BACKSIDE OF ELM STREET WITH, UH, UH, COLUMBIA IN, IN FRONT OF YOU? THAT'S RIGHT.
UH, HOWEVER, TO THE NORTH, THERE ARE SOME, UH, SOME RESIDENTIAL, UH, UH, STRUCTURES.
AND, AND YOU'RE AWARE THAT I REACHED OUT TO AT LEAST ONE PROPERTY OWNER, THAT ONE WHO OWNED SEVERAL PROPERTIES THERE, DALE WOOTEN AND HIS SON MARK WOOTEN.
AND, UH, THEY HAD NO OBJECTIONS, UH, HAD NOTHING BAD TO SAY ABOUT IT'LL DO, UH,
[00:15:01]
WHICH IS WHY WE DON'T HAVE ANY ANYBODY HERE SPEAKING AGAINST US.IS THAT CORRECT? THAT'S CORRECT.
AND WE KNOW MOST OF OUR RESIDENTIAL NEIGHBORS ON AL-QAEDA STREET.
SO, UM, WE HAVE GOOD RELATIONSHIPS WITH ALL OF OUR RESIDENTIAL NEIGHBORS.
AND AS YOU SAY, YOU'VE BEEN INVOLVED WITH LATE HOURS CLUBS FOR, YOU KNOW, DARN NEAR EVER.
SO, UH, IS THERE, UH, HAS, HAVE YOU HAD ANY DETRIMENTAL EFFECT ON THE NEARBY PROPERTIES? NO.
AND YOU HAVE A VERY LOW NUMBER OF POLICE CALLS, UH, SO YOUR OPERATION IS AND WOULD NOT BE CONTRARY TO PUBLIC SAFETY OR WELFARE? THAT'S CORRECT.
AND, UH, AM I CORRECT THAT PROPERTY VALUES IN THE AREA HAVE GONE UP RATHER THAN DOWN? THEY'VE SKYROCKETED
UH, AND, UH, UH, YOU NOT OPERATING ANY WAY THAT WOULD AFFECT THE NEGATIVELY AFFECT THE QUALITY OF LIFE OR ENCOURAGE URBAN BLOOD? NO.
AND IN YOUR NEIGHBORHOOD THERE, AM I CORRECT? THERE'S NOT A PROGRAM OF NEIGHBORHOOD CONSERVATION? THERE IS NOT.
UH, AND IT'LL DO QUALIFIED FOR A DANCE HALL.
AND INDEED A DANCE HALL WAS, WAS ISSUED.
DANCE HALL LICENSE WAS ISSUED? YES.
UH, HOWEVER, THE POLICE DEPARTMENT HAD NO DISCRETION IN DENYING YOUR LATE HOURS PERMIT BECAUSE THERE WERE RESIDENTIAL USES WITHIN A THOUSAND FEET.
UH, AND AGAIN, UH, UM, OH, I, UH, STRIKE THAT.
UH, THEN WE WILL PROCEED TO BOARD QUESTIONING.
UM, MS. KYLE, DO YOU HAVE ANY QUESTIONS? I DO NOT.
UM, MS. WILLIS, DO YOU HAVE ANY QUESTIONS? NO, SIR.
TORRES, DO YOU HAVE ANY QUESTIONS? NO.
THANK YOU MR. LER FOR BEING HERE.
I DO HAVE A COUPLE QUESTIONS YOU MENTIONED, UH, OR, OR CAN YOU REMIND ME, WHAT ARE YOUR OFFICIAL HOURS AT THE MOMENT? WE OPEN AT 9:00 PM AND CLOSE AT 2:00 AM 9:00 PM AND CLOSE AT 2:00 AM.
UM, HAS, UM, I'LL DO CLUB EVER HAD A LATE HOURS PERMIT? NO.
SO THIS WOULD BE THE FIRST TIME? YES.
AND YOU MENTIONED THAT YOU HAVE, UH, OR ARE MISSING OUT ON OPPORTUNITIES AT THIS TIME.
UM, AND THAT'S WHY IT WOULD BENEFIT YOU TO HAVE THIS BECAUSE YOU MAY USE THIS ON AN OCCASIONAL BASIS.
UM, AND YOU SERVE ALCOHOL, UM, UP UNTIL WHAT TIME? 2:00 AM.
AND THEN YOU HAVE VALET PARKING.
DO YOU HAVE ANY OTHER PARKING OR IS IT ALL VALET? WE, WE VALET OUR ENTIRE LOT.
BECAUSE WE SECURE IT, WE DON'T WANT LOITERING.
AND WITH RIDESHARE, IT HAS BEEN A GAME CHANGER FOR NIGHTCLUBS IN TERMS OF PARKING NEEDS.
AND, UM, IS THERE SOMETHING THAT THIS CLUB DOES IN THE COMMUNITY? WELL, WE DO A LOT OF THINGS IN THE COMMUNITY.
WE, WE RAISE MONEY DURING THE HOLIDAYS AND DURING, UH, DURING THE BEGINNING OF SCHOOL TO HELP SOME LOCAL SCHOOLS, UH, WITH SCHOOL SUPPLIES.
UM, AND, AND WE'RE JUST GENERALLY GOOD NEIGHBORS.
WE, THERE'S A LOT OF HOMELESS PEOPLE IN OUR NEIGHBORHOOD.
AND, YOU KNOW, YOU, WE KIND OF, WE REACH OUT AND WE HELP A LOT OF THE LOCAL HOMELESS PEOPLE IN OUR NEIGHBORHOOD.
THEY DON'T WANT TO GO TO SHELTERS, UNFORTUNATELY.
UM, BUT, YOU KNOW, IT'S JUST A FACT OF LIFE.
IF YOU DO BUSINESS IN DOWNTOWN DALLAS, YOU'RE GONNA, YOU'RE GONNA HAVE SOME HOMELESS PEOPLE IN YOUR NEIGHBORHOOD.
THAT, THAT'S ALL QUESTIONS I HAVE CHAIR.
UH, MR. CILLA, DO YOU HAVE ANY QUESTIONS? UH, MR. CILLA? I THINK YOU'RE ON MUTE.
UM, COUPLE QUESTIONS HAVE ALREADY BEEN ASKED.
WHAT MY ONE I HAD WAS, BESIDES THE ISSUE, UM, WITH THE DJ WHO CAME IN AND PLAYED AMER, I GUESS AMERICAN AIRLINE CENTER AND THEN WAS WANTING, UH, TO COME AND DO AN AFTER PARTY, WERE THERE ANY OTHER NEEDS THAT YOU SEE
[00:20:01]
THAT YOU'LL BE ANTICIPATING IN THE FUTURE? LIKE, IS THERE A NEW YEAR'S EVE PARTY OR SOMETHING OF THAT SORT? WELL, WHAT WE'VE, WHAT WE'VE NOTICED OVER THE YEARS, WE DEAL WITH, UH, OUR DJS FLY IN FROM OTHER CITIES TO PERFORM.THEY COME IN FROM MIAMI, ATLANTA, SOMETIMES NEW YORK.
AND OVER THE, OVER THE PAST FIVE YEARS, WE'VE HAD A LOT OF WEATHER INCIDENTS IN DALLAS WHERE FLIGHTS GET DIVERTED AND SOMETIMES THE DJ ENDS UP LANDING AT DFW AT 1205 IN THE MORNING.
SO, YOU KNOW, THEY CAN'T GET TO THE CLUB TILL 1:00 AM SO IT WOULD BE HELPFUL TO US RATHER THAN ISSUING REFUNDS.
IF THE DJ COULD PLAY TO ONE TO 3:00 AM THAT WOULD BE HELPFUL TO US.
BUT WE'VE HAD MORE THAN OCCASIONAL, UH, ISSUES WITH FLIGHT DELAYS AND DIVERSIONS AND THAT SORT OF THING.
CAN YOU HEAR ME? CAN NOW? YES.
OH, SORRY, I WAS, DIDN'T TOUCH ANYTHING.
UM, BESIDES, UH, OR IN REGARD TO GROSS REVENUE, YOUR TOP LINE REVENUE, HOW MUCH IS TICK RELATED TO TICKET SALES FOR THESE, UH, DJS? I'M SORRY, I DIDN'T UNDERSTAND THE QUESTION.
IN YOUR GROSS REVENUE, HOW MUCH IS RELATED TO TICKET SALES FOR THE DJS? WELL, 50%.
51% OF OUR, OUR REVENUE COMES FROM TICKET SALES.
AND THEN THE OTHER REVENUE COMES FROM ALCOHOL SALES, IS THAT THAT'S CORRECT.
ALCOHOL, NON-ALCOHOLIC AND MERCHANDISE.
AND SO THE REASON FOR THE, THE, I GUESS THE DENIAL OF THE PERMIT WAS ONLY BECAUSE OF RESIDENTIAL, UH, HOUSING THAT HAD BEEN HAD, I GUESS HAD APPEARED LATER AFTER, UM, IT'LL DO, HAS BEEN AROUND OR BEEN OPEN, YES.
WERE THERE ANY OTHER REASONS? NO.
AND THEN IN REGARD TO YOUR EDUCATION RELATED TO YOUR, UM, EMPLOYEES FOR TABC, IS THAT AN ANNUAL RENEWAL OR HOW DOES THAT WORK WITH THE TABC EDUCATION? THEY, UH, THEY TAKE THE COURSE EVERY TWO YEARS.
THAT'S ALL MY QUESTIONS, CHAIR.
UH, MR. JEFFS, DO YOU HAVE ANY QUESTIONS? FURTHER QUESTIONS? THANK YOU.
MR. HAYES, UH, JUST BRIEFLY, I'M LOOKING AT THE OVERHEAD.
UH, DO YOU, AND YOU SAID THAT THERE WERE RESIDENCES ON ALADE STREET OR LC STREET? THAT'S CORRECT.
ARE THEY OWNER OCCUPIED OR RENTAL UNITS? AND HOW MANY OF 'EM ARE WE TALKING ABOUT? WITHIN THE THOUSAND FOOT RADIUS, MOST OF THEM ARE OWNER OCCUPIED AND THERE ARE SEVERAL EMPTY LOTS DIRECTLY ACROSS THE STREET FROM US.
THERE ARE FOUR EMPTY LOTS, SO YOU'D HAVE TO GO ABOUT, I DON'T KNOW, MAYBE A HUNDRED YARDS DOWN ALQAEDA STREET TO GET TO THE FIRST RESIDENT.
AND WHAT KIND OF NOISE CONTROL DO YOU HAVE? WOULD IF, IF I LIVED IN ONE OF THOSE RESIDENCES, WOULD I EVEN HEAR YOUR, YOUR CLUB? NO, YOU WOULDN'T.
AND I, AND I'LL TELL YOU WHY, UM, THE ELEVATION OF THE, IT'LL DO CLUB.
WE ARE ELEVATED EIGHT FEET ABOVE STREET LEVEL ABOVE ELM STREET.
WHEN YOU PULL INTO THE ILL DO CLUB, YOU GO UP THE DRIVEWAY AND THE NOISE LITERALLY, WELL, WE DO TWO THINGS.
ONE, UH, WE BUILT A VESTIBULE AT THE FRONT DOOR.
SO WHEN THE DOOR TO THE FRONT DOOR OPENS THE DOOR TO THE NIGHTCLUB ACTUALLY IS CLOSED.
SO YOU GO INTO THE VESTIBULE TO PAY THE COVER CHARGE, AND THEN YOU ENTER THE NIGHTCLUB THROUGH A SEPARATE DOOR.
AND HAVING THE VESTIBULE AVOIDS HAVING THE DOOR OPEN DIRECTLY TO THE OUTSIDE.
SO WHEN YOU PULL UP TO THE, IT'LL DO CLUB BETWEEN THE RIDESHARE AND THE FACT THAT THERE'S, THERE'S NO, THERE'S REALLY NO, NO, NOBODY WALKING FROM A PARKING LOT TO THE CLUB.
YOU'D BARELY KNOW WE WERE THERE.
UH, AND, AND IT'S AN OLD BUILDING WITH THICK BRICK WALLS, DOUBLE BRICK WALLS, AND THE BUILDING IS SO SOLID THAT YOU REALLY, YOU NOT HEAR US, UH, STANDING 50 FEET AWAY FROM OUR FRONT DOOR.
THAT'S ALL THE QUESTIONS I HAVE.
UH, MR. QUINT, DO YOU HAVE ANY QUESTIONS? UH, THANK YOU, CHAIR.
SO I WANNA MAKE SURE I HEARD THIS CORRECTLY.
THE CLUB WAS, UH, IN PLACE BEFORE THE HOUSES WERE BUILT.
[00:25:01]
SORRY, I DON'T, I'M, IT'S, IT IS REALLY HARD FOR ME TO HEAR.WAS, WAS THE CLUB IN PLACE BEFORE THE HOUSES WERE BUILT? YEAH, I, YOU KNOW, I CAN'T SAY EVERY, ALL THOSE STRUCTURES WERE PROBABLY BUILT IN THE FIFTIES.
I KNOW THAT LL DO WAS BUILT IN 1949.
THOSE HOUSES WERE PROBABLY BUILT WITHIN FIVE YEARS.
THEY LOOKED LIKE THEY WERE BUILT IN THE FIFTIES, WOULD BE MY BEST GUESS.
THAT I, THAT TOTALLY UNDERSTANDS THE, THAT MAKES SENSE.
'CAUSE Y'ALL HAVE BEEN THERE 70 YEARS WITHOUT ISSUES, SO TO SPEAK, OR, SO THE OTHER QUESTION I HAD WAS, UM, YOU SAID THERE WERE PREVIOUS CLUBS WITHIN THAT LOCATION.
DID ANY OF THEM HAVE LATE NIGHT PERMITS? NOT TO MY KNOWLEDGE.
UH, MS. SHIN, DO YOU HAVE ANY QUESTIONS? NO QUESTIONS AT THIS TIME.
UH, MR. VERA, DO YOU HAVE ANY QUESTIONS? OH, SORRY.
UH, MR. VERA IS ABSENT, SO HE HAS NO QUESTIONS.
UM, UH, I JUST HAVE A COUPLE OF QUESTIONS.
UM, JUST TO REITERATE, YOU, YOU'RE GONNA BE DOING THE SAME THING AFTER HOURS, BASICALLY, AS FAR AS NOISE AS YOU'RE DOING CURRENTLY.
AND YOU'VE HAD NO COMPLAINTS FROM THE NEIGHBORS ABOUT NOISE? NO.
UM, JUST LOOKING AT THE, THE OVERHEAD SATELLITE VIEW, I MEAN, IT'S HARD TO TELL LIKE WHAT'S HOUSES AND WHAT'S NOT THE, THE 175 FOOT MARK THAT THEY HAVE, THE CLOSEST ZONED RESIDENTIAL LOT, ARE YOU SAYING THERE'S NOT ACTUALLY A HOUSE THERE? HO, HOLD ON, LET ME LOOK.
DO, DO YOU HAVE THAT HONOR? LET ME VIEW PHOTO BEFORE HONOR.
WE CAN PUT IT UP ON THE SCREEN IF, YEAH.
IT'S TAB FOUR, MR. BUT I'VE GOTTA, GOTTA GET FIND IT.
I DIDN'T, I HAD SAID A HUNDRED YARDS, WHICH WOULD'VE BEEN 300 FEET.
UH, BUT 175 FEET LOOKS ACCURATE BECAUSE MOST OF THE LOTS DIRECTLY ACROSS THE STREET, THERE ARE AT LEAST FOUR EMPTY LOTS DIRECTLY ACROSS THE STREET FROM US.
AND THEN THERE ARE HOUSES AFTER THAT.
SO I THINK THE CLOSEST IS 175 FEET AND, AND THAT, BUT THAT LOT THAT THAT 175 FOOT ARROW IS POINTING TO, IS THERE A HOME ON THAT LOT? THAT'S CORRECT.
HAVE YOU HAD ANY INTERACTIONS WITH THE OWNERS OR THE RESIDENTS OF THAT? YES.
AND THEY'RE POSITIVE? YEAH, GENERALLY, YEAH.
WE, WE HAD A PROBLEM IN THE PAST WITH PEOPLE OCCASIONALLY PARKING.
WE HAD A PROBLEM WITH PEOPLE BLOCKING THEIR DRIVEWAY.
SO WE HAD SIGNS MADE, LITTLE SANDWICH BOARD SIGNS, AND WE PUT SOME SIGNS IN FRONT OF THEIR HOUSE THAT WE PUT OUT WHEN WE OPEN AND WE TAKE THEM UP AT THE END OF THE NIGHT AND THAT RESOLVED THE ISSUE.
DID THAT, DO YOU KNOW IF THAT RESOLVED THE ISSUE FROM THEIR PERSPECTIVE? IT DID.
AND, AND OTHER THAN THAT, YOU'VE, THEY'VE HAD NO NOISE ISSUES OR ANYTHING LIKE THAT? NONE.
WE HAVE VERY GOOD RELATIONS WITH OUR RESIDENTIAL NEIGHBORS.
UM, WE CAN GO THROUGH QUICKLY FOR A SECOND ROUND IN CASE ANYBODY HAS ANY FOLLOW UP QUESTIONS.
I, I, I'VE ACTUALLY BEEN TO, TO THE CLUBS FOR DJING ONE, ONE TIME, SO I, I'M FAMILIAR WITH IT ALWAYS LEVELS ON THE INSIDE VERSUS THE OUTSIDE, WHICH IS VERY VASTLY DIFFERENT.
MR. HAYES? UH, ONE QUICK FOLLOW UP.
YOU, YOU STATE THAT ONE OF THE, OR THE MAJOR REASON WHY YOU WANT THIS PERMIT IS TO HANDLE DJS WHO CAN'T SEE WHO FOR SOME REASON OR ANOTHER, CAN'T GET THERE IN TIME.
AND YOU WIND UP HAVING TO CANCEL AN EVENT, AND THAT'S UNDERSTANDABLE.
IF INDEED YOU WERE GIVEN THE PERMIT, WOULD YOU ACTUALLY SCHEDULE EVENTS THAT WENT BEYOND TWO? I LIKE JUST SAY THREE OR WHATEVER IT, IT, AT, IT IS NOT OUR INTENT TO SCHEDULE EVENTS AFTER 2:00 AM OUR IDEAL
[00:30:01]
BUSINESS MODEL IS TO OPEN AT 9:00 PM AND TO CLOSE AT 2:00 AM I WAS IN THE AFTER HOURS BUSINESS FOR 30 YEARS OVER AT LIZARD LOUNGE, AND I CAN TELL YOU THAT THE REVENUE AFTER 2:00 AM IS REALLY NEGLIGIBLE.UM, HOWEVER, IT, THIS WOULD ALLOW US TO CHARGE REVENUE LATER.
NORMALLY WE CUT OFF THE COVER AT 1:00 AM BUT WE HAVE NO PLANS CURRENTLY TO SCHEDULE LATE NIGHT EVENTS.
UH, THAT WOULD END AFTER 2:00 AM THAT WAS NOT THE INTENT FOR THE ACQUISITION OF THE PERMIT.
UH, AND I NOTE THAT MR. JEFFERSON, UH, IS NOW PRESENT.
MR. JEFFERSON, DO YOU HAVE ANY QUESTIONS FOR THE APPELLANT? NO.
AND I HAVE NO ADDITIONAL QUESTIONS, THEREFORE WE WILL MOVE ON TO THE CITY'S PRESENTATION.
MR. WILKINS, YOU RECOGNIZED FOR 20 MINUTES.
I'M GONNA CALL, UH, MY WITNESS.
UH, PLEASE STATE YOUR NAME FOR THE RECORD.
UH, DETECTIVE ARMANDO DEUS WITH THE VICE LICENSING UNIT.
UM, AND FOR THE RECORD, UH, HOW ARE YOU EMPLOYED? I WORK FOR THE DALLAS POLICE DEPARTMENT VICE LICENSING UNIT.
AND HOW LONG HAVE YOU BEEN WITH THE POLICE DEPARTMENT? UH, I'VE BEEN WITH THE POLICE DEPARTMENT ABOUT 15 AND A HALF YEARS.
AND HOW LONG HAVE YOU BEEN WITH THE VICE LICENSING UNIT? UH, UM, I HAVE BEEN CURRENTLY ASSIGNED TO MY, UH, CURRENT ASSIGNMENT, TWO AND A HALF.
WHAT ARE YOUR RESPONSIBILITIES IN VICE LICENSING? UH, WE APPROVED DENY, REVOKE, SUSPEND, SOB, SEXUALLY ORIENTED BUSINESS PERMITS, UH, DANCE HALL, LATE HOURS PERMITS, BILLIARD HALL PERMITS, AND AMUSEMENT CENTER.
ARE YOU FAMILIAR WITH THE BUSINESS KNOWN AS THE ILL DO CLUB LOCATED AT 43 22 ELM STREET? YES, I AM.
DID YOU REVIEW THE APPLICATION FOR THE IT'LL DO CLUB'S, DANCEHALL LATE HOURS PERMIT? YES, I DID.
TURNING TO TAB ONE IN THIS BINDER, CAN YOU BRIEFLY DESCRIBE THE APPLICANT'S APPLICATION HISTORY? YES, I WILL.
ON SEPTEMBER 20, 20, 24, WE RECEIVED THE APPLICATION AND BEGAN TO PROCESS IT.
UH, THAT'S INCLUDING THE DANCE HALL LATE HOURS.
UH, ON SEPTEMBER 23RD, UH, A SURVEY REQUEST WAS SENT OUT.
UM, AND THEN ON SEPTEMBER 8TH, UH, THE APPLICATION WE HAD RECEIVED THE SURVEY AT THE TIME, UH, WAS SENT OUT TO GET APPROVED BY THE CITY ATTORNEY'S OFFICE ON SEPTEMBER 23RD, WE RECEIVED THE, UH, REVIEW FROM THE CITY ATTORNEYS SAYING THE LATE HOURS IS DENIED FOR RESTRICTIONAL, UH, LOCATIONS, UH, ANY HOUSING WITHIN A THOUSAND FEET.
AND THEN ON SEPTEMBER 28TH, THE DANCE HALL, UH, APPROVAL LETTER WAS SENT OUT.
SO THE LATE HOURS SENT OUT ON THE 23RD.
UH, THE DANCE HALL WAS SENT OUT ON THE 28TH, WHICH WON'T BEGIN UNTIL MARCH OF NEXT YEAR, I BELIEVE.
AND THEN, AND P LAB WAS, UH, SCHEDULED FOR TODAY, THE 19TH.
SO, UH, JUST TO SUMMARIZE, YOU'RE SAYING THEY APPLIED FOR A DANCE HALL PERMIT FOR A LATE HOURS PERMIT, DANCE HALL PERMIT WAS APPROVED, LATE HOURS PERMIT WAS DENIED BASED ON THE LOCATIONAL RESTRICTION? YES.
IS THAT LOCATIONAL RESTRICTION? DISCRETIONARY? NO.
AND SO, UH, FOR CLARITY'S SAKE, IT'S BECAUSE THEY'RE WITHIN A THOUSAND FEET OF A RESIDENCE, RIGHT? YES.
TURNING TO TAB FIVE, DOES THIS TAB DOCUMENT CALLS FOR SERVICE AT THE LOCATION? YES, IT DOES.
HOW MANY CALLS PER SERVICE WERE THERE OVER THE PAST YEAR? UH, 14.
AND, UH, DID ANY OF THESE CALLS GENERATE POLICE REPORTS? UH, ONLY ONE TECHNICALLY.
IT, UH, WAS A DISTURBANCE STARTED AS A DISTURBANCE AND SOMEBODY WAS ARRESTED FOR PUBLIC INTOXICATION.
SO THAT OTHER ONE, THE MIR, WHAT DOES MIR STAND FOR? UH, MISCELLANEOUS INCIDENT REPORT.
THAT'S JUST DOCUMENTS THAT SOMEBODY, UH, DOCUMENTS THE COMPLAINT OR CALL THAT SOMEBODY MADE.
SO IN OTHER WORDS, POLICE WENT OUT THERE AND SO THEY NEED TO MAKE A REPORT THAT THEY WENT OUT THERE.
UM, WERE ANY OF THESE INCIDENTS OR CALLS AFTER 2:00 AM NO, THEY WERE NOT.
AND IS, UH, 14 CALLS AND TWO INCIDENTS, UH, A HIGH NUMBER OF, OF CALLS OR INCIDENTS FOR A BUSINESS OF THIS TYPE? UH, NO.
UM, DO YOU BELIEVE THAT THIS BUSINESS CREATES A PUBLIC SAFETY PROBLEM IF IT OPERATES DURING LATE HOURS? UH, NOT AT THIS
[00:35:01]
TIME.ASIDE FROM THE LOCATIONAL RESTRICTION OF BEING WITHIN A THOUSAND FEET OF RE OF A RESIDENCE, DO YOU KNOW OF ANY OTHER REASON TO DENY THIS APPLICANT'S DATE? DANCE HALL LATE HOURS PERMIT? AT THIS TIME, I DO NOT.
UH, MR. ALBRIGHT, DO YOU HAVE ANY QUESTIONS FOR THE CITY? MR. CAR? I HAVE NO QUESTIONS.
UH, MR. CAR, I HAVE NO QUESTIONS FOR THIS WITNESS.
I I WOULD LIKE TO ASK, UH, MR. LER ONE FOLLOW UP QUESTION AT THE APPROPRIATE TIME IF WE OKAY.
I DON'T KNOW IF THAT'S NOW OR, YOU KNOW, UM, LET'S, LET'S DO THE BOARD QUESTIONING.
AND, AND WE'LL SEE IF THAT'S STILL A ISSUE.
WE'LL FIRST GO THROUGH FOR THREE MINUTES.
UH, MS. CO, DO YOU HAVE ANY QUESTIONS FOR THE CITY? NO.
UH, MS. WILLIS, DO YOU HAVE ANY QUESTIONS FOR THE CITY AT THIS TIME? THANK YOU.
VICE CHAIR TORRES, DO YOU HAVE ANY QUESTIONS FOR THE CITY? I DO.
UM, I DO HAVE JUST A QUESTION REGARDING THIS, UM, ESTABLISHMENT AND THE OTHER ESTABLISHMENTS MAYBE THAT YOU'RE FAMILIAR WITH.
IT LOOKS LIKE 14 POLICE CALLS WERE REGISTERED, BUT ONLY TWO REPORTS WERE GENERATED.
IS THAT BECAUSE LIKE THE OTHER 12 JUST DECIDED NOT TO GO THROUGH WITH AN OFFICIAL REPORTING OF IT? LIKE, SOME OF THE CALLS ARE ACCIDENTS, SOME OF THE CALLS, SOME PEOPLE CALL AND THEN DON'T WANNA MAKE A REPORT OR, YOU KNOW, THERE'S NOTHING TO IT.
UM, SO YEAH, THESE ARE THE ONLY CALLS THAT ACTUALLY GENERATED REPORT, LIKE AN OFFICIAL REPORT.
WHICH WAS PUBLIC INTOXICATION AND THEN, UM, MR. MIR? YEAH.
NOW, UH, COMPARED TO OTHER CLUBS POTENTIALLY IN THE AREA, DO YOU FEEL THAT, UM, IT'S KIND OF NORMAL POLICE ACTIVITY? LIKE YES, I'VE SEEN, UH, CLUBS THAT GENERATE A LOT OF REPORTS OF, UH, A LOT OF PUBLIC INTOXICATION.
UH, ARREST, UH, THIS, THIS IS NOTHING NEAR ANY OF THE OTHER CLUBS THAT I'VE SEEN.
NOW, UM, DID UH, MR. WILKINS MENTION THAT AND ASKED YOU, YOU KNOW, OUTSIDE OF THE ACTUAL OFFICIAL RESTRICTION, YOU REALLY WOULDN'T, WOULDN'T HAVE DENIED THIS REQUEST FOR THEM TO STAY OPEN LATER, CORRECT? CORRECT.
UH, MR. CCIA, DO YOU HAVE ANY QUESTIONS? UM, NOT AT THIS TIME.
THANK YOU, MR. JEFFS, HOW ABOUT YOU? QUESTIONS? THANK YOU.
MR. HAYES, NO QUESTIONS ARE, OH, THERE YOU'RE, UH, MR. QUINT.
UM, I, I JUST HAD ONE QUESTION ON THE PUBLIC INTO, EXCUSE ME, ON THE PUBLIC INTOXICATION CALLED, DO YOU KNOW WHO CALLED THE POLICE? UH, FROM MY RECOLLECTION, I BELIEVE THE SECURITY GUARD THAT, YOU KNOW, THIS GUY WAS BEING, UH, CAUSING A DISTURBANCE, SO HE JUST WANTED SOME ASSISTANCE.
SO POLICE WERE CALLED OUT THERE FOR THAT.
THE, THE SECURITY GUARD FOR THE CLUB? YES.
UM, WE CAN RUN THROUGH AGAIN QUICKLY IN CASE ANYBODY HAS ANY FOLLOW UP QUESTIONS.
MS. KYLE? UM, MS. WILLIS? OH, I, THERE, UH, VICE CHAIR.
MR. ILLA? MR. JEFF QUESTIONS? OH, SORRY.
AND I SKIPPED, UH, YOU MR. JEFFERSON QUESTIONS? MR. HAYES? NO QUESTIONS.
MR. QUINT QUESTIONS? THANK YOU, CHAIR.
UM, AND THAT'S ALL YOU HAVE, MR. WILKINS? YES.
UM, I UNDERSTAND MR. ALBRIGHT, THAT YOU HAVE ANOTHER QUESTION FOR YOUR WITNESS.
[00:40:02]
I GUESS WE CAN DO THAT WITH UNANIMOUS CONSENT.IS THERE ANY OBJECTION TO ALLOWING, UH, TO, UH, MR. CARRA? I'LL, I'LL WAIVE MY REQUEST.
UH, THEN I GUESS IT'S TIME FOR CLOSINGS.
UM, MR. ALMIGHT, DO YOU HAVE A BRIEF CLOSING? UH, VERY, VERY QUICKLY.
UH, UH, MR. CARE, UH, OBVIOUSLY, UH, DON ADLER'S, A VERY, UH, UH, YOU KNOW, WELL-KNOWN, UH, CLUB OPERATOR BETWEEN DEEP DEVELOP AND THIS CLUB.
HE'S, HE'S BEEN DOING IT FOR, YOU KNOW, FOREVER.
AS, AS WE SAY, UH, LIZARD LOUNGE HAD NO PROBLEMS AND IT HAD A LATE HOURS.
HE KNOWS HOW, HOW TO RUN A LATE HOURS CLUB.
THE SAME TEAM THAT WAS IN PLACE AT LIZARD LOUNGE, THE FOUR TOP PEOPLE OR THE OWNERS, OPERATORS, MANAGERS, ET CETERA, OF, OF IT'LL DO.
SO WE HAVE A TEAM IN PLACE THAT, UH, UH, BECAUSE OF THAT WE HAVE A VERY LOW NUMBER OF POLICE CALLS FOR SERVICE.
UH, THERE IS, UH, YOU KNOW, NO EVIDENCE OF, UH, HAVING A DETRIMENTAL EFFECT ON NEARBY PROPERTIES WERE BEING CONTRARY TO PUBLIC SAFETY OR WELFARE.
UH, THERE'S NO EVIDENCE THERE'D BE THE DOWNGRADE OF PROPERTY VALUES THAT INDEED, UH, MR. LER TESTIFIED IN THE OPPOSITE THAT THEY WERE GOING UP.
UH, THERE'S NOT A NEIGHBORHOOD, UH, CONSERVATION PROGRAM GOING ON.
IT'LL DO QUALIFIED IN ALL OTHER RESPECTS.
THE POLICE DEPARTMENT WAS REQUIRED TO DENY THIS, BUT AS THE DETECTIVE INDICATED IT, IT WAS NOT IN HIS DISCRETION.
BUT FOR THAT REQUIREMENT, UH, UH, HE WOULD'VE APPROVED THE LATE HOURS AS WELL AS THE, UH, THE DANCE HALL.
UH, MR. NEDR HAS NOT ONLY WORKED HARD ON HIS CLUBS, BUT OVER THE YEARS, UH, HE'S BEEN ACTIVELY INVOLVED WITH THE CITY OF DALLAS DANCE HALL ORDINANCE AND WAS A MEMBER OF THE MAYOR'S DEVELOP TASK FORCE, TRIED TO ELIMINATE THE ILLEGAL RAVE CLUBS.
AND LITERALLY AS RECENTLY AS THIS MORNING, WE HAD A DISCUSSION WITH THE, UH, THE, UH, THE POLICE DEPARTMENT AND MR. WILKINS TO ALERT THEM TO YET ANOTHER ILLEGAL RAVE CLUB THAT TRIED TO WORK IN THE AREA.
UH, WE BELIEVE WE MEET ALL THE REQUIREMENTS AND WE ASK THAT IT BE APPROVED.
DO YOU HAVE A BRIEF CLOSING? MY CLOSING STATEMENT WILL BE FAIRLY DUPLICATIVE.
SO IN THE SPIRIT OF THE HOLIDAYS, I'M GOING TO GIVE OUR TIME BACK TO THE, TO THE BOARD.
SO, UH, NOW IT'S TIME FOR MOTION.
IS THERE A MOTION TO AFFIRM OR REVERSE THE DECISION OF THE CHIEF OF POLICE REGARDING THE DENIAL OF A LA DANCEHALL LATE HOURS PERMIT FOR IT'LL DO CLUB AND IN THIS CASE, IT'S ACTUALLY GRANTING AN EXEMPTION.
SO, IS THERE A MOTION TO GRANT AN EXEMPTION TO, UH, THE DENIAL OF THE DANCE HALL LATE HOURS PERMIT FOR DO CLUB? I MOVE THAT WE GRANT OVERTURN THE CHIEF'S, UH, DESIGNATION AND GRANT AN EXEMPTION TO THE CLUB MOTION BY MR. UH HAYES TO, UH, OVERTURN THE DENIAL OF THE DANCE DANCEHALL LATE HOURS PERMIT AND GRANT AN EXEMPTION FOR IT'LL DO CLUB A ONE YEAR EXEMPTION IN THIS CASE.
UH, IS THERE A SECOND? SECOND.
UH, SO WE HAVE A MOTION BY MR. HAYES, SECOND BY MR. JEFFERSON.
UH, MR. HAYES, WOULD YOU LIKE TO SPEAK IN FAVOR OF YOUR MOTION? IN THE SPIRIT OF BREVITY? I THINK WE'VE HEARD A VERY COMPELLING CASE TO GRANT THE EXEMPTION.
UH, I'M, I'M LOVING THIS HOLIDAY SPIRIT.
IS THERE ANYBODY WHO WOULD LIKE TO SPEAK AGAINST THE MOTION? IS THERE ANYBODY WHO WOULD LIKE TO SPEAK ON NEITHER FOR OR AGAINST THE MOTION? ALL RIGHT.
IS THERE ANYBODY ELSE WHO WOULD LIKE TO SPEAK FOR THE MOTION? IF THERE'S NO FURTHER DISCUSSION, WE WILL PROCEED TO A VOTE ON MR. HAYES'S MOTION TO OVERTURN THE DECISION OF THE CHIEF OF POLICE AND GRANT A ONE YEAR EXEMPTION FOR A DANCE HALL LATE HOURS PERMIT FOR DO CLUB.
MOTION PASSES UNANIMOUSLY IN THE SPIRIT OF BREVITY.
TODAY'S MEETING IS CONCLUDED AT 9:27 AM HAPPY HOLIDAYS EVERYONE.
HAPPY HOLIDAY TO ALL THE BOARD MEMBERS.
