UM, ON FRIDAY WAS A MEMORANDUM FOR ME DISCUSSING A REQUEST THAT I'M GOING TO BRING BACK BEFORE YOU ALL NEXT MONTH IN THE FORM OF A PUBLIC HEARING AND AN ACTION ITEM.
BUT WITHIN YOUR BOARD MATERIALS YOU WILL RECALL OR TAKE, HAVE TAKEN NOTE THAT, UM, BACK IN 2021, THE DALLAS POLICE DEPARTMENT REQUESTED, I'M FLIPPING TO GET TO THE, TO, TO THE, TO THE MEMO, BUT THE DALLAS POLICE DEPARTMENT REQUESTED, UM, THAT WE CHANGE THE, THE MINIMUM, UH, A PORTION OF THE MINIMUM QUALIFICATIONS FOR TRAINING POLICE OFFICER TO ALLOW FOR AN UNCHARACTERIZED DISCHARGE AS, AS AT THE TIME RECOGNIZED BY THE TEXAS COMMISSION ON LAW ENFORCEMENT.
SINCE THAT TIME, IN APRIL OF 2024, THE TEXAS, UM, T CODE DEPARTMENT, UM, ASK THAT, WELL, THEY, THEY SIT BACK CLARIFYING LANGUAGE SAYING THAT THEY WILL NOT ACCEPT AN UNCHARACTERIZED DISCHARGE IN THE EMPLOYMENT PROCESS OR IN THE GRANTING OF THE LICENSE, I SHOULD SAY.
AND SO IN RESPONSE TO THAT, THE DEPARTMENT HAS COME BACK AND ASKED THAT WE CONSIDER AMENDING OUR QUALIFICATIONS TO REMOVE THAT LANGUAGE AS IT RELATES TO UNCHARACTERIZED DISCHARGE.
AND THAT'S WHAT WE SAW IN THEIR MATERIAL.
UM, AND WANTED TO DISCUSS THAT WITH YOU TODAY AND ANSWER ANY QUESTIONS YOU MAY HAVE BEFORE SEEING THAT AGAIN.
IT IS MY HOPE TO BRING THAT BACK TO YOU IN MARCH.
UM, HAVE A PUBLIC HEARING TO HEAR FROM ANY EMPLOYEES WHO MAY HAVE AN OPINION ONE WAY OR ANOTHER, UM, ABOUT THE RULE AMENDMENT.
AND THEN HOPEFULLY AS WE CONTINUE TO WORK WITH THAT RULE AMENDMENT AND OTHERS AS IT RELATES TO POLICE, AND WE'VE DISCUSSED, UM, AS A GROUP BEFORE THAT, THAT ALL CATCH UP.
AND WHEN WE GO TO COUNCIL TO MAKE ONE, UM, UPDATE TO THE RULES AS WE UNDERSTAND 'EM.
I I READ THROUGH MATERIALS, BUT I DON'T NECESSARILY COMB THROUGH 'EM LIKE SOME OF THE OTHER COMMISSIONERS.
UM, CAN IS IT SHORT ENOUGH FOR YOU TO READ THE SENTENCE THAT'S GETTING CHANGED AND THEN WHAT IT'S CHANGING TO? YES.
THE, THE, THE SENTENCE, UM, AND I DON'T HAVE IT RIGHT IN FRONT OF ME, AND I'M AT, AT A, AT A DISADVANTAGE, BUT, BUT THE, IT'S SIMPLY THIS BOARD MEMBER GERBER, THE RULE USED TO, OR THE RULE CURRENTLY ALLOWS THAT WE WOULD CONSIDER A PERSON FOR EMPLOYMENT THAT THEY HAVE PREVIOUS OR PRIOR MILITARY SERVICE WITH AN HONORABLE DISCHARGE OR AN UNCHARACTERIZED DISCHARGE.
THE, THE, THE NEW, THE CHANGE WOULD JUST SIMPLY STRIKE UNCHARACTERIZED THE DISCHARGE, AND IT WOULD JUST REMAIN AN HONORABLE DISCHARGE WITH PRIOR MILITARY SERVICE.
SO IT'S REALLY JUST STRIKING ONE WORD, UNCHARACTERIZED.
WHAT DOES UNCHARACTERIZED MEAN? IT, IT DOESN'T WITHOUT CHARACTER.
UM, GENERALLY THE, THE, THE, UM, DEPARTMENT OF DEFENSE HAS SOME SIXTH UM, CATEGORIES.
AND, AND WE, WHAT WE UNDERSTAND UNCHARACTERIZED TO ME IS THAT THE INDIVIDUAL WAS IN ARMED FORCES OR IN THE MILITARY

FOR A PERIOD OF TIME, AND THEIR DISCHARGES OF THE CIRCUMSTANCES THAT THEY CANNOT CHARACTERIZE IT HONORABLE OR DISHONORABLE.IT'S JUST SIMPLY UNCHARACTERIZED DISCHARGE.
AND SO THAT, THAT WOULD, THAT USED TO BE OR SEEN AT SOME POINT AS AN OPPORTUNITY FOR THE DEPARTMENT TO BE ABLE TO DO FURTHER INVESTIGATION AND LOOK INTO THE CIRCUMSTANCES AROUND GIVING RISE TO THE DISCHARGE AND, AND IN ITS UNCHARACTERIZED NATURE.
BUT, BUT THAT'S NO LONGER ACCEPTABLE BY CHIEF COLE.
SO THAT'S WHY WE'RE, THAT'S WHY I'M GONNA BE RECOMMENDING THAT WE STRIKE THAT.
PAM, IF I COULD GIVE YOU AN EXAMPLE.
UH, I'VE DEALT WITH IT A FEW TIMES IN THE EMPLOYMENT LAW COMPLEX, UH, CON, UH, CONTEXT, UM, AN UNCHARACTERIZED DISCHARGE, FOR EXAMPLE, PEOPLE HAVE JOINED THE MILITARY AND SHORTLY AFTER JOINING, FOR SOME REASON THEY, THEY, THEY ARE ASKED, THEY ASKED TO LEAVE THE MILITARY AND IS APPROVED.
THEY LEAVE PRIOR TO THE END OF THEIR SERVICE.
IT CAN BE FOR A HOST OF REASONS.
UM, BUT, BUT I'VE, I'VE ENCOUNTERED SOME PEOPLE IN THE PAST WHO'VE BEEN IN THE MILITARY LIKE TWO MONTHS AND THEY LEFT.
SO THEY DON'T GET, THEY DON'T GET AN HONORABLE DISCHARGE BECAUSE THEY'RE LEAVING BEFORE THE TERM, THEIR TERM SERVICE HAS ENDED OR, OR A DISHONORABLE DISCHARGE AS A CASE MAY BE.
UM, SO THEY, THEY, THEY'RE CHARACTERIZED AS AN UNCHARACTERIZED OR THEY'RE CLASSIFIED AS AN UNCHARACTERIZED DISCHARGE.
SO IT'S NOT AN HONORABLE DISCHARGE, IT'S NOT A DISHONORABLE DISCHARGE, IT IS JUST A DISCHARGE FROM THE MILITARY FOR, FOR A LIST OF POSSIBLE REASONS.
AND T COLE IN THE PAST, TEXAS COMMISSIONER LAW ENFORCEMENT, HAD SAID IN THE PAST THAT YOU, YOU, THAT, THAT YOU, YOU WOULD BE ELIGIBLE WITH A A A, AN HONORABLE DISCHARGE OF COURSE.
AND WITH AN UNCHARACTERIZED DISCHARGE, THEY'VE NOW CHANGED THAT AND JUST ELIMINATED THE UNCHARACTERIZED DISCHARGE AS BEING ACCEPTABLE.
AND MY QUESTION, AND JARED I GUESS I WOULD HAVE IS SINCE T CALL REQUIRES US FOR, FOR STATE, FOR, FOR THE STATE OF TEXAS, I I'M NOT SURE WE HAVE MUCH CHOICE.
WE, WE DON'T, UM, AND I DON'T WANT US ADVERTISING JOBS THAT ARE CONTRADICTORY TO THE LICENSE AGENCY.
UM, AND SO THAT'S WHY THAT'S, THAT'S REALLY WHY THAT'S HERE.

UH, AND, AND WITH THE LIMITED RESOURCES THAT WE HAVE, YOU KNOW, WE HAVE THE BUDGET CUTS, WOULD, WOULD WE CUT LIKE 5.7 MILLION OR SOMETHING LIKE THAT? WE'RE GONNA HAVE TO FIGURE OUT WAYS AROUND THAT.
SO I JUST WANNA MAKE SURE THAT THAT STAYS ON EVERYBODY'S RADAR SCREEN.
THIS IS NOT SOMETHING THAT WE CAN JUST LIGHTLY SKIP OVER.

IT STARTS WITH US, UM, IN TERMS OF SETTING OUR PRIORITIES AND OUR GOALS, WHICH, YOU KNOW, WHAT, WHAT WE KIND OF TALKED THROUGH AND WE'D ALREADY SET UP FOR THIS FISCAL YEAR, UM, UNDERSTANDING THAT THERE MAY BE SOME ADDITIONAL THINGS THAT WE NEED TO GO AND GIVE OUR ATTENTION TO.
UM, OR SOME THINGS THAT WE NEED TO TAKE OUR ATTENTION FROM THAT WE SAID WE WERE GOING TO DO.
BUT I THINK THAT'S A PART OF THE ITERATIVE, ONGOING, YOU KNOW, KIND OF PLANNING AND EXECUTION PROCESS.
BUT WITH US, DO YOU, HOW DO YOU NORMALLY DO THAT WHEN YOU WANNA DO, THIS IS LIKE A CONSTITUTIONAL CONVENTION IN MY BOOK.
