SO TONIGHT I'M GONNA WALK YOU THROUGH A BRIEF HISTORY OF CITY OF DALLAS ENVIRONMENTAL PERFORMANCE, AND THEN AN INTRODUCTION OF THE ENVIRONMENTAL MANAGEMENT SYSTEM AND THE ISO CERTIFICATION. UM, THEN THE BENEFITS OF THE EMS AND HOW WE ARE LOOKING FORWARD. NEXT SLIDE, PLEASE. NEXT SLIDE. SO, I'M NOT SURE IF ANY OF Y'ALL WILL REMEMBER THIS, BUT IN 2003, FOX NEWS RELEASED A NEWS STORY ABOUT THE CITY OF DALLAS TITLED DIRTY WATER DIRTY SECRETS. AS IMPLIED BY THE STORY'S TITLE, IT DID NOT SHINE A FAVORABLE FAVORABLE [00:10:01] LIGHT ON THE CITY. AT THAT TIME, THE NEWS CAMERAS CAUGHT PETROLEUM PRODUCTS DISCHARGING FROM CITY FACILITIES AND FLOWING INTO STORM DRAINS, WHICH WAS A VIOLATION OF THE CITY'S MUNICIPAL SEPARATE STORM WATER, STORM SEWER SYSTEM, OR MS FOUR PERMIT. AS PART OF THE FEATURE, THE REPORTERS ALSO NOTED AN APPARENT DOUBLE STANDARD THAT THE CITY ITSELF WAS IN VIOLATION WHILE CITY INSPECTORS WERE PURSUING IN ENFORCEMENT ACTIONS WITH HEFTY FINES AGAINST PRIVATE COMPANIES WITH SIMILAR VIOLATIONS. SO SOON AFTER THE NEWS REPORT, THE EPA INVESTIGATED AND THE CITY BEGAN TO QUICKLY ADDRESS THE CRITICAL AND SYSTEMATIC ISSUES THAT HAD BEEN IDENTIFIED. IN FEBRUARY, 2004, THE EPA ISSUED THE CITY OF DALLAS A COMPLIANCE ORDER ALLEGING THAT THE CITY HAD FAILED TO ADEQUATELY IMPLEMENT FUND AND STAFF THE CITY'S STORMWATER MANAGEMENT PROGRAM. IN RESPONSE TO THE COMPLIANCE ORDER, THE OFFICE OF ENVIRONMENTAL QUALITY WAS ESTABLISHED AND IMMEDIATELY BEGAN CONDUCTING AUDITS TO DETERMINE THE ROOT OF ENVIRONMENTAL AND COMPLIANCE ISSUES. THE VIOLATIONS DISCOVERED THROUGH THESE AUDITS WERE REPORTED TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY. UNDER THE AUDIT PRIVILEGE ACT IN 2005, THE CITY MANAGER'S OFFICE ANNOUNCED THAT THE CITY WOULD IMPLEMENT AN ENVIRONMENTAL MANAGEMENT SYSTEM IN 11 CITY DEPARTMENTS TO BE COMPLETED BY APRIL, 2007. THIS WAS THE FIRST AND LARGEST EFFORT OF ITS KIND IN THE NATION AT THE TIME. AND THEN IN 2006, THE CITY ENTERED INTO A CONSENT DECREE, WHICH IS A SET, WAS A SETTLEMENT AGREEMENT BETWEEN THE CITY OF DALLAS AND THE DEPARTMENT OF JUSTICE, WHO WAS ACTING ON BEHALF OF THE U-S-E-P-A NEXT SLIDE. INITIALLY, DOJ AND EPA ASSESSED AN $8 MILLION CIVIL PENALTY. THROUGH NEGOTIATIONS, THE CITY OF DALLAS REACHED AN AGREEMENT WITH THE FEDERAL GOVERNMENT REQUIRING THE CITY TO SPEND IN EXCESS OF 3.5 MILLION IN A COMPREHENSIVE EFFORT TO DECREASE THE AMOUNT OF POLLUTION ENTERING THE CITY STORMWATER SYSTEM, AND TO ENSURE THE CITY'S COMPLIANCE GOING FORWARD. NEXT SLIDE. THE SETTLEMENT REQUIRED THE CITY TO CONSTRUCT TWO WETLANDS AT AN ESTIMATED COST OF $1.2 MILLION. ONE ALONG THE TRINITY RIVER AND ONE ALONG CEDAR CREEK NEAR THE DALLAS ZOO. THE CITY ALSO HAD TO PAY A CIVIL PENALTY OF $800,000. UNDER THE CONSENT DECREE, THE CITY WAS REQUIRED TO HAVE AT LEAST 36 PEOPLE WORKING IN THE CITY STORMWATER MANAGEMENT SECTION, WHICH WAS A 25% INCREASE OVER THE NUMBER OF PEOPLE ON STAFF WHEN EPA ISSUED ITS COMPLIANCE ORDER. THE CONSENT DECREE ALSO REQUIRED THE CITY TO INSPECT AT LEAST 500 STORMWATER DISCHARGE PIPES PER YEAR, 500 INDUSTRIAL FACILITIES EACH YEAR, AND LARGE CONSTRUCTION SITES EVERY TWO WEEKS. PURSUANT TO THE SETTLEMENT, THE CITY CREATED A FORMAL FORMAL ENVIRONMENTAL MANAGEMENT SYSTEM FOR 12 CITY RUN FACILITIES, INCLUDING THE CITY'S SERVICE CENTERS, AND HAD A THIRD PARTY, THIRD PARTY AUDITOR REVIEW THE MANAGEMENT SYSTEMS. THE OFFICE OF ENVIRONMENTAL QUALITY WAS CREATED TO OVERSEE ALL OF THESE ACTIVITIES. NEXT SLIDE PLEASE. ON OCTOBER 5TH, 2023, THE US DISTRICT COURT FOR THE NORTHERN DISTRICT OF TEXAS APPROVED THE JOINT STIPULATION AND CONSENT MOTION FOR FINAL TERMINATION OF THE CONSENT DECREE, AND DETERMINED THAT FINAL AND COMPLETE TERMINATION WAS WARRANTED. THE TERMINATION OF THE CONSENT DECREE SPEAKS TO THE HARD WORK OF THOUSANDS OF CITY STAFF SUCCESSFULLY ENSURING COMPLIANCE WITH THE CITY'S ENVIRONMENTAL OBLIGATIONS, CREATING A CULTURE OF MANAGING AND REDUCING ENVIRONMENTAL RISKS, AND IMPROVING THE CITY'S ENVIRONMENTAL PERFORMANCE. NEXT SLIDE. LOOKING BEYOND THE TERMINATION OF THE CONSENT DECREE, THE CITY OF DALLAS REMAINS COMMITTED TO CONTINUING TO COMPLY WITH EN ENVIRONMENTAL REGULATIONS, MANAGING ENVIRONMENTAL RISKS FROM CITY OPERATIONS AND IMPROVING ENVIRONMENTAL PERFORMANCE THROUGH EXISTING SYSTEMS AND PROGRAMS. LIKE THE EMS, THE CITY'S ENVIRONMENTAL MANAGEMENT SYSTEM ADVANCES REGULATORY COMPLIANCE PROGRAMS ACROSS MULTIPLE ENVIRONMENTAL MEDIA. THE ME, THE EMS IS NOT ONLY REQUIRED BY THE CITY'S MS FOUR STORMWATER PERMIT, BUT IT ALSO SUPPORTS ADVANCEMENT OF THE ENVIRONMENTAL AND CLIMATE GOALS UNDER THE CITY'S COMPREHENSIVE ENVIRONMENTAL [00:15:01] AND CLIMATE ACTION PLAN, OR CCAP, THE OBJECTIVES AND TARGETS SET BY THE CITY DEPARTMENTS AS PART OF THE EMS WASTE MINIMIZATION JUST BEING ONE EXAMPLE, OFTEN SUPPORT SEA CAPITALS OF MITIGATING CLIMATE CHANGE IMPACTS BY REDUCING GREENHOUSE GAS EMISSIONS, ENHANCING RESILIENCE TO EXTREME WEATHER EVENTS, AND, AND PROMOTING SUSTAINABILITY THROUGHOUT THE CITY. NEXT SLIDE. NEXT SLIDE. ISO IS SHORT FOR THE INTERNATIONAL ORGANIZATION FOR STANDARDIZATION, WHICH IS A WORLDWIDE FEDERATION OF NATIONAL STANDARDS BODIES, OR ISO MEMBER BODIES, PRIMARILY WORKING THROUGH ITS TECHNICAL COMMITTEES. THE ISO CREATES INTERNATIONAL STANDARDS ON A WIDE RANGE OF TOPICS. ISO 14,001 IS THE INTERNATIONALLY RECOGNIZED STANDARD FOR ENVIRONMENTAL MANAGEMENT SYSTEMS. IT PROVIDES A FRAMEWORK FOR ORGANIZATIONS TO DESIGN AND IMPLEMENT AN EMS WITH THE OBJECTIVE OF CONTINUALLY IMPROVING THEIR ENVIRONMENTAL PERFORMANCE. THE NUMBER AFTER THE COLON, IN THIS CASE 2015, IS THE PUBLICATION DATE OF THE CURRENT STANDARD. 2015 IS THE MOST CURRENT VERSION, ALTHOUGH, AS I WILL DISCUSS LATER IN THE PRESENTATION, PUBLICATION OF AN UPDATED VERSION IS EXPECTED LATER THIS SPRING. ONCE PUBLISHED CERTIFIED ENTITIES HAVE THREE YEARS TO IMPLEMENT AND BE CERTIFIED IN THE NEW STANDARD. THE SUCCESS OF ENVIRONMENTAL MANAGEMENT SYS, UH, OF AN ENVIRONMENTAL MANAGEMENT SYSTEM DEPENDS ON COMMITMENT FROM ALL LEVELS AND FUNCTIONS OF THE ORGANIZATION. LED BY TOP MANAGEMENT ORGANIZATIONS CAN LEVERAGE OPPORTUNITIES TO PREVENT OR MITIGATE ADVERSE ENVIRONMENTAL IMPACTS AND ENHANCE, OH, WE'RE NOT DONE YET. YEAH, THAT'S ALRIGHT. , TO PREVENT OR MITIGATE ADVERSE ENVIRONMENTAL IMPACT IMPACTS AND ENHANCE BENEFICIAL ENVIRONMENTAL IMPACTS, PARTICULARLY THOSE WITH STRATEGIC IMPLICATIONS IN IMPLEMENTING THE STANDARD, THE CITY OF DALLAS CAN ENSURE WE ARE TAKING PROACTIVE MEASURES TO MINIMIZE OUR ENVIRONMENTAL FOOTPRINT, COMPLY WITH RELEVANT LEGAL REQUIREMENTS AND ACHIEVE OUR ENVIRONMENTAL OBJECTIVES. THE LEVEL OF DETAIL AND COMPLEXITY OF THE ENVIRONMENTAL MANAGEMENT SYSTEM WILL VARY DEPENDING ON THE CONTEXT OF THE ORGANIZATION, THE SCOPE OF ITS ENVIRONMENTAL MANAGEMENT SYSTEM, ITS COMPLIANCE OBLIGATIONS, AND THE NATURE OF ITS ACTIVITIES, PRODUCTS, AND SERVICES, INCLUDING ITS ENVIRONMENTAL ASPECTS AND ASSOCIATED ENVIRONMENTAL IMPACTS. THROUGH THE EMS, THE CITY ASSESSES ITS ACTIVITIES, THE POTENTIAL AND ACTUAL ENVIRONMENTAL IMPACTS OF EACH ACTIVITY, AND PROVIDES GUIDELINES SUCH AS BEST MANAGEMENT PRACTICES, WORK INSTRUCTIONS, AND ADMINISTRATIVE DIRECTIVES TO REDUCE ENVIRONMENTAL IMPACTS. IN ADDITION TO THESE AUDITS AND ASSESSMENTS, EXTERNAL THIRD PARTY AUDITS ARE CONDUCTED TO VERIFY THAT THE CITY OF DALLAS EMS MEETS THE REQUIREMENTS OUTLINED IN THE ISO 14,001 IN ORDER TO MAINTAIN OUR CERTIFICATION. SO I'M SURE THAT YOU HAVE NOTICED THAT THERE'S A SLIGHT DIFFERENCE BETWEEN THE NUMBER OF ASSESSMENTS AND AUDITS BETWEEN THE TWO YEARS. AS YOU CAN SEE, THERE HAS BEEN A SIGNIFICANT DROP IN HAZARDOUS WASTE AND UNIVERSAL WASTE GENERATION AS A RESULT OF THE ISO 14,001 EMS. NEXT SLIDE. IN ADDITION TO REDUCED HAZARDOUS AND UNIVERSAL WASTE, THERE'S BEEN A SIGNIFICANT REDUCTION IN OVERALL WASTE DISPOSAL OF THE CITY. THIS LEADS TO A REDUCTION IN WASTE THAT HAS BEEN SENT TO THE LANDFILLS AND COST SAVINGS AND AND WASTE DISPOSAL COSTS. I WANT TO POINT OUT THAT THE JUMP THAT YOU SEE IN 2013 WAS DUE TO A PROCESS CHANGE THAT RESULTED IN AN INCREASE OF NON-HAZARDOUS WASTE THAT YEAR. BUT CONVERSELY, IT WAS A DECREASE IN HAZARDOUS WASTE. UM, ADDITIONALLY, THERE WAS A JUMP, A SLIGHT JUMP IN, UH, NUMBER OF SPILLS THAT YEAR, WHICH ALL WHICH LED TO MORE WASTE GENERATION AND DISPOSABLE AS WELL. NEXT SLIDE. SO, THIS CHART SHOWS THE IMPACT OF ADOPTING ISO 14,001 ON THE RECYCLING OF USED OIL RECYCLING. USED OIL IS IMPORTANT BECAUSE IT ALLOWS FOR THE REUSE OF AN IMPORTANT RESOURCE, AND IT ALSO SIGNIFICANTLY REDUCES THE POTENTIAL FOR HOME HARMFUL METALS AND HYDROCARBON POLLUTION BY KEEPING OIL OUT OF LANDFILLS, UM, OUT OF LANDFILL SEWERS IN WATER WAVES. AND IT ALSO REDUCES THE COST BY REDUCING HAZARDOUS BASED DISPOSAL. NEXT SLIDE. THEY ALSO, UH, APPROVE THEIR FIRST UPDATED DEVELOPMENT STANDARDS, WHICH WILL AFFECT ANY DATA DEVELOPMENT, UH, DATA CENTER DEVELOPMENT GOING FORWARD. UH, WE HAD ATTEMPTED TWO VOTES ON MORATORIUMS OUT THERE, WHICH FAILED THANKS TO SENATOR BETTENCOURT SENDING A THREATENING LETTER, UH, TO THE COMMISSIONERS. UM, I WILL ALSO SAY THAT SOMERVILLE WATER DISTRICT HAS TURNED DOWN SAIL FISH'S REQUEST FOR WATER. AND, AND THE ACTON MUD HAS TURNED DOWN PACIFIC COAST REQUEST FOR WATER. AND, UH, I KNOW MS. ROBERSON MENTIONED WATER BEFORE, WE'RE TALKING 7,000 ACRES WORTH OF DATA CENTERS. JUSTIN HOOD COUNTY. UM, THE 2,600 ACRE DATA CENTER WOULD USE OVER, UH, A MILLION GALLONS OF WATER PER DAY. THAT'S HOW HUGE THE VOLUMES ARE. UM, I DON'T THINK THE OPPORTUNITY GROUNDWATER DISTRICT THINKS THEIR AQUIFERS CAN SUSTAIN ALL THAT. AND WE SHOULD ALL BE CONCERNED THAT A LOT OF THESE DATA CENTERS ARE CO-LOCATED WITH NATURAL GAS PLANTS. AND IN DOING MY OWN WORK ON DATA CENTERS, 'CAUSE I'M PRESENTING NEXT MONTH TO THE FORT WORTH SIERRA CLUB ON DATA CENTERS, I FOUND A STARTLING FACT FROM THE GLOBAL SCIENCE MONITOR. AND IT'S THAT TEXAS IS ONLY SECOND TO CHINA NOW IN NATURAL GAS DEVELOPMENT, YET THEY HAVE 50 TIMES THE AM THE POPULATION AND 15 TIMES THE LAND MASS. HALF OF THAT NATURAL GAS DEVELOPMENT IS FOR DATA CENTERS IN TEXAS. SO WE ARE LOOKING AT A HUGE JUMP IN EMISSIONS AS WELL. SO JUST WANTED TO PUT THAT OUT THERE. THANKS. THANK YOU. SO I WANTED TO REFRAME THAT CONVERSATION ABOUT THE WATERSHED AND HOW WE LOOK AT THE WATERSHED, NOT JUST SOME THING THAT'S ABSTRACT, IT'S A REAL LIVING THING AND THAT WE NEED TO TALK ABOUT WATER AND THE WATERSHED. MOST PEOPLE THAT TURN HAVING WATER PINS OUT, WE CAN DRINK IT AND WATER ALONG THAT THE FAR CONVERSATION GOES. BUT WE KNOW THE WATERSHED AND THE LIVING BEING AND SOME AND THE BEGUN TO GET PEOPLE HERE AT CITY HALL TO THINK ABOUT WATER FROM THE POINT OF VIEW OF THE WATERSHED BEING CONSTITUENT TO BE TAKEN INTO CONSIDERATION FOR EVERY LANDING CASE THAT COMES FORWARD.
