FOUR OUT OF THE FIVE TOTAL PANEL MEMBERS IS PRESENT AND THEREFORE WE CAN PROCEED WITH THE MEETING.
PANEL MEMBERS PRESENT TODAY ARE ME, PARKER GRAHAM, SARAH LAMB, MICHAEL QUINT, AND STUART CAMPBELL.
STAFF PRESENT INCLUDE THERESA CARLISLE, WHO'S OUR BOARD ATTORNEY AND ASSISTANT CITY ATTORNEY, DR.
KAMIKA MILLER HOSKINS, WHO'S THE BOARD ADMINISTRATOR AND CHIEF PLANNER, MARY WILLIAMS, WHO'S THE BOARD SECRETARY AND MEETING MODERATOR.
BEFORE WE BEGIN, I'D LIKE TO MAKE A FEW GENERAL COMMENTS ABOUT THE BOARD OF ADJUSTMENT AND THE WAY THIS HEARING WILL BE CONDUCTED.
MEMBERS OF THE BOARD ARE APPOINTED BY THE CITY COUNCIL.
WE GIVE OUR TIME FREELY AND RECEIVE NO FINANCIAL COMPENSATION FOR THAT TIME.
WE OPERATE UNDER CITY COUNCIL APPROVED RULES OF PROCEDURE, WHICH ARE POSTED ON OUR WEBSITE CONSISTENT WITH THE DALLAS DEVELOPMENT CODE.
NO ACTION OR DECISION ON A CASE SETS A PRECEDENT.
EACH CASE IS DECIDED UPON ITS OWN MERITS AND CIRCUMSTANCES.
THE APPLICANT HAS THE BURDEN OF PROOF TO ESTABLISH THE NECESSARY FACTS TO WARRANT FAVORABLE ACTION FROM THE BOARD.

SO THAT'S WHAT'S REQUIRING THIS BECAUSE AS YOU KNOW, WHEN YOU GET FENCE PLANS APPROVED, YOU'RE TIED TO THE SITE PLAN AND YOU'RE TIED TO THE ELEVATIONS.
AND, UH, IF WE BUILT OUTSIDE OF THOSE, WE COULDN'T GET OUR FENCE APPROVED, UH, IN THE FIELD.
SO THE CHANGE OF, UH, CIRCUMSTANCE ON THE PROPERTY IS THE PROPERTY CHANGED HANDS.
IT WAS A SPEC HOME, IT'S OWNED BY THE OWNER.

WALL GOES UP, ASKED WHAT WE NEEDED TO DO.
THEY SAID, JUST MAKE SURE YOU HAVE OPENINGS AND THAT YOU HAVE, UM, A PATH IN CASE OF AN EMERGENCY.
WE RECEIVED A, UH, COMPLAINT, UH, DECEMBER AND THE MINUTE WE RECEIVED IT, I REACHED OUT TO THE INSPECTOR AND ASKED HER WHAT NEEDED TO TRANSPIRE SINCE WE HAD NOT BEEN TOLD ANYTHING.
UM, AS YOU SEE UP HERE ON THE POWERPOINT, UM, WE DID A CINDER BLOCK WITH HOLD IN IT, UH, MADE SURE THAT WE WERE NOT IN THE RIGHT OF WAY OF EASEMENT.
WE DID IT FOR PRIVACY, SECURITY, SO ON AND SO FORTH.
SO THAT'S WHAT IT LOOKS LIKE RIGHT NOW.
THE MINUTE WE FOUND OUT, OBVIOUSLY EVERYTHING STOPPED.

THE MINUTE THAT HAPPENED, I CALLED BACK AND SPOKE TO THE INSPECTOR, SAID, WHAT DO I DO? DO YOU NEED DRAWINGS? YOU NEED ALL THESE THINGS.
HIRED THE PERSON TO DO SO, STARTED SUBMITTING IT TO UM, THE PLANNING COMMITTEE AND THERE WERE SOME THINGS THAT WERE DONE INCORRECTLY BY THE PERSON WHO DREW THEM.
THEY WENT BACK, SHE CAME IN AND UH, SPOKE TO SOMEONE TO FIND OUT WHAT WAS RIGHT.
WHEN THAT STARTED HAPPENING, THEN IT WAS DENIED.
I SAID, I'M JUST GONNA TRY TO TAKE OVER AND FIGURE THIS OUT MYSELF.
SO I CAME DOWN AND SPOKE TO THE PLANNING DEPARTMENT.
THEY TOLD ME WHAT NEEDED TO BE DONE, I SUBMITTED IT, THEN RECEIVED A REFERRAL FROM THE DEPARTMENT AND UH, STARTED THE PROCESS.
SO THEN I HAD SOMEBODY HELP ME CREATE THIS RENDERING THAT WAS SUBMITTED TO SHOW WHAT IT WOULD LOOK LIKE WITH THE ELEVATIONS.
THEN ALSO THERE WAS SENT TO FENCE ELEVATION, WHICH IS

AND AS A REMINDER OF THE STANDARD IS WHETHER OUR EVALUATION OF THE PROPERTY AND THE TESTIMONY SHOWS THAT THIS SPECIAL EXCEPTION WILL NOT ADVERSELY AFFECT CORRECT.
