IF THIS BOARD FINDS THE FOLLOWING, NUMBER ONE, THE LOCATION OF THE PROPOSED DANCE HALL WILL NOT HAVE A DETRIMENTAL EFFECT ON NEARBY PROPERTY OR BE CONTRARY TO THE PUBLIC SAFETY OR WELFARE.

TWO, THE LOCATION OF THE PROPOSED DANCE HALL WILL NOT DOWNGRADE THE PROPERTY VALUE OR QUALITY OF LIFE IN ANY ADJACENT AREA, OR ENCOURAGE THE DEVELOPMENT OR OF URBAN BLIGHT.

THE LOCATION OF THE PROPOSED DANCE HALL OPERATING UNDER A LATE HOURS PERMIT IN THE AREA WILL NOT BE CONTRARY TO ANY PROGRAM OF NEIGHBORHOOD CONSERVATION OR INTERFERE WITH ANY EFFORTS OF URBAN RENEWAL OR RESTORATION.

AND FOR ALL OTHER APPLICABLE PROVISIONS OF CHAPTER 14 WILL BE OBSERVED.

IN ADDITION, THE BOARD MAY GRANT AN EXEMPTION FOR A TWO YEAR PERIOD.

IF THE BOARD FINDS THAT ONE, THE DANCEHALL HAS BEEN GRANTED AN EXEMPTION FROM THE LOCATIONAL RESTRICTIONS OF SECTION 14 DASH 3.1 FOR THREE CONSECUTIVE YEARS PROCEEDING THE CURRENT EXEMPTION REQUEST.

TWO, THE APPLICANT HAS NOT HAD ANY DANCEHALL LICENSE SUSPENDED, REVOKED, OR DENIED WITHIN THE 24 MONTH, WITHIN THE 24 MONTHS PROCEEDING, THE EXEMPTION REQUEST.

AND THREE, NO VIOLATIONS OF CHAPTER 14 HAVE BEEN COMMITTED BY THE APPLICANT OR BY ANY EMPLOYEE OF A DANCEHALL OF THE APPLICANT WITHIN THE 24 MONTHS PROCEEDING THE EXEMPTION REQUESTS.

NOW, IF THE BOARD FINDS IN THE CONTRARY TO ANY ONE OF THE PREVIOUS STATEMENTS, THEN THIS BOARD MAY AFFIRM THE DECISION OF THE CHIEF OF POLICE.

SO THE ONLY THING BEFORE US IS THE LATE HOURS PERMIT, WHICH THE CHIEF DENIED, UH, BECAUSE THE PREMISE SITS WITHIN A THOUSAND FEET, UH, OF A LOT DEVOTED TO RESIDENTIAL USE.

UH, ON THAT POINT, THE CHIEF HAD NO DISCRETION.

SO WE'RE NOT, WE'RE NOT HERE TO, TO REVIEW WHETHER THE CHIEF WAS RIGHT OR WRONG.
