WE'LL JUST ASK, I KNOW WE'VE GOT OUR, UH, WE DIDN'T GET ENOUGH OF YOU AT FORWARD DALLAS THE OTHER DAY, SO WE GLAD TO SEE, UM, DIRECTOR GILLIS UP HERE AGAIN.
WOULD YOU, UH, LIKE TO GET US START ON WHERE YOU'RE AT WITH THE, UM, JUST A LITTLE BRIEF HISTORY AND WHERE YOU'RE AT NOW WITH THE LAND USE NEW CATEGORY FOR, UM, THESE OPERATORS? SURE.

UM, WELL THIS ITEM IS ACTUALLY GOING FORWARD TO CITY PLAN COMMISSION ON THURSDAY.
UM, SO IT'LL BE THOROUGHLY DISCUSSED AT CITY PLAN COMMISSION.
UM, THERE IS A PROPOSAL ABOUT CREATING A NEW USE PRIVATE GAME CLUBS, UM, AND WHERE, AND THE DISCUSSION WILL BE ABOUT WHERE THAT USE WILL BE ALLOWED.
THE RECOMMENDATION IS TO HAVE IT ALLOWED BY SUP, OBVIOUSLY IT NEEDS TO FOLLOW ALL STATE LAW REQUIREMENTS, UM, AND THAT IT BE ACCESSORY TO ANY MAIN USE.
AND THEN THERE'S A LISTING OF ZONING CATEGORIES IN WHICH IT POTENTIALLY COULD BE LOCATED.
SO THAT'S WHAT CCP C'S GOING TO BE CONTEMPLATING ON THURSDAY.
IT DID ALREADY GO TO ZONING ORDINANCE ADVISORY COMMITTEE A COUPLE MONTHS AGO, BUT THEY HAD A MULTITUDE OF DIFFERENT QUESTIONS THAT THEY THOUGHT REALLY NEEDED TO BE ADDRESSED AT CPC, SO THEY MOVED IT ON WITHOUT A RECOMMENDATION TO CPC.
AND I WAS GONNA, BEFORE WE OPENED IT UP FOR QUESTIONS FOR YOU, I WAS JUST GONNA ASK IF THE CITY ATTORNEY HAD ANY GUIDANCE ON, YOU KNOW, WHAT WE CAN AND CAN'T SAY.
I KNOW THAT I WAS CAUTIONED BY THE, UH, CITY ATTORNEY.
JUST BE VERY CAREFUL THAT WE DON'T TRY TO INFLUENCE THE CITY PLAN COMMISSION SINCE THE VOTE IS COMING UP SO QUICKLY.
UM, AND WE DON'T WANNA FALL INTO ANY, UM, 12 A ISSUES.
HI, I WOULD SAY AN ABUNDANCE OF CAUTION.
I WOULD PROBABLY NOT ASK VERY MANY QUESTIONS TODAY OTHER THAN, UH, THE STATEMENT SHE MADE ABOUT WHAT THEY'RE GONNA BE DISCUSSING SO THAT WE DON'T LOOK LIKE WE'RE INFLUENCING THE PROCESS.
IT'S ALSO OUR TEXAS LOCAL GOVERNMENT CODE REQUIRES THAT THE CITY CLIENT COMMISSION PROVIDE AN INDEPENDENT, UM, THEY HAVE PUBLIC HEARINGS AND PROVIDE RECOMMENDATIONS TO COUNCIL INDEPENDENTLY.
UM, JUST I GUESS PROCEDURALLY, I'LL, I'LL KICK IT OFF AND I'LL PUNT IT OVER TO MY COLLEAGUES.
UM, IS THERE, I THINK THIS WAS LAST FEBRUARY THAT WE ASKED THE PLAN COMMISSION TO BEGIN REVIEWING THIS LAND USE CATEGORY, WHAT TOOK SO LONG TO GET IT TO WHERE IT IS TODAY? SO I THINK LARGELY WE HAD A PRETTY SIGNIFICANT NUMBER OF CASES THAT NEEDED TO MOVE FORWARD THROUGH THE CCPC, THROUGH ZO OAC AND THE CPC PROCESS.
IN THE INTERIM OF THAT, UM, WE'VE HAD SOME VERY, VERY, I THINK PART OF THE CONCERN IS GETTING ITEMS SCHEDULED ON CPC BECAUSE OF THE MASSIVE CASES THAT ARE GOING THROUGH CPC AT THIS TIME.
SO IT REALLY WAS JUST A WAY OF MANAGING BETWEEN HAVING THE STAFF AVAILABLE TO DO IT, BEING ABLE TO FIND SOME SPACE ON THE CPC AGENDA GIVEN THE AMOUNT OF CASES THAT THEY'RE GOING THROUGH.
AND I CAN SAY PERSONALLY, AS YOU MENTIONED PREVIOUSLY, FORWARD DALLAS
DO YOU ANTICIPATE A BRIEFING AND A DISCUSSION? IS IT JUST A BRIEFING? HOW IS IT? IT'S BRIEFING A PUBLIC HEARING BRIEFING AND A PUBLIC HEARING.
SO IT IS POSSIBLE THERE COULD BE A VOTE ON THURSDAY? IT'S POSSIBLE, YES.
UM, I DO HAVE SOME QUESTIONS FOR THE CITY ATTORNEY, BUT I WANTED TO JUST SEE IF MY COLLEAGUES, UH, HAVE ANY QUESTIONS FOR PUD.

UH, I THINK THERE WERE THREE OF THEM AND THEN THOSE WERE APPEALED TO THE BOARD OF ADJUSTMENT.
UM, AND THEN THE, UM, APPLICANT'S APPEALED TO DISTRICT COURT AND THEN THERE WERE TWO OTHER CASES, I BELIEVE THERE WERE TWO, UM, WHERE THE BUILDING OFFICIAL REVOKED

AND THOSE WERE APPEALED TO, UM, THE DISTRICT COURT.THE, UM, JUDGES ALL DECIDED THAT THEY WOULD HAVE ONE CASE GO FORWARD, ONE WENT FORWARD.
UM, THE TRIAL COURT FOUND THAT THE, UM, UM, THE BOARD OF ADJUSTMENT, UM, SHOULD HAVE REVOKED THE COS BECAUSE THE LAND USE, THEY WERE ILLEGAL USES.
AND SO NOW THAT'S UP ON APPEAL.
DO WE KNOW A TIMELINE FOR THE APPEAL? UM, THE, WELL WE KNOW THAT THE, UM, ORAL ARGUMENTS WERE DECEMBER 13TH AND WE HAVE NOT HAD A RULING OUT OF THE COURT YET.
SO THEY'RE, AND THEY'VE, AND THERE'S NO NEW DATE FOR ORAL ARGUMENTS? NO, THEY'VE ALREADY DONE THE ORAL ARGUMENTS AND THE COURT HAS TAKEN IT UNDER ADVISEMENT.
SO THE COURT, WE'RE JUST WAITING ON JUDGMENT FROM THE COURT.
SO THERE'S NO OTHER WORK THAT NEEDS TO BE DONE? NO, EVERYTHING ELSE HAS STAYED PENDING THE OUTCOME OF THE FIFTH COURT OF APPEALS DECISION.
DO WE HAVE ANY INDICATION FROM THE, UM, CFO OR FROM OUR BUDGET OFFICE ON THE POTENTIAL REVENUE FROM SALES TAX THAT WE'VE FORGONE BY NOT ISSUING NEW COS? WELL, I WOULD SAY THAT, UM, ANYBODY CAN APPLY FOR A CO AND IF THERE'S NO LAND USE THAT IS PARTICULAR TO THAT, UM, LAND USE STATEMENT, THAT THE BUILDING OFFICIALS STILL, UM, LOOKS AT WHAT IS CLOSEST AND THEY WOULD ISSUE THAT.
AND SO THERE'S NO, NO ONE IS STOPPING PEOPLE FROM APPLYING FOR COS IT JUST HAS TO COMPLY WITH THE LOCAL LAWS IN THE STATE LAW.
BUT IF IT'S, IF IT'S NOT WITHIN THEIR BUSINESS MODEL, THEY'RE PROBABLY NOT GONNA APPLY FOR A CO.
SO BACK TO MY QUESTION, UH, JEANETTE WHEATEN, DIRECTOR OF BUDGET AND MANAGEMENT SERVICES? NO, SIR.
WE DO NOT HAVE AN ESTIMATE OF, UH, PROJECTED REVENUE FOREGONE, BUT THAT'S SOMETHING THAT WE CAN TAKE A LOOK AT.
DO YOU, UH, DO WE HAVE, WE HAVE PRIOR YEARS, UM, SALES, MAYBE NOT RIGHT NOW, BUT UH, ON FILE FOR WHAT OUR SALES TAX REVENUE HAS BEEN FROM THIS INDUSTRY, RIGHT? CORRECT.
UM, IF ANOTHER QUESTION FOR EITHER CITY SECRETARY OR FOR, UH, MS. PALOMINO IS IF THE, IF COUNCIL DECIDED THAT THEY WANTED TO TAKE AN ACTION, A VOTE, UM, AT A FUTURE DATE FOR, TO GO BACK TO THE WAY IT WAS ESSENTIALLY TO BASICALLY BEGIN REISSUE THE COS THAT WERE, THAT WERE ORIGINALLY ISSUED, UM, AND THE ONES THAT WERE PENDING THAT, YOU KNOW, THESE OPERATORS HAD FILED THEIR APPLICATIONS INVESTED IN OUR CITY, PUT MILLIONS OF DOLLARS INTO THE FACILITIES, UM, IF WE WANTED TO PROCEED WITH AN ACTION TO GO BACK TO THE WAY IT WAS, WHAT WOULD WE NEED TO DO PREFER TO ANSWER THAT IN, UM, EXECUTIVE SESSION? SO I'M NOT, UH, BUT YOU'RE TALKING ABOUT STR STRATEGY AND OTHER THINGS THAT I NEED TO MAKE SURE ARE CONFIDENTIAL WITH, UM, MY CLIENT'S COUNSEL.
AND I CAN SAVE THAT QUESTION, AND SO WE DON'T HAVE TO STOP THE MEETING AND, AND SEE IF THERE'S ANY OTHER EXECUTIVE SESSION RELATED QUESTIONS.

UH, IT'S THE FIRST TIME I'D SEEN THAT CONSOLIDATED LIST AND I, YOU KNOW, IT JUST RAISED SOME QUESTIONS FOR ME AND I THINK FOR SOME OTHER FOLKS, UM, WHICH IS WHY, YOU KNOW, WITH OUR BUDGET COMING UP AND WE'RE SEEING BUDGET CUTS ACROSS THE CITY, UM, THIS WAS AN ITEM AT LEAST I FELT WAS IMPORTANT FOR US TO ADDRESS BEFORE WE RECEIVED THE CITY'S BUDGET ON FRIDAY.

WHAT I TRIED TO DO ON SLIDE THREE WAS ENCAPSULATE THE MEMORANDUM THAT CHAIR WEST MENTIONED THAT BASICALLY HAD A LAUNDRY LIST OF ALL OUR 44 LEASES, UH, SPELLED OUT THERE, UH, IN THE TABLE THAT TALKED ABOUT THE SQUARE FOOTAGE TO USE, UH, THE TERM, UH, OF THE LEASE AND THE COST ASSOCIATED, WHICH EACH INDIVIDUAL ACQUISITION LEASE THAT THE CITY'S PROCESSED AND IS IN THE, IN THE, UH, POSITION OF USING THOSE PARTICULAR PIECES OF PROPERTY.
ON SLIDE THREE WORKING THROUGH THE TABLE, JUST THE BREAKDOWN OF THOSE ACQUISITION LEASES, A TOTAL OF 44 LEASES, NINE OF WHICH ACTUALLY DON'T COME WITH A BASE RENTAL COST, RIGHT? THEY, THEY START WITH THE ZERO COST.
THERE COULD BE SOME ANCILLARY COSTS LIKE MAYBE THE, THE COST OF A UTILITY, BUT FOR THE MOST PART, THE BASE RENTAL IS AT ZERO.
WE HAVE 14 OTHER LEASES THAT ARE TIED TO OUR WIC CLINICS THAT PROVIDE SERVICES TO THE COMMUNITY, AND THOSE ARE REIMBURSED BY THE STATE OF TEXAS.
SO THERE'S NO DIRECT COST IMPACT, UH, RELATED TO THOSE INDIVIDUAL LEASES.
SO THAT LEAVES US WITH 21 LEASES THAT HAVE A ACTUAL BASE RENTAL THAT KIND OF START THE FRAMEWORK OF OUR CONVERSATION TODAY ABOUT WHAT ACTUAL COST AND TIED THAT WE HAVE TIED TO THE USES.
SO THE NEXT SECTION HERE ON SLIDE THREE TALKS ABOUT RIGHT AT $5.4 MILLION IS THE TOTAL, UH, ACQUISITION LEASE COST.
IN SUMMARY, WHEN YOU BACK OUT THE COST THAT WE'RE REIMBURSED FROM THE WIC CLINICS THAT I MENTIONED EARLIER, THAT THE STATE FUNDS WERE RIGHT AT $3.9 MILLION.
OKAY? AND THEN THE BOTTOM SECTION OF THE SAME CHART ON SLIDE THREE, WHAT I DID WAS TRY TO GIVE YOU THE BIG ROCKS, THE, THE, THE PIECES OF PROPERTY, THE LOCATIONS, AND THE USES THAT, THAT REALLY CONSIST THAT $3.9 MILLION AND THEN A REFLECTION OF VERY LIKELY WHAT HAPPENS WITH THOSE INDIVIDUAL LOCATIONS WITH THE FUTURE ACTION.
SO IF YOU'LL FOLLOW WITH ME, THE DALLAS POLICE ACADEMY BEING THE, THE CHIEF COST IN THAT $3.9 MILLION IS RIGHT AT $1.1 MILLION.
NOW, WE, WE ALL KNOW THAT THE 2024 BOND PROGRAM, UH, HAS SOME, SOME, UH, FUNDING, UH, THAT'S BEEN SET ASIDE FOR THE ACTUAL CONSTRUCTION AND DEVELOPMENT OF A SITE FOR THE POLICE DEPARTMENT TO HAVE AN ACADEMY.
SO AT SOME POINT IN THE NEAR FUTURE, ONCE THAT, UH, GROUNDBREAKING AND, AND ONCE ALL THOSE, UH, CONSTRUCTION DOCUMENTS AND EVERYTHING THAT'S REQUIRED TO ACTUALLY BUILD, UH, THAT NEW ACADEMY, THAT COST ROLLS OFF THE BOOKS.
THE NEXT ITEM IS A DALLAS WATER UTILITY IN ENGINEERING AND EMERGENCY RESPONSE RIGHT AT $800,000 THERE.
AND THEY ACTUALLY HAVE SOME PLANS IN THE FUTURE TO ACTUALLY RELOCATE THE EMERGENCY RESPONSE PORTION.
SO THAT ITSELF WILL GO DOWN BY ANOTHER $139,000 ANNUALLY OVER THE NEXT COUPLE OF YEARS AS THEY'RE ABLE TO PHASE THAT GROUP INTO OTHER PROPERTY THAT WE OWN.
THEN YOU GOT THE BUILDING INSPECTION OFFICES RIGHT AT A LITTLE OVER 400,000, RIGHT? THOSE BY DESIGN WERE INTENDED TO FOLD INTO THE 7,800 SIMMONS BUILDING AS WE STILL CONTINUE TO REIMAGINE HOW WE'RE GONNA WORK THROUGH GETTING THAT BUILDING OPEN.
BUT IT WAS ENVISIONED THAT THOSE DISTRICT OFFICES, FOUR OF THEM, I BELIEVE, FOUR TO FIVE OF THEM INDEPENDENTLY SCATTERED THROUGHOUT THE CITY, WOULD THEN ALL COMBINE AND THEN RESIDE THERE AT 7,800 SIMMONS.
AND THEN YOU GOT THE JACK EVANS POLICE HEADQUARTERS GARAGE.
NOW, I WILL MAKE A NOTE THAT ON THE ORIGINAL LISTING, THE MEMORANDUM, THE DOLLAR AMOUNT THAT WAS LISTED, I BELIEVE WAS $350,000.
THAT WAS AT THE OUTSET OF THE LEASE MANY YEARS AGO.
IN THIS TABLE THAT I'M SHOWING YOU ON SLIDE THREE, THAT NUMBER'S BEEN UPDATED TO SHOW APPROXIMATELY A MILLION DOLLARS ANNUALLY.
BUT THAT BUILDING AND THE GARAGE ASSOCIATED WITH THAT, UH, IS GONNA BE PROCESSED AS A NEW BUILDING WITH, FOR THE CITY.
AND ONCE THAT BUILDING IS ACQUIRED, UH, BY THE CITY, BASED ON THE LEASE AGREEMENT THAT WE HAVE FOR THE GARAGE, THAT EXPENSE WILL ALSO GO AWAY.
THEN WE HAVE THE EMERGENCY RADIO SYSTEM TOWERS, OBVIOUSLY, UH, FOR THE PUBLIC SAFETY RADIO SYSTEM, UH, TO ADEQUATELY FUNCTION.
UH, THERE ARE PLACES ACROSS THE CITY, UH, FOR PROXIMITY AND LOGISTICS THAT WE HAVE TOWERS SCATTERED THROUGHOUT THE CITY FOR THE RADIO SYSTEM TO BE ABLE TO COMMUNICATE AND NOT LEAVE ANY SPOTS THAT DEAD SPOTS IN THE INSIDE THE CITY FOR RADIO COMMUNICATIONS.
SO WE PAY THOSE, THOSE COSTS ANNUALLY AS WELL.
AND THEN ANOTHER BIG ROCK THAT WAS LISTED THERE IS THE CITY SURPLUS STORE, WHICH IS WHERE WE TAKE OR, OR ACTUALLY STAFF ANY SURPLUS ITEMS, UH, ITEMS THAT HAVE BEEN DETERMINED THAT ARE NO LONGER NEEDED, OLD FIXED ASSETS THAT ARE PAST THEIR USEFUL LIFE.
THEY'RE, UH, SENT TO THE, UH, CITY
