I HAVE THE HONOR OF SERVING AS CHAIRMAN OF THE COMMUNITY POLICE OVERSIGHT BOARD.

UH, WE HAVE BEEN SELECTED BY CITY COUNCIL MEMBERS, AS WELL AS THE MAYOR OF, OF, UH, THE CITY OF DALLAS, STATE OF TEXAS.

WE REPRESENT THE PEOPLE.

UH, THE MISSION OF THE COMMUNITY POLICE OVERSIGHT BOARD IS TO ENHANCE PUBLIC TRUST BY ENSURING THAT COMPLAINTS OF MISCONDUCT AGAINST DEPARTMENTAL EMPLOYEES ARE INVESTIGATED WITH FAIRNESS, IMPARTIALITY, THOROUGHNESS, AND TRANSPARENCY.

AND WE ARE COMMITTED TO PROVIDING THE RESIDENTS OF THE CITY OF DALLAS WITH AN ACCESSIBLE AND OPEN PROCESS FOR ADDRESSING THEIR CONCERNS.

I AM HERE TO ADDRESS ORDINANCES OR LAWS THAT DALLAS POLICE DEPARTMENT HAVE BUT CANNOT CARRY OUT.

ONE IS BLASTING LOUD MUSIC BEING PLAYED BY SOME HOMEOWNERS, AS IF THEY ARE THE ONLY ONES LIVING IN THE NEIGHBORHOOD, SOMETIMES UNTIL 4:00 AM IF THEY'RE HAVING A HOUSE PARTY, A CALL TO NINE ONE ONE ON RESULTS IN THE OFFICE, AND NOT SHOWING UP, OR SIMPLY DRIVING BY THE RESIDENCE HOURS AFTER THE INCIDENT, RESULTING IN THE COMPLIANT RESIDENCE SUFFERING, AND THE NONCOMPLIANT RESIDENTS GETTING AWAY WITH BREAKING THE LAW WITHOUT ANY CONSEQUENCES.

SECONDLY, NEW YEAR'S DAY 2024, A CONTINUOUS GUNFIRE IN MY NEIGHBORHOOD, WHICH STARTED EARLY AFTER NIGHTFALL.

THIS YEAR, I CALLED 9 1 1 AND REQUESTED FOR THE POLICE TO DRIVE DOWN OUR STREET TO MAKE OUR, THEIR PRESENCE KNOWN.

SINCE I DIDN'T KNOW WHO WAS SHOOTING, I DIDN'T THINK ANYONE CAME BECAUSE THE SHOOTING CONTINUED.

THEN NEW YEAR'S DAY, MORNING SHOOTING WAS HEARD AGAIN, CALLED 9 1 1, MADE THE SAME REQUEST.

SHORTLY AFTER 9:00 AM I WITNESSED THE HOMEOWNER ACROSS THE STREET, TAKE HIS, UH, AUTOMATIC RIFLE AND SHOOT MULTIPLE SHOTS SEVERAL TIMES WHILE STANDING ON HIS FRONT PORCH, ALONG WITH HIS UNDERAGE SON AND GUEST SHOOTING THE GUN.

LEFT MY HOUSE, WENT TO SOUTHWEST POLICE PRECINCT TO ADDRESS THE HOMEOWNER'S SHOOTING, BUT GOT NOWHERE.

DURING THE CONVERSATION.

THE SERGEANT AT THE DESK QUESTIONED TO ME WAS, WHAT DO I WANT HER TO DO? ACCORDING TO THE SERGEANT, THERE WAS, THEY WERE SHORT STAFFED, AND THAT WAS AT ALL PRECINCTS.

I LEFT FEELING THAT MY EXPECTATIONS FOR DALLAS POLICE DEPARTMENT ARE TOO HIGH, AND DPD WILL ONLY COME TO MY NEIGHBORHOOD TO ADDRESS FATALITIES OR ALMOST FATALITIES.

1254 SAW AN OFFICER DRIVE BY, AND AT THAT TIME, THE STREETS WERE QUIET.

LATER ON, I VIEWED THE SOUTHWEST PATROL DIVISION COMMANDER, WELCOME PAGE, DEPUTY CHIEF MA, JUSTICE ALLEN, AND OBSERVED CATCHPHRASES LIKE OFFICERS ARE COMMITTED TO PROVIDING BEST POSSIBLE POLICE SERVICE MISSION TO PROTECT AND SERVE OUR COMMUNITY.

COLLABORATION PLAYS A CRITICAL ROLE IN MAKING SOUTHWEST AREA OF DALLAS SAFER FOR A PLACE TO LIVE, INTENTIONAL ABOUT LIST LISTENING, AND EVERYONE IN OUR COMMUNITY, UH, DEDICATED TO HOLDING EVERYONE ACCOUNTABLE, WANT TO WORK WITH EVERYONE TO IMPROVE THE HIGH QUALITY OF LIFE THAT MAKES SOUTHWEST A UNIQUE AREA TO LIVE, VISIT, AND WORK.

TO ME, THESE ARE EMPTY WORDS BECAUSE I FEEL LIKE DPD HAS FAILED ME AS A CITIZEN TRYING TO GET HELP.

AND, UM, I AM SO GLAD TO SEE, AND MAJOR GREER HAS TOLD US THAT HE'S COMMITTED TO BEING AT EACH AND EVERY ONE OF OUR MEETINGS, WHICH I THINK IS EXTREMELY IMPORTANT TO ME AS A BOARD MEMBER TO GET THAT.

MY MAIN, UH, UH, CHIEF GARCIA CAME TO US FROM SAN JOSE, WHERE HE SAID HE HAD POLICE OVERSIGHT AND, AND, AND ISSUES WHERE HE WOULD MEET WITH THE BOARD.

AND MY IMPRESSION WAS THAT HE WAS SUPPORTIVE OF WHAT WE ARE DOING.

BUT THE ISSUE THAT I AND SOME OF THE OTHER BOARD MEMBERS HAVE FOUND IS HOW DO WE WORK WITH THE POLICE? BECAUSE I PERSONALLY THINK IT'S IMPORTANT THAT THE RANK AND FILE HAVE BUY-IN TO WHAT WE ARE DOING.

UM, I DON'T THINK IT'S GOOD ENOUGH TO HAVE BUY-IN FROM YOU AND NOT YOUR OFFICERS.

SO WHAT, AND THIS MAY NOT BE A FAIR QUESTION, AND I'LL LET YOU COME BACK AT ANOTHER TIME AND ANSWER IT.

UH, BUT WHAT DO YOU THINK NEEDS TO BE DONE TO GET US TO BE IN A SITUATION WHERE YOUR POLICE OFFICERS, UH, UNDERSTAND, APPRECIATE WHAT WE'RE DOING, WILL COOPERATE WITH US IN THE FIVE YEARS OR FOUR AND A HALF YEARS THAT THIS BOARD HAS BEEN IN EXISTENCE? WE'VE HAD ONE POLICE OFFICER VOLUNTARILY SPEAK TO US IN TERMS OF AN INVESTIGATION.

IF IT'S SOMETHING ELSE, THEN I JUST WANT AN EXPLANATION AS TO HOW WE'RE GOING TO ADDRESS IT BECAUSE OF DISPARITY.

AND THOSE NUMBERS ARE DISTURBING TO ME.

UM, I ALSO, UM, UH, WORK WITH, UH, DALLAS PD ON THEIR FORCE ANALYSIS SYSTEM THAT WE BUILT FOR THEM.

AND WHAT I'M GONNA DO TODAY IS, UH, I ALSO RECEIVED SOME QUESTIONS, UM, THAT WERE SENT TO ME FROM THE BOARD THAT I HOPE TO ADDRESS DURING MY PRESENTATION.

UH, MY GOAL IS I'M, I'M HERE FOR YOU.

SO, UH, I HAVE A LOT OF INFORMATION AND A LOT OF DATA TO PRESENT.

UM, SO WITH THAT, I WILL, UH, INTRODUCE MYSELF.

UM, SO I'M THE, THE CEO OF POLICE STRATEGIES, LLC.

AND WHAT WE DO IS WE HELP LAW ENFORCEMENT AGENCIES COLLECT, ANALYZE,

AND REPORT ON MOSTLY THEIR USE OF FORCE DATA, BUT WE DO A LOT OF RACIAL DISPARITY ANALYSIS, UH, FOR STOPS AND ARRESTS AND SEARCHES AND USES OF FORCE AS WELL FOR DIFFERENT DEPARTMENTS.

UM, MY BACKGROUND, I WAS A DEPUTY PROSECUTOR IN KING COUNTY, WASHINGTON IN THE 1990S.

I ALSO WORKED FOR THE US ATTORNEY'S OFFICE, UH, FOR 14 YEARS.

I WORKED FOR THE CITY OF SEATTLE.

I WAS FIRST A PUBLIC SAFETY POLICY ADVISOR TO THE SEATTLE MAYOR.

I ALSO WORKED IN THE CITY ATTORNEY'S OFFICE, AND I REPRESENTED THE CITY, UH, OF SEATTLE DURING THE DEPARTMENT OF JUSTICE PATTERN OF PRACTICE INVESTIGATION IN 2011.

THAT LED TO A CONSENT DECREE THAT THE DEPARTMENT IS STILL UNDER.

AND, UM, I WAS APPOINTED TO BE THE COMPLIANCE COORDINATOR TO OVERSEE THE REFORMS IN THE DEPARTMENT FOR THE FIRST TWO YEARS OF THE CONSENT DECREE.

UH, UH, FOR THE LAST DECADE I'VE BEEN WORKING, UH, UH, WITH POLICE STRATEGIES, LLC TO HELP LAW ENFORCEMENT AGENCIES BETTER UNDERSTAND THEIR DATA.

UM, I WANTED TO TALK JUST A LITTLE BIT ABOUT SOME OF THE DATA AND RESOURCES THAT ARE AVAILABLE TO YOU AND THE CITY OF DALLAS.

UM, SOME OF WHICH WE CREATED.

UM, SO OUR FORCE ANALYSIS SYSTEM, UM, WELL, FIRST OF ALL, ONE OF THE BIGGEST PROBLEMS WE HAVE LOOKING AT, UH, LAW ENFORCEMENT DATA IS, IS THE LACK OF DATA.

UM, BECAUSE ALL, FOR ALL THE IT SYSTEMS THAT POLICE DEPARTMENTS HAVE, THEY ARE NOT DESIGNED FOR STATISTICAL ANALYSIS, RIGHT? THEY'RE DESIGNED TO TRACK OFFENDERS THROUGH THE SYSTEM AND CALLS FOR SERVICE AND SO FORTH.

SO IT'S A BIG CHALLENGE TO GET USEFUL DATA FROM LAW ENFORCEMENT AGENCIES.

SO WITH OUR FORCE ANALYSIS SYSTEM, WE ACTUALLY HAVE TO GO TO THE INCIDENT REPORTS THEMSELVES AND EXTRACT THE DATA, UH, MANUALLY.

UM, SO WITH DALLAS PD, WE REVIEW, UM, THOUSANDS OF INCIDENT REPORTS, UM, EACH YEAR WE ALSO LOOK AT I PRO DATA THAT I KNOW YOUR OFFICE HAS ACCESS TO, AND WE EXTRACT THE DATA, WE EXTRACT UP TO 150 DIFFERENT DATA FIELDS FROM EACH INCIDENT.

AND THEN WE CREATE A SERIES OF DASHBOARDS, UM, FOR, UM, PUT THAT UP THERE, UH, FOR BOTH INTERNALLY FOR THE DEPARTMENT, AS WELL AS PUBLIC DASHBOARDS.

UM, AND WITH THESE DASHBOARDS, YOU CAN ANSWER VIRTUALLY ANY QUESTION THAT YOU MIGHT HAVE ABOUT, UH, HOW AND WHY DALLAS PD OFFICERS USE FORCE.

AND WE HAVE DATA GOING BACK TO 2021, AND THE DASHBOARDS ARE UPDATED QUARTERLY, AND THE DEPARTMENT HAS A WEBSITE.

UM, UH, THE, THE LINK IS, IS IN THIS SLIDE.

AND THEN THERE ARE A SERIES OF THREE DASHBOARDS WHERE YOU CAN LOOK AT THE DEMOGRAPHICS, UM, YOU CAN LOOK AT THE TYPES OF FORCE INCIDENTS THAT ARE USED, UH, IN THE LOCATION AND TIME, ET CETERA.

SO THERE'S A WEALTH OF INFORMATION, UM, WE CAN, WE CAN LOOK AT AT THOSE DASHBOARDS IN REAL TIME, IF YOU LIKE, AT THE END OF THE PRESENTATION.

UM, JUST A LITTLE BIT MORE ABOUT THE, THE, UM, THE DATA COLLECTION MODEL.

A LOT OF TIMES WHEN PEOPLE LOOK AT USE OF FORCE OR STOPS OR ARRESTS, THEY'RE SIMPLY COUNTING THINGS.

THEY'RE COUNTING THE NUMBER OF TIMES THAT IT HAPPENS.

SO COUNTING THE NUMBER OF TIMES THAT FORCE HAPPENS, OR COUNTING THE NUMBER OF TIMES THAT OFFICERS USE TASERS.

AND THAT'S REALLY, YOU REALLY CAN'T UNDERSTAND MUCH ABOUT USE OF FORCE BY JUST COUNTING THE NUMBER OF TIMES THINGS HAPPEN.

SO WHAT WE LOOK AT IS THE FULL CONTEXT OF THE FORCE INCIDENT.

SO WHAT HAPPENED BEFORE THE OFFICER DECIDED TO USE FORCE, WHAT WAS THE, WHAT WERE THE, UM, CIRCUMSTANCES, THE THREAT LEVEL, THE CRIME LEVEL, ET CETERA, WHAT WERE THE INTERACTIONS BETWEEN THE OFFICER AND THE SUBJECT DURING THE FORCE INCIDENT? AND THEN WHAT HAPPENED AFTER THE FORCE INCIDENT? AND WE LOOK AT THINGS AT THE INCIDENT LEVEL, THE SUSPECT LEVEL, AND THE OFFICER LEVEL.

IT'S VERY IMPORTANT TO UNDERSTAND THE, UH, SUSPECT BEHAVIOR IN ORDER TO UNDERSTAND THE OFFICER BEHAVIOR.

SO WE COLLECT ALL THE, ALL THE INFORMATION ON THAT.

AND THEN THE OTHER THING THAT WE DO THAT IS UNIQUE IS THAT WE ANALYZE THE DATA, UM, USING WHAT WE CALL LEGAL ALGORITHMS, BUT BASICALLY IT'S THE US SUPREME COURT CASE OF GRAHAM V CONNOR, WHICH, UH, IS THE FLOOR BY BY WHICH ALL USE OF FORCE THAT CAN'T GO BELOW THAT, THAT LEGAL STANDARD.

AND WE, WE EVALUATE EACH INCIDENT AND GIVE IT A SCORE BASED ON THE JUSTIFICATION, WHETHER IT'S POTENTIALLY EXCESSIVE.

UM, ONE OF THE KEY FINDINGS I WANTED TO JUST SORT OF HIGHLIGHT IS THAT WHAT WE FOUND WAS THAT USES OF FORCE ARE LINKED TO ARRESTS.

SO THE MORE USES OF FORCE OR THE MORE ARRESTS A DEPARTMENT HAS OR AN OFFICER HAS, THE MORE USES OF FORCE THEY WILL HAVE.

UM, AND ON AVERAGE, ABOUT 4% OF ALL ARRESTS RESULT IN A USE OF FORCE.

AND THERE'S, THERE'S REALLY NO WAY TO GET THAT TO ZERO, UM, NO MATTER HOW MUCH DEESCALATION TRAINING YOU DO AND OTHER THINGS, BECAUSE THERE'S, THERE'S, THESE ARE PEOPLE WHO ARE BEING ARRESTED, SO THEY GENERALLY, THEY DON'T WANT TO BE ARRESTED.

SO THERE'S ALWAYS GOING TO BE A CERTAIN PERCENTAGE OF SUSPECTS WHO ARE GOING TO FLEE FROM THE POLICE, WHO ARE GOING TO RESIST ARREST OR THREATEN OR ASSAULT THE OFFICERS.

SO

USE OF FORCE IS, IS, IS A, A NECESSARY AND JUSTIFIED, UM, IN, IN ABOUT 4% OF, OF ALL ARRESTS.

AND WHAT THIS ALSO MEANS IS THAT IF YOU HAVE OFFICERS WHO ARE VERY PROACTIVE, WHO ARE ON PATROL, WHO ARE MAKING LOTS ARRESTS, I GUARANTEE YOU THEY'RE GOING TO HAVE MORE USES OF FORCE THAN A DETECTIVE WHO'S SITTING BEHIND A DESK AND MAYBE MAKE 10 ARRESTS A YEAR.

UM, SO WE CAN'T JUDGE AN OFFICER SIMPLY BY THE NUMBER OF USES OF FORCE THEY HAVE.

WE HAVE TO LOOK AT THE FULL CONTEXT.

UM, WE ALSO FOUND THAT THE, THERE'S, EVERY DEPARTMENT HAS A GROUP, UH, OF HIGH PERFORMING OFFICERS THAT MAKE LOTS OF ARRESTS, AND THEY TEND TO MAKE UP, UH, AT LEAST ABOUT A QUARTER OF ALL THE USE OF FORCE IN THE DEPARTMENT.

UM, ONE OF THE THINGS WE LOOKED AT WAS WHETHER, UM, UH, FOR USE OF FORCE INCIDENTS, UM, UH, DO THE DEMOGRAPHICS CHANGE BASED ON WHETHER THE OFFICER INITIATED THE CONTACT VERSUS A CALLS FOR SERVICE? AND SO THE, THE DALLAS PD DATA, WHICH WE HAVE GOING BACK TO 2021, UM, SHOWS THAT ABOUT, UH, TWO THIRDS OF USE OF FORCE INCIDENTS ARE THE RESULT OF A CALL FOR SERVICE RATHER THAN, UH, AN OFFICER INITIATED CONTACT.

AND WHEN WE LOOK AT THE RACIAL, UH, DEMOGRAPHICS OF THE SUBJECTS, WE SEE VERY LITTLE DIFFERENCE, UM, IN THE DEMOGRAPHICS, WHETHER THE USE OF FORCE WAS INITIATED FROM AN OFFICER CONTACT OR A CALL FOR SERVICE.

UM, AS WE TALK ABOUT RACIAL DISPARITIES, UH, I MEAN, THIS IS, THIS IS, I MEAN, I STARTED, I STARTED WORKING ON THIS WITH THE SEATTLE RACIAL PROFILING TASK FORCE IN, IN 2001.

AND UNFORTUNATELY, THE, UM, THE, THE ADVANCEMENT IN TERMS OF THE METHODOLOGIES AND, AND, AND DATA AVAILABILITY HAS NOT ADVANCED MUCH SINCE THEN.

SO, SO WE'RE, WE'RE LOOKING AT VERY BASIC INFORMATION ON THIS, BUT ONE OF THE THINGS THAT, THAT IS IMPORTANT TO NOTE IS THAT THERE ARE RACIAL DISPARITIES IN LAW ENFORCEMENT.

NO QUESTION.

NOT ONLY IN DALLAS, BUT IN EVERY DEPARTMENT IN THE COUNTRY, BUT THERE ARE ALSO RACIAL DISPARITIES THROUGHOUT SOCIETY.

SO IF YOU LOOK AT INCOME LEVELS, UNEMPLOYMENT, EDUCATION, HEALTHCARE, HOUSING, YOU'LL ALWAYS FIND RACIAL DISPARITIES IN OUR SYSTEM.

SO THE QUESTION ISN'T DO RACIAL DISPARITIES EXIST? THE THE ISSUE IS WHY DO THEY, WHY DO RACIAL DISPARITIES EXIST AND WHAT IS THE CAUSE UNTIL WE FIGURE OUT WHAT THE CAUSE IS, WE CAN'T DEVELOP ANY TYPE OF SOLUTION FOR REDUCING THE DISPARITIES.

SO WHAT I WORK ON A LOT IS, IS TRYING TO DETERMINE THE ROOT CAUSE OF WHY THESE DISPARITIES EXIST.

UM, SO THE OTHER QUESTION IS, OKAY, WELL, WE KNOW WE HAVE RACIAL DISPARITIES IN THE CRIMINAL JUSTICE SYSTEM.

HOW CAN WE REDUCE THEM? AND AGAIN, WE HAVE TO UNDERSTAND THE ROOT CAUSE OF THOSE DISPARITIES.

SO ONE, ONE ARGUMENT IS, WELL, IT'S, IT'S A PRODUCT OF THE WAR ON DRUGS, UM, DURING THE EIGHTIES AND NINETIES THAT, UH, DISPROPORTIONATELY INCARCERATED, UM, UH, PEOPLE OF COLOR, PRIMARILY YOUNG BLACK MEN.

AND ONE OF THE THINGS THAT WE'VE FOUND WITH, WITH STATES THAT HAVE, UH, LEGALIZED, UH, DRUGS LIKE MARIJUANA, UH, SO FOR EXAMPLE, IN WASHINGTON AND CALIFORNIA, UM, WE FOUND THAT THE LEGALIZATION OF MARIJUANA WHERE THERE WERE LARGE RACIAL DISPARITIES DID NOT REDUCE RACIAL DISPARITIES IN THE CRIMINAL JUSTICE SYSTEM.

SO WE SEE THE SAME DISPARITIES AND STOPS, ARRESTS AND INCARCERATIONS AFTER LEGALIZATION AS BEFORE.

UM, ANOTHER, UM, UH, CONCEPT IS THAT THE, UH, RACIAL DISPARITIES ARE CAUSED BY, UM, OFFICER BIAS AND RACIAL PROFILING.

AND, UM, AROUND ABOUT 2000, 2001, THIS WAS A, A NATIONAL ISSUE, UM, BASED ON SOME HIGH PROFILE INCIDENTS AND, AND, AND DOCUMENTED RACIAL PROFILING BY THE NEW JERSEY STATE PATROL.

AND MANY STATES AND, AND MANY, UM, POLICE DEPARTMENTS IMPLEMENTED BIAS-FREE POLICING POLICIES AND, UH, DID IMPLICIT BIAS TRAINING AND OTHER TRAINING.

UM, AND THAT HAD ZERO IMPACT ON RACIAL DISPARITIES.

IN FACT, IN SOME JURISDICTIONS LIKE SEATTLE, THE RACIAL DISPARITIES ACTUALLY GOT WORSE AFTER THESE POLICIES WERE PUT INTO PLACE.

AND I THINK ONE OF THE REASONS IS THAT THE, THE POLICIES DIDN'T DO ANYTHING NEW BECAUSE RACIAL PROFILING, RACIAL DISCRIMINATION IS ALREADY UNCONSTITUTIONAL.

UM, AND SO THERE'S NO DEPARTMENT IN THE COUNTRY THAT WOULD CONDONE RACIAL PROFILING OR BIAS POLICING, AND OFFICERS KNOW THAT THEY CAN'T, I DON'T KNOW THAT I'D GO AS FAR AS TO SAY NO DEPARTMENT, BUT NOT OUR DEPARTMENT.

RIGHT? YEAH, TRUE, TRUE.

SO, SO THERE ARE, THERE ARE SOME EXTREME EXCEPTIONS.

AND, AND ONE, ONE EXCEPTION IS MARICOPA COUNTY, WHERE YOU HAD SHERIFF JOE ARPAIO, WHO PUBLICLY STATED THAT HE WAS RACIALLY PROFILING FOR IMMIGRATION PURPOSES.

SO THANK YOU FOR THAT CORRECTION.

UH, THERE ARE SOME EXTREME EXAMPLES, BUT CERTAINLY, UM, NO, NO ORGANIZATION

THAT I WORK WITH AND, AND, AND CERTAINLY MY EXPERIENCE IN SEATTLE, UM, AND, AND, AND ALSO, IT, IT, IT'S, EVERYONE KNOWS IT'S UNCONSTITUTIONAL.

SO, UM, WHEN YOU IMPLEMENT A POLICY THAT SAYS YOU CAN'T DO SOMETHING THAT'S ALREADY UNCONSTITUTIONAL, IT PROBABLY DOESN'T HAVE MUCH OF AN IMPACT.

AND THAT'S WHAT WE SEE, WE SEE IN THE DATA.

UM, AND SO ONE OF THE THINGS THAT, THAT I'VE BEEN FOCUSING ON IS, IS THAT THE, THE, THE POLICE DEPARTMENT, MOST, MOST OF THE TIME THEY'RE RESPONDING TO CALLS FOR SERVICE.

UM, THEY DON'T, THEY DON'T PICK AND CHOOSE WHO THEY INTERACT WITH FOR THE MOST PART.

AND SO WHAT WE'RE DEALING WITH, WITH THE RACIAL DISPARITIES IN, IN THE CRIMINAL JUSTICE SYSTEM, ARE OFTENTIMES A FUNCTION OF RACIAL DISPARITIES WITHIN SOCIETY.

UM, SO IF YOU HAVE A PARTICULAR GROUP, UH, THAT IS, UH, UH, MORE INCLINED TO BE IN POVERTY OR LOW INCOME OR HOMELESS, THOSE ARE THE INDIVIDUALS THAT ARE MOST LIKELY TO COME INTO CONTACT WITH LAW ENFORCEMENT.

UM, AND SO ONE OF THE THINGS THAT I, I LOOKED AT IN SEATTLE, I WROTE AN OP-ED FOR THE SEATTLE TIMES, AND I LOOKED AT SOME OF THE RACIAL DISPARITIES IN DIFFERENT ASPECTS IN, IN SEATTLE AND KING COUNTY WASHINGTON.

AND MY, MY THESIS WAS, IF WE WANT TO REDUCE RACIAL DISPARITIES IN, IN LAW ENFORCEMENT DATA, WE SHOULD ADDRESS THE INEQUALITIES AND DISPARITIES IN OTHER ASPECTS OF SOCIETY.

UM, AND IF WE DO THAT, IT WILL, IT WILL EVENTUALLY, IT MAY TAKE A LONG TIME, BUT IT WILL EVENTUALLY REDUCE RACIAL DISPARITIES IN, IN OUR CRIMINAL JUSTICE SYSTEM.

UM, HAVING SAID THAT, WE WE'RE, WE'RE WE, WE, WE, OUR FOCUS NOW ON DATA COLLECTION ANALYSIS TO LOOK AT RACIAL PROFILING, UM, AND RACIAL, UM, DISPAR, UM, UH, DISCRIMINATION IN LAW ENFORCEMENT.

AND JUST A LITTLE BIT OF BACKGROUND, IN 2001, I WORKED FOR THE CITY COUNCIL'S RACIAL PROFILING TASK FORCE.

WE FOCUSED A LOT ON THE ISSUE OF BENCHMARKING.

UM, AND WE'LL TALK, WE'LL TALK A LOT ABOUT BENCHMARKING IN TERMS OF MEASURING DISPARITIES.

UM, WE ALSO, UM, UH, REALLY CAME TO THE CONCLUSION THAT A RACIAL DISPARITY DOES NOT AUTOMATICALLY EQUAL RACIAL DISCRIMINATION.

SO AGAIN, WE, WE HAVE DISPARITIES IN SOCIETY, UM, AND DISPARITIES IN LAW ENFORCEMENT DATA, BUT WE CAN'T AUTOMATICALLY ASSUME THAT A HUNDRED PERCENT OF THOSE DISPARITIES ARE DUE TO BIAS OR RACIAL PROFILING OR DISCRIMINATION.

CERTAINLY, IT'S REASONABLE TO ASSUME THAT A, A CERTAIN PERCENTAGE OF THAT DISPARITY IS DUE TO DISCRIMINATION AND BIAS, BUT THE QUESTION IS HOW MUCH, UM, WE ALSO HAVE TO LOOK AT OFFICER DISCRETION, UM, VERSUS OFFICER DISCRIMINATION.

SO OFFICERS HAVE A GREAT DEAL OF DISCRETION WHEN IT COMES TO LOW LEVEL OFFENSES.

SO, FOR EXAMPLE, UH, MAKING A STOP FOR A TAILLIGHT OUT, OFFICERS MIGHT SEE HUNDREDS OF CARS EVERY DAY, UH, WITH A TAILLIGHT OUT, AND THEY CAN CHOOSE TO IGNORE.

UH, THEY CAN'T POSSIBLY STOP ALL OF THEM, SO THEY CAN CHOOSE TO IGNORE THEM, OR THEY CAN CHOOSE TO STOP THE PERSON FOR THE TAILLIGHT OUT.

SO THAT'S A HIGH DISCRETION.

IF THEY'RE RESPONDING TO A DOMESTIC VIOLENCE INCIDENT, UM, WHERE THERE'S AN INJURY, THEY MAY BE REQUIRED BY LAW TO MAKE AN ARREST, AND THERE WOULD BE NO DISCRETION INVOLVED IN THAT INCIDENT.

SO WHEN WE LOOK AT DISPARITIES, IT'S IMPORTANT TO FOCUS ON WHAT ARE THE DISPARITIES WHERE OFFICERS HAVE NO DISCRETION OR LITTLE DISCRETION VERSUS WHERE THEY HAVE A HIGH DEGREE OF DISCRETION.

UM, ONE OF THE THINGS WE DID IN SEATTLE WAS WE, WE, WE TRIED TO FILL THE, THE DATA GAP.

AND ONE OF THE GAPS THAT WE HAD WAS THAT FOR TRAFFIC STOPS, WE HAD NO DATA ON STOPS THAT DID NOT RESULT IN A TICKET.

SO WE IMPLEMENTED A WRITTEN WARNING SYSTEM FOR TRAFFIC STOPS, AND THEN WE COLLECTED DATA ON THAT.

AND THAT HELPED TO REALLY HELP US UNDERSTAND HOW OFFICERS WERE MAKING STOPS AND NOT JUST WRITING TICKETS.

UM, THE OTHER THING WE DID WAS WE IMPLEMENTED A BIENNIAL POLICE PUBLIC CONTACT SURVEY, WHICH IS SIMILAR TO THE FEDERAL SURVEY WHERE WE, WE, UM, DID A, EVERY TWO YEARS WE WOULD INTERVIEW INDIVIDUALS WHO ACTUALLY HAD CONTACT WITH THE SEATTLE POLICE TO, UM, EVALUATE BOTH AS VICTIMS AND AS SUSPECTS, UM, AND TO EVALUATE THEIR INTERACTION WITH THE POLICE.

AND, AND WE, WE LEARNED A LOT OF VALUABLE, UM, THINGS ABOUT WHEN WE MADE CHANGES IN OUR POLICIES OR TRAINING, HOW THAT MIGHT HAVE IMPACTED POLICE INTERACTIONS WITH THE PUBLIC.

AND THEN WE ALSO IMPLEMENTED A BIAS FREE POLICING POLICY AND ADDITIONAL TRAINING.

UM, SO NOW I'M GONNA START GETTING INTO THE DATA.

UM, SO, UH, THIS IS ACTUALLY FROM, UH, ONE OF THE QUESTIONS THAT I RECEIVED FROM THE BOARD.

AND, UH, THE QUESTION WAS, UM, DO, UM, DO THE DEMOGRAPHICS OF ARRESTEES, THE RACIAL DEMOGRAPHICS OF ARRESTEES DIFFER BASED ON, UH, THE OFFICER'S RACE.

AND SO I'LL JUST TRY TO SORT OF ORIENT YOU TO THESE, UM, UH, UH, GRAPHS HERE.

SO IF WE GO FIRST TO THE BOTTOM GRAPH, UM, ON THE LEFT YOU SEE THE NUMBER OF INCIDENTS.

SO THESE ARE THE TOTAL NUMBER OF INCIDENTS, UH, WHERE, UH, AN ARREST WAS MADE.

UM, UH, I'M, I'M SORRY, WE'RE STARTING WITH USE OF FORCE WHERE USE OF FORCE, UH, AN OFFICER USED FORCE, UM, UH, 7,522 INCIDENTS BETWEEN 2021 AND 2023.

SO, UM, I'M, I'M PRETTY SURE THE, THE DEPARTMENT IS MAJORITY WHITE, UM, WHICH IS WHY MOST OF THE, UH, A LARGE PERCENTAGE OR NUMBER OF THE USE OF FORCE ARE WITH INVOLVE WHITE OFFICERS, UM, FOLLOWED BY HISPANIC, THEN BLACK OFFICERS, ASIAN OFFICERS, AND THE NATIVE AMERICAN OFFICERS.

UM, AND THEN, UM, WE HAVE, UH, THE SUBJECT RACE.

SO IF WE GO, UM, TO THE TOP, SO WE SEE WHITE OFFICERS, SO THESE ARE WHITE OFFICERS WHO USED FORCE.

SO WE SEE FOR, UH, BLACK SUSPECTS, UM, 55% OF ALL USE OF FORCE BY WHITE OFFICERS INVOLVED A BLACK SUSPECT.

AND FOR HISPANIC OFFICERS, IT WAS ALSO 55%.

FOR BLACK OFFICERS, IT WAS A LITTLE BIT HIGHER AT 61% ASIAN OFFICERS, 48%, AND NATIVE AMERICAN 55%.

SO THE WAY TO READ THIS IS THAT WHEN, WHEN OFFICERS USE FORCE, IF THE, IF THE OFFICER IS BLACK, THEY'RE SLIGHTLY MORE LIKELY TO, UH, HAVE USED FORCE AGAINST A BLACK SUSPECT THAN WHITE, HISPANIC, ASIAN, OR NATIVE AMERICAN OFFICERS.

UM, WHEREAS WHITE AND HISPANIC OFFICERS AND NATIVE AMERICANS ARE, ARE PRETTY MUCH THE SAME IN TERMS OF THEIR, UM, THE DEMOGRAPHICS OF THEIR SUBJECTS.

DOES THAT MAKE SENSE? MR. SCALE'S? TRYING TO INTERRUPT HERE.

YOU'RE SAYING THE, THE PERCENTAGE RANGES FROM 55 TO 61%, IS THAT RIGHT? 55, 55 AND 61.

YEAH.

SO THE WAY, THE WAY TO READ THIS IS IF YOU READ THEM ACROSS, IT'LL ADD UP TO A HUNDRED PERCENT.

SO OF, OF, UM, SO ON AVERAGE, YOU KNOW, ABOUT 55% OF ALL USE OF FORCE INCIDENTS ARE, ARE, UH, INVOLVE A BLACK SUSPECT AND, UM, SLIGHTLY HIGHER PERCENTAGE IF YOU'RE A BLACK OFFICER, AND SLIGHTLY LOWER IF YOU'RE AN ASIAN OFFICER.

BUT IT'S IN, IN TERMS OF PERCENTAGES, STATISTICS, WHATEVER IT IT APPEARS TO BE, THEY'RE ALL WITHIN THE SAME RANGE.

IS THAT RIGHT, OR AM I MISREADING THAT? IN OTHER WORDS, IT'S NOT, DOESN'T MAKE A BIG DIFFERENCE THE RACE OF THE ARRESTING OFFICER, RIGHT? I, YES.

AND SO, SO THIS WAS A QUESTION THAT, THAT THE BOARD HAD.

AND SO I, I, I, I BASICALLY TRIED TO, UH, DO THIS GRAPHICALLY, UM, BECAUSE WE HAVE DATA ON OFFICER DEMOGRAPHICS AS WELL AS SUSPECT DEMOGRAPHICS.

BUT YES, THE WAY THAT I WOULD, I WOULD READ THIS IS THAT THERE IS NOT A LOT OF DIFFERENCE IN TERMS OF THE DEMOGRAPHICS OF SUSPECTS THAT HAVE FORCED USED AGAINST THEM BASED ON THE OFFICER'S RACE.

IT'S SLIGHTLY HIGHER FOR BLACK OFFICERS AND SLIGHTLY LOWER FOR ASIAN OFFICERS, BUT THESE DIFFERENCES ARE NOT VERY SIGNIFICANT.

UM, I ALSO HAVE DATA ON ARREST.

UM, SO FIRST WE WERE LOOKING AT USE OF FORCE, AND NOW WE'RE LOOKING AT ARRESTS FROM 2020 TO 2024, ABOUT 32,000 ARRESTS.

SO WE READ THIS IN THE SAME WAY, UM, WHITE OFFICERS, UH, OR THE RACE OF THE OFFICERS VERSUS THE RACE OF THE SUSPECT.

UM, SO WE SEE A SORT OF A SIMILAR PATTERN HERE, UM, WHERE FOR WHITE, HISPANIC AND NATIVE AMERICAN OFFICERS, ABOUT 44% OF ALL THEIR ARRESTS INVOLVE A BLACK SUSPECT, AND IT'S SLIGHTLY HIGHER FOR BLACK OFFICERS AND SLIGHTLY LOWER FOR ASIAN OFFICERS.

UM, I WAS ALSO ASKED ABOUT, UM, THE RACE OF VICTIMS VERSUS THE RACE OF ARRESTEES.

UM, SO AGAIN, THIS IS 2020 TO 2024, UH, TOTAL OF 5,152 ARRESTS.

SO, UM, THE VICTIM RACE IS LISTED ON THE LEFT AND THEN THE SUSPECT RACE AT THE TOP.

SO, UH, THE WAY TO READ THIS IS THAT, UM, BLACK VICTIMS, UM, REPORT, UH, OR 75% OF SUSPECTS WHO ARE ARRESTED FOR VICTIMIZING A BLACK VICTIM ARE, ARE BLACK.

UM, SO, UM, WHEREAS WE LOOK AT HISPANICS AND WE SEE THAT 53% OF HISPANIC VICTIMS REPORT THAT THE SUSPECT WAS HISPANIC.

AND THEN FOR WHITE SUSPECTS, 32% OF WHITE SUSPECTS REPORT THAT THE, THE, I'M SORRY, VICTIMS REPORT THAT THE SUSPECT WAS WHITE.

SO WE SEE, UM, A LOT OF, UM, SORT OF SIMILARITIES.

WERE SORT OF A PEAK WHERE YOU HAVE THE SAME RACE OF THE SUSPECT

AND THE VICTIM.

AND I THINK THE REASON FOR THAT IS THAT A LOT OF THESE INCIDENTS, UM, INVOLVE SOME TYPE OF, OF, UH, VIOLENT CRIME.

SO YOU, YOU COULD, IT COULD BE A DOMESTIC VIOLENCE SITUATION WHERE YOU HAVE A FAMILY MEMBER, IT COULD BE A NEIGHBOR OR A FRIEND SITUATION, IT COULD BE A WORKPLACE SITUATION.

UM, BUT GENERALLY WE SEE THAT, UM, CERTAINLY FOR, FOR BLACK INDIVIDUALS, A A MAJORITY OF BLACK VICTIMS, THE SUSPECT WAS BLACK THREE QUARTERS OF THE TIME.

DOES THAT MAKE SENSE? UM, ANOTHER, UM, ISSUE OBVIOUSLY THAT THE BOARD IS LOOKING AT OUR, OUR, UM, UH, DRUG ARRESTS, UH, BY RACE.

AND SO I ALSO HAD THAT DATA IN SOME OF THE ARREST STATISTICS.

UM, SO AGAIN, THIS IS, THIS IS, UH, GOING BACK A LITTLE BIT FURTHER.

THIS IS ACTUALLY DATA THAT I GOT FROM THE OPEN DATA PORTAL, WHICH I KNOW THAT THE BOARD HAS ALSO LOOKED AT SOME OF THAT DATA AS WELL.

SO THIS IS, UM, 11 YEARS OF DATA.

UM, SO WE HAVE VERY LARGE DATA SET.

UM, AND AGAIN, WE'RE READING THIS THE SAME WAY.

SO WE HAVE THE DIFFERENT TYPES OF DRUGS THAT THE, UM, SUSPECT WAS ARRESTED FOR.

UM, AND SO WE CAN SEE THAT FOR, FOR MARIJUANA, BOTH CULTIVATED AND PROCESSED MARIJUANA, 63% OF ARRESTS, UM, FOR, FOR MARIJUANA WERE BLACK INDIVIDUALS.

WHEREAS IF WE GO DOWN TO METHAMPHETAMINE, UM, WHICH IS THE THIRD MOST COMMON DRUG, ONLY 28%, AND THEN WE SEE A PEAK FOR, UM, UH, OR A, A HIGHER AMOUNT FOR HISPANIC AND WHITE, UH, SUBJECTS FOR METHAMPHETAMINE.

SIMILAR FOR HEROIN ONLY 19% OF HEROIN ARRESTS ARE BLACK SUSPECTS, WHERE 50% OF THE ARRESTS WERE HISPANIC AND 31% WHITE.

UM, AND THIS IS VERY SIMILAR TO, UM, PATTERNS THAT I'VE SEEN IN SEATTLE AND ELSEWHERE, WHERE, UM, UH, ALSO YOU CAN SEE DIFFERENCES FOR CRACK COCAINE VERSUS POWDER COCAINE, WHERE A HIGHER PERCENTAGE OF BLACK ARRESTS FOR CRACK COCAINE AND A LOWER PERCENTAGE FOR POWDER COCAINE.

UM, AND THIS IS VERY SIMILAR TO, TO IN SEATTLE, WE DID A VERY EXTENSIVE STUDY LOOKING AT OPEN AIR DRUG MARKETS.

AND IN THE BELLTOWN NEIGHBORHOOD, IT WAS A HEAVILY CRACK MARKET AND IT WAS ABOUT 75%, UM, BLACK SUSPECTS.

AND THEN ON CAPITOL HILL IT WAS PREDOMINANTLY HEROIN MARKET, AND, UH, BOTH THE SELLERS AND THE, AND THE, AND THE USERS WERE PREDOMINANTLY WHITE.

UM, SO WE DO SEE DEMOGRAPHIC, UM, SIGNIFICANT DEMOGRAPHIC DIFFERENCES IN, UM, NOT, UH, IN, IN, BASED ON THE, ON THE TYPE OF DRUG INVOLVED.

SO NOW I WANTED TO TALK ABOUT POPULATION BENCHMARKS BECAUSE I WOULD SAY MOST, MOST MEDIA OUTLETS, UM, MOST ADVOCACY GROUPS WILL USE, UH, WHEN THEY LOOK AT RACIAL DISPARITIES IN LAW ENFORCEMENT DATA, THEY USE POPULATION, UH, AS A BENCHMARK.

AND I CAN TELL YOU THAT EVERY SINGLE AGENCY THAT I'VE LOOKED AT AND ALL THE, THE NATIONAL REPORTS AND SO FORTH THAT USE POPULATIONS AS A BENCHMARK, EVERY SINGLE JURISDICTION WILL HAVE SIGNIFICANT RACIAL DISPARITIES.

UM, AND THE REASON THAT PEOPLE USE, I THINK, CENSUS POPULATION IS THAT IT'S EASY TO OBTAIN, IT'S AN EASY BENCHMARK TO USE BECAUSE WE HAVE CENSUS DATA ON, ON EVERYTHING DOWN TO THE BLOCK GROUP LEVEL.

UM, THE PROBLEM IS, IS THAT IN ORDER TO
